A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, DESIGNATING THE AREA BOUNDED BY 6TH
STREET TO THE NORTH; 5TH STREET TO THE SOUTH; ALTON ROAD TO THE
WEST; AND LENOX AVENUE TO THE EAST, AS A BROWNFIELD AREA, TO
PROMOTE THE ENVIRONMENTAL RESTORATION AND ECONOMIC
REDEVELOPMENT OF THE AREA.
WHEREAS, the properties located within the area that is bounded by 6th Street to the
North; 5th Street to the South; AIton Road to the West; and Lenox Avenue to the East; have
historically been utilized for automotive repair shops, paint and body shops, gas stations and
other industrial uses; and
WHEREAS, the potential for these industries to impair the environment through the
release of petroleum products, solvents and other hazardous materials is well known; and
WHEREAS, the development potential of the subject properties has been negatively
impacted by known and perceived environmental problems associated with these industrial
uses; and
WHEREAS, the Florida Department of Environmental Protection has recognized that
there are a large number of abandoned, idle or under-utilized industrial and commercial
properties whose redevelopment is complicated by actual or perceived environmental
contamination; and
WHEREAS, the State has classified these properties as "brownfields" and created the
Brownfields Redevelopment Program to help stimulate the revitalization of brownfields; and
WHEREAS, the State's Brownfields Redevelopment Program provides liability
indemnifications, greater flexibility in remediation criteria, corporate & intangible tax credits,
and other incentives to developers of brownfield properties; and
WHEREAS, Potamkin Properties is the sole owner of the subject properties and plans
to remediate any environmental problems and redevelop the property at its expense; and
WHEREAS, because the subject properties are urban, and have been negatively
impacted by known or perceived environmental problems, they are eligible to be designated
as a Brownfield Area; and
WHEREAS, Potamkin Properties is therefore requesting to have the subject property
designated as a Brownfield Area, in order for it to be eligible to receive the benefits provided
by the State's Brownfields Redevelopment Program; and
WHEREAS, by designating the property as a Brownfield Area, the City assumes no
liability for the remediation of the properties and does not agree to incur any expense or to
approve any development agreements, variances or waivers associated with the redevelopment
of the proposed area.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the area bounded
by 6th Street to the North; 5th Street to the South; Alton Road to the West; and Lenox Avenue
to the East; is hereby designated as a Brownfield Area to promote the environmental
restoration and economic redevelopment of the area.

ANAL YSIS
Historically, the properties located within the area that is bounded by 6th Street to the North, 5th Street to
the South, Alton Road to the West, and Lenox Avenue to the east, have been predominately utilized for
automotive repair shops, paint and body shops, gas stations and other industrial uses. The potential for
these industries to impair the environment through the release of petroleum products, solvents and other
hazardous materials readily exists. As a result, the development potential of the subject properties has been
negatively impacted by known and perceived environmental problems associated with these industrial
property uses.
The Florida Department of Environmental Protection has recognized that there are a large number of
abandoned, idle or under-utilized industrial and commercial properties whose redevelopment is
complicated by actual or perceived environmental contamination. The State classified these properties as
"Brownfields" and created the Brownfields Redevelopment Program to help stimulate the revitalization
of brownfield areas. The Program provides liability indemnifications, greater flexibility in remediation
criteria, corporate & intangible tax credits, and other incentives to developers of brown field properties.

Potamkin Properties (alk/a A & R SoBe LLC) (Potamkin) is the sole owner of the entire block of subject
property. Potamkin plans to remediate any environmental problems and redevelop the property at their
expense. (Because the subject properties are urban, and have been negatively impacted by known or
perceived environmental problems, they are eligable to be designated as a Brownfield Area.) Therefore,
Potamkin Properties is requesting to have the subject property designated as a Brownfield, in order for
them to be eligible to receive the benefits provided by the State's Brownfields Redevelopment Program.
By designating the property as a Brownfield Area, the City assumes no liability for the remediation of the
properties and does not agree to incur any expense or to approve any development agreements, variances
or waivers associated with the redevelopment of the proposed brownfield area.
Therefore, the City Commission should adopt the attached Resolution designating the area bounded by 6th
Street to the North, 5th Street to the South, Alton Road to the West and Lenox Avenue to the East, as a
Brownfield Area to promote the environmental restoration and economic redevelopment of the area.
