A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE
RECOMMENDATION OF THE CITY MANAGER PERTAINING TO THE
RANKING OF FIRMS PURSUANT TO REQUEST FOR PROPOSALS
(RFP) NO. 30-05/06 FOR THE MANAGEMENT AND OPERATION OF: 1)
A GREEN (FARMERS) MARKET ON LINCOLN ROAD; 2) A STREET
MARKET ON ESPANOLA WAY; 3) A STREET MARKET IN NORMANDY
VILLAGE; AND 4) AN ANTIQUE AND COLLECTIBLES MARKET ON
LINCOLN ROAD; AUTHORIZING THE ADMINISTRATION TO ENTER
INTO NEGOTIATIONS WITH THE MARKET COMPANY, INC. FOR A
GREEN (FARMERS) MARKET ON LINCOLN ROAD; WITH THE
MARKET COMPANY, INC. FOR A STREET MARKET ON ESPANOLA
WAY; WITH THE MARKET COMPANY, INC. FOR A STREET MARKET
IN NORMANDY VILLAGE; AND WITH PRODUCTION SUO, INC. FOR
AN ANTIQUE AND COLLECTIBLES MARKET ON LINCOLN ROAD;
AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AGREEMENTS UPON THE COMPLETION OF SUCCESSFUL
NEGOTIATIONS BY THE ADMINISTRATION.
WHEREAS, the Mayor and City Commission, at its March 17, 2004 meeting,
adopted resolutions, approving concession agreements for open-air markets on certain
City public right-of-ways, though a competitive RFP process, for an Espanola Way (Arts
& Crafts) Street Market, a Green (Farmers) Market on Lincoln Road, and a Normandy
Village Street Market; and
WHERAS, the Mayor and City Commission at its September 8, 2004 meeting,
adopted a resolution approving the Lincoln Road Antique and Collectibles Market, which
operates from October 151 through May 3151; and
WHEREAS, the agreements for the Espanola Way Street Market, the Green
(Farmers) Market on Lincoln Road, and the Street Market in Normandy Village, had
expired on March 31,2006; and
WHEREAS, the agreement for the Antique and Collectibles Market on Lincoln
Road is expiring on September 30, 2006; and
WHEREAS, the City Commission at its April 11, 2006 meeting, authorized the
issuance of an RFP, and further approved the extensions of the Market agreements on a
month-to-month basis; and
WHEREAS, on May 31, 2006, RFP No. 30-05/06 was issued and notices sent to
over 40 firms; and
WHEREAS, on the specified due date, the Procurement Division received
proposals from the following firms, for the following Markets:
Lincoln Road Green (Farmers) Market -The Market Company, Inc.;
Street Market on Espanola Way - The Market Company, Inc. and Universal Light of the
Blind, Inc.;
A Street Market in Normandy Village -The Market Company, Inc.;
Antique and Collectibles Market on Lincoln Road - Production Sud, Inc.; and
WHEREAS, on July 28, 2006, the City Manager via Letter to Commission No.
191-2006 appointed an Evaluation Committee (the "Committee"), consisting of the
following individuals:
Sandra Rodriguez -Vice President, 420 Lincoln Road Associates;
Daniel Veitia -President Elect, North Beach Development Corp.;
Robert Halfhill - Asst. Director, CMB Public Works;
Rhonda McPherson - Asst. Director, CMB Sanitation Dept.;
Jimmy McMillion - Special Projects Coordinator, CMB Neighborhood Services;
Ana Cecilia Velasco - Asset Manager, CMB Office of Asset Management;
Odalys Mon - Representing the Lincoln Road Marketing Association; and
WHEREAS, the Committee convened on August 23, 2006, and was provided
with an overview of the project, information relative to the City's Cone of Silence
Ordinance, and the Government in the Sunshine Law; and
WHEREAS, the Committee was instructed to score and rank each proposal
pursuant to the evaluation criteria established in the RFP, which was as follows (total
possible 100%):
. Financial - 30%;
· Experience and Qualifications - 35%;
· Methodology and Approach - 20%;
· Past Performance Based on Client Surveys - 15%; and
WHEREAS, the Committee discussed each of the proposals and proceeded to
score them; and
WHEREAS, there was one proposal submitted for each the Lincoln Road Green
(Farmers) Market; A Street Market in Normandy Village; and the Antique and
Collectibles Market on Lincoln Road, and the proposals submitted were from the firms
currently under contract for the same; and
WHEREAS, overall, the Committee was pleased with the current contractors for
the four Markets, and voted unanimously in favor of going forward with new contracts;
and
WHEREAS, the Committee scored the two proposals received for the Market on
Espanola Way; and
WHEREAS, the proposal from Universal Light of the Blind, Inc., did not provide
financial background, experience and qualifications, or past performance to deem them
a viable choice; and
WHEREAS, the Committee was unanimous in their decision to not rank
Universal Light of the Blind as a second choice, and instead supported issuing a new
RFP if negotiations were unsuccessful with The Market Company, Inc. to continue to
manage and operate the Market on Espanola Way; and
WHEREAS, the City Manager concurs with the Committee's recommendations.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby accept the recommendation of the City Manager pertaining to the
ranking of firms pursuant to Request for Proposals (RFP) No. 30-05/06, for the
Management and Operation of: 1) A Green (Farmers) Market on Lincoln Road; 2) A
Street Market on Espanola Way; 3) A Street Market in Normandy Village; and 4) An
Antique and Collectibles Market on Lincoln Road; authorize the Administration to enter
into negotiations with The Market Company, Inc. for a Green (Farmers) Market; with the
Market Company, Inc. for a Street Market on Espanola Way; with the Market Company,
Inc. for a Street Market in Normandy Village; and with Production Sud, Inc. for an
Antique and Collectibles Market on Lincoln Road; and further authorize the Mayor and
City Clerk to execute agreements upon conclusion of successful negotiations by the
Administration.

