2000-23955 RESO RESOLUTION No. 2000-23955 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE EIGHTH AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1999/00, IN THE AMOUNT OF $70,403, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS. WHEREAS, Section 932.705, Florida Statutes, addresses the purpose and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Eighth Amendment to the FY 99/00 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $70,403, as reflected in the attached Exhibit "A". These include poor or non-existent lighting, overgrown shrubbery, lack of signage, existing telephones, litter and open areas underneath the boardwalk. All of the relevant City Departments as well as representatives from Miami Dade County have been brought together under the leadership of Asst. City Manager Janet Gavarrete, and a strategy to correct the environmental issues has been developed. The Police Department has agreed to fund portions of the strategy with Law Enforcement Trust funds. Funding is being provided for the removal of existing phones and the installation of an Emergency 911 Phone system. Funding is also being provided to backfill underneath the boardwalk from 21 st to 22nd Streets. The Police Department believes that the environmental improvements will improve the boardwalk aesthetically and prevent crime as well as improve the ability to patrol the area. THE DADE COUNTY CHIEFS OF POLICE MEETING/ BANQUET - This meeting is a principal forum in Miami-Dade County for the discussion of matters of interest to the law enforcement community. All Chiefs and members of their staffs, who are members of the Dade County Chief of Police Association, are invited, as well as a number of local dignitaries. LITTLE ACORNS CRIME AND DRUG PREVENTION FAMILY TRAINING PROGRAM - Little Acorns has been a valuable non-profit partner to the Public School System and local law enforcement and private agencies serving youth and families since 1984. More than seven thousand students and parents have graduated from its juvenile drug, crime and drop-out prevention training program. TO: FROM: ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS Florida Statute 932.705 provides for expenditures of forfeiture funds for law enforcement purposes. The Chief of Police of the City of Miami Beach has reviewed and identified the need for the appropriation and has established that the expenditures of forfeiture funds is in compliance with Section 932.705, Florida State Statutes. These forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has complied with all statutory procedures involved in the transaction of these funds. The Administration requests authorization to adopt the Eighth Amendment to the operating budget for the FY 1999/00 Police Confiscation Trust Fund in the amount of $70,403, from State funds to be used to provide for the expenditures listed in Exhibit "A".
