A RESOLUTION OF THE CHAIRMAN AND THE MEMBERS OF THE
MIAMI BEACH REDEVELOPMENT AGENCY APPROVING
AMENDMENT NO. 5 TO THE AGREEMENT BETWEEN THE MIAMI
BEACH REDEVELOPMENT AGENCY AND KIMLEY-HORN AND
ASSOCIATES, INC., DATED FEBRUARY 17TH, 1999, FOR PROFESSIONAL
ENGINEERING AND LANDSCAPING SERVICES, IN AN AMOUNT NOT-
TO-EXCEED $8,500.00 FOR DESIGN, COORDINATION AND
PREPARATION OF CONSTRUCTION DOCUMENTS FOR TWO
MONUMENT IDENTIFICATION SIGNS AT SOUTH POINTE PARK, TO
BE INCLUDED AS PART OF PHASE I OF THE SOUTH POINTE
REDEVELOPMENTAREASTREETSCAPEPROJECT
WHEREAS, on January 20, 1999, the Chairman and Members of the Miami Beach
Redevelopment Agency (RDA) authorized the Executive Director and RDA staff to negotiate an
agreement with Kimley-Horn and Associates, Inc. (the Agreement), to provide professional
engineering and landscaping services for design of street improvements in the South Pointe
Redevelopment Area (the Project); and
WHEREAS, staff has negotiated a not-to-exceed fee of$170,760 for the preparation of
the final Master Plan and opinion of probable cost for the entire Project; and
WHEREAS, the scope of services included in the initial phase of work consisted of data
collection and a review of existing documents, resulting in the preparation of a Master Plan and
surveying for the Phase I improvements; and
WHEREAS, on May 26, 1999, the RDA approved Amendment No.1 to the Agreement,
which included a not -to-exceed fee, in the amount of $3 89,100, for the preparation of construction
documents, permitting and bidding services for Phase I; and
WHEREAS, on May 26, 1999, the RDA approved Amendment No.2 to the Agreement,
which included a not-to-exceed fee, in the amount of$103,800, including surveying, Master Plan
design, preparation of bidding and construction documents, and permitting for the Washington
Avenue extension, as required by the Porto fino Settlement Agreement; and
WHEREAS, on October 20, 1999, the RDA approved Amendment No.3, which included
a not-to-exceed fee in the amount of $70,925, for a Phase II survey, including geo-technical
studies, aerial photos and other expenses; and
WHEREAS, on February 9, 2000, the RDA approved Amendment No.4, which included
a not-to-exceed fee in the amount of $22,500 for survey, construction documentation, permitting
services and geo-technical studies to modify the existing parking lot located at South Pointe Park
for its connection with the driveway entrance provided into Park; and
WHEREAS, in order to meet the time schedule prepared as part of the Master Plan, the
Phase I construction documents were completed last March, the construction bid is currently
underway, and the contract is estimated to be awarded by late May; and
WHEREAS, due to the short time frame to incorporate the South Pointe Park's
identification signage design into the Phase I construction documents, it is recommended that
these plans be completed and issued as Amendment No.5 to the Agreement; and
WHEREAS, the design will include two monument signs: a primary sign at the
Washington Avenue median, just south of Biscayne Street, and a secondary sign at the southeast
corner of Washington Avenue and South Pointe Park entry road; and
WHEREAS, all improvements will be fully coordinated with the Park's design, as
required; and
WHEREAS, the signs will also reference the Smith & Wollensky Restaurant, located in
the Park, for which the restaurant owner has agreed to fund the construction hard costs associated
with this Project; and
WHEREAS, the proposed not-to-exceed fee for the design of two monument signs at
South Pointe Park is $8,500.00 with the following defined tasks: Schematic Design - $2,500.00;
Design Development - $1,800.00; Construction Documents - $3,300.00; Public Meetings and
Presentations - $550.00; and Reimbursements - $350.00.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND
MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY, that the Chairman
and Members of the Miami Beach Redevelopment Agency herein approve the attached
Amendment No.5 to the Agreement with Kimley-Horn and Associates, Inc., dated February 17th,
1999, for professional engineering and landscaping services, in an amount not-to-exceed
$8,500.00 for design, coordination and preparation of construction documents for two monument
identification signs at South Pointe Park; to be included as part of phase I of the South Pointe
Redevelopment Area streetscape project.

SCOPE OF SERVICES
Task 1 - Schematic Design Phase
1. This phase includes those services necessary to prepare concept
drawings and other documents illustrating the general scope,
scale and relationship of the project components. We will
review applicable local ordinances, and review the Client's
design and budget criteria to establish the project program and
design objectives. We will provide three monument sign
concepts for the median sign, which will represent low, medium
and high cost options. The schematic design concepts will be
presented via elevation/cross-sections and plan graphics and will
address the following:

Landscape plantings;
Landscape and feature lighting;
Design criteria established by the Client, Owner.

the schematic level design effort.
3. We will attend one meeting with representatives from the Smith

4. Preparation of an Opinion of Probable Cost.
Task 2 - Design Development Phase
1. This phase includes the design development of schematic level
designs approved by the Client and a revised budget, based on
the funding agreement between the City of Miami Beach and
The Smith and Wollensky Restaurant Group.
2. Those elements included in this phase will be those listed in the
schematic design phase and the preparation of the secondary
monument sign design development drawings based on the
approved schematic design and revised budget

3. Design development will incorporate input received during the
schematic design workshop and will include an additional Client
meeting to review design development level drawings.
4. We will prepare design development plans for review by the
Client. This submittal will include the design development plans
and revised graphics for both monument signs,
5. Preparation of an opinion of probable construction costs.
Task 3- Construction Document Phase
1. This phase includes those designated services necessary to
prepare further drawings, specifications and related documents
setting forth in detail the requirements for construction of the
project and for contracting for construction from the approved
design development documents. This phase is specifically
limited the preparation of construction documents for 2
monument signs and associated landscaping, irrigation and
lighting as described within Task 1 and 2. Construction
document plans will generally consist of the following sheets:
a. Signage plans/elevations and details
b. Landscape plans and supporting specifications
c. Irrigation specifications and details
d. Lighting fixture specifications and electrical notes.
e. Electrical conduit layout revision and circuitry (as
required)
Task 4 - Public Meetings and Presentations
Our proposal includes the attendance/presentation of the improvements at one
coordination meeting with City staff, The Smith and Wollensky Restaurant
Group and other consultants associated with the South Pointe Park Master Plan
Improvements.
ADDITIONAL SERVICES
Upon your authorization, we will provide any additional services that may be
required beyond those described in Task 1 through 4. These services may include
but are not limited to such items as the following:
· Preparation of computer images depicting the proposed monument signs
from specified views.

Adopt the Resolution.
ANALYSIS
On January 20, 1999, the Chairman and Members of the Miami Beach Redevelopment Agency
(RDA) authorized the Executive Director and RDA staff to negotiate an agreement with Kimley-
Horn and Associates, Inc. (the Agreement), to provide professional engineering and landscaping
services for design of street improvements in the South Pointe Redevelopment Area (the Project).
The RDA staff negotiated a not-to-exceed fee of $170,760 for the preparation of the final Master
Plan and opinion of probable cost for the entire Project. The scope of services included in the initial
phase of work consisted of data collection and a review of existing documents resulting in the
preparation of a Master Plan and surveying for the Phase I improvements.

On May 26, 1999, the RDA approved Amendment No.1, which included a not-to-exceed fee in the
amount of $389,100 for the preparation of construction documents, permitting and bidding services
for Phase I.
On May 26, 1999, the RDA approved Amendment No.2, which included a not-to-exceed fee in the
amount of $103,800 including surveying, Master Plan design, preparation of bidding and
construction documents and permitting for the Washington Avenue extension, as required by the
Porto fino Settlement Agreement.
On October 20, 1999, the RDA approved Amendment No.3, which included a not-to-exceed fee in
the amount of $70,925 for Phase II survey, including geo-technical studies, aerial photos and other
expenses.
On February 9, 2000, the RDA approved Amendment No.4, which included a not-to-exceed fee in
the amount of$22,500 for survey, construction documentation, permitting services and geo-technical
studies to modify the existing parking lot located at South Pointe Park for its connection with the
driveway entrance provided into Park.
In order to meet the time schedule prepared as part of the Master Plan, the Phase I construction
documents were completed last March, the construction bid is currently underway, and the contract

On May 26, 1999, the RDA approved Amendment No.1, which included a not-to-exceed fee in the
amount of $389, 1 00 for the preparation of construction documents, permitting and bidding services
for Phase I.
On May 26, 1999, the RDA approved Amendment No.2, which included a not-to-exceed fee m the
amount of $103,800 including surveying, Master Plan design, preparation of bidding -and
construction documents and permitting for the Washington A venue extension, as required by the
Portofino Settlement Agreement.
On October 20, 1999, the RDA approved Amendment No.3, which included a not-to-exceed fee in
the amount of $70,925 for Phase II survey, including geo-technical studies, aerial photos and other
expenses.
On February 9, 2000, the RDA approved Amendment No.4, which included a not-to-exceed fee in
the amount of$22,500 for survey, construction documentation, permitting services and geo-technical
studies to modify the existing parking lot located at South Pointe Park for its connection with the
driveway entrance provided into Park.
In order to meet the time schedule prepared as part of the Master Plan, the Phase I construction
documents were completed last March, the construction bid is currently underway, and the contract
is estimated to be awarded by late May. Due to the short time frame to incorporate the South Pointe
Park's identification signage design into the Phase I construction documents, it is recommended that
these plans be completed and issued as Amendment No.5 to the Agreement. The design will include
two monument signs: a primary sign at the Washington Avenue median, just south of Biscayne
Street, and a secondary sign at the southeast corner of Washington Avenue and South Pointe Park
entry road. All improvements will be fully coordinated with the Park's design, as required.
The signs will also reference the Smith & Wollensky Restaurant, located in the Park, for which the
restaurant owner has agreed to fund the construction hard costs associated with this Project.
The proposed not-to-exceed fee for the design of two monument signs at South Pointe Park is
$8,500.00 with the following defined tasks:

The Administration recommends that the Mayor and City Commission ratify Amendment No.5 to

LANDSCAPE ARCHITECTURAL SERVICES, FOR DESIGN,
COORDINATION AND PREPARATION OF CONSTRUCTION
DOCUMENTS FOR TWO MONUMENT SIGNS AT SOUTH POINTE
PARK, TO BE INCLUDED AS PART OF PHASE I OF THE SOUTH
POINTE REDEVELOPMENT AREA STREETSCAPE PROJECT
This Amendment No.5, dated as of ~1JfJ1 /0 , 2000, to that certain
Professional Services Agreement (Agreement), ~ebruary 17, 1999, by and between the
Miami Beach Redevelopment Agency (RDA) and Kimley-Hom and Associates, Inc.
(Consultant).
RECITALS
WHEREAS, the Agreement provides for the preparation of the final Master Plan for the
South Pointe Redevelopment Area Project; and
WHEREAS, this Amendment No.5 to the Agreement provides for design, coordination
and preparation of construction documents for two monument signs at South Pointe Park, to be
included as part of Phase I of the South Pointe Redevelopment Area Streetscape Project; and
WHEREAS, the design will include two monument signs: a primary sign at the
Washington Avenue median, just south of Biscayne Street; and a secondary sign at the southeast

hereto and incorporated herein as Exhibit "A-5".
3. OTHER PROVISIONS
All other provisions of the Agreement, as amended, are unchanged.
4. RATIFICATION
The RDA and Consultant ratify the terms of the Agreement, as modified by this
Amendment No. 5.

SCOPE OF SERVICES
Task 1 - Schematic Design Phase
I. This phase includes those services necessary to prepare concept
drawings and other documents illustrating the general scope,
scale and relationship of the project components. We will
review applicable local ordinances, and review the Client's
design and budget criteria to establish the project program and
design objectives. We will provide three monument sign
concepts for the median sign, which will represent low, medium
and high co:;t options. The schematic design concepts will be
presented via elevation/cross-sections and plan graphics and will
address the following:
a. Project entry signage and special features;
b. Landscape plantings;
c. Landscape and feature lighting;
d. Design criteria established by the Client, Owner.
e. Comments from the Smith and Wollensky Restaurant
Group

We will participate in one schematic design review with the
RDA and planning department staff for the purpose of reviewing
the schematic level design effort.

Task 2 - Design Development Phase
1. This phase includes the design development of schematic level

the funding agreement between the City of Miami Beach and

3. Design development will incorporate input received during the
schematic design workshop and will include an additional Client
meeting to review design development level drawings.
4. We will prepare design development plans for review by the
Client. This submittal will include the design development plans
and revised graphics for both monument signs.
5. Preparation of an opin ion of probable construction costs.
Task 3- Construction Document Phase
1. This phase includes those designated services necessary to
prepare further drawings, specifications and related documents
setting forth in detail the requirements for construction of the
project and for contracting for construction from the approved
design development documents. This phase is specifically
I im ited the preparation of construction documents for 2
monument signs and associated landscaping, irrigation and
lighting as described within Task I and 2. Construction
document plans will generally consist of the following sheets:
a. Signage plans/elevations and details
b. Landscape plans and supporting specifications
c. Irrigation specifications and details
d. Lighting fixture specifications and electrical notes.
e. Electrical conduit layout revision and circuitry (as
required)
Task 4 - Public Meetings and Presentations
Our proposal includes the attendance/presentation of the improvements at one
coordination meeting with City stalf. The Smith and Wollensky Restaurant
Group and other consultants associated with the South Pointe Park Master Plan
Improvements.
ADDITIONAL SERVICES
Upon your authorization, we will provide any additional services that may be
required beyond those described in Task I through 4. These services may include
but are not limited to such items as the following:
· Preparation of computer images depicting the proposed monument signs
from specified views.