Item Summary/Recommendation:
The agreements for the Green (Farmers) Market on Lincoln Road, the Street Market on Espanola Way,
and the Street Market in Normandy Village, had expired on March 31, 2006, and the Antique and
Collectibles Market on Lincoln Road is expiring on September 30, 2006. The City Commission at its April
11, 2006 meeting authorized the issuance of an RFP, and further approved the extensions of said
agreements on a month-to-month basis. Request for Proposals (RFP) NO.30-05/06 was issued for the
above mentioned Markets, and sent to over 40 firms. Proposals from the following firms, for the following
Markets were received:
Lincoln Road Green (Farmers) Market -The Market Company, Inc.
Street Market on Espanola Way - The Market Company, Inc. and Universal Light of the Blind, Inc.
A Street Market in Normandy Village -The Market Company, Inc.
Antique and Collectibles Market on Lincoln Road - Production Sud, Inc.
An Evaluation Committee appointed by the City Manager reviewed and scored the proposals. The
Committee did not have a comfort level with proposal from Universal Light of the Blind, Inc., to manage the
Espanola Way Market. The Committee was pleased with the current contractors for the four Markets, and
voted unanimously in favor of going forward with new contracts.
The Administration recommends approval.

The Mayor and City Commission, at its March 17, 2004 meeting, adopted Resolutions,
approving Concession Agreements (one year term, plus a one year option) for open-air
markets on certain City public rig ht-of-ways , after conclusion of a public and competitive
RFP process:
Espanola Way (Arts & Crafts) Street Market
Lincoln Road Green (Farmers) Market
Normandy Village Street Market
Additionally, the Mayor and City Commission at its September 8, 2004 meeting, passed a
Resolution approving the Lincoln Road Antiques and Collectibles Market, which operates
from October 1st through May 31st.,

Each of the above noted markets (collectively referred to as "Markets") were originally
authorized via City Special Event permits and were intended to provide a vehicle to attract
patrons to the respective rights-of-way and neighboring merchant areas assisting in
commercial revitalization. In 2002, it was determined that the most appropriate manner in
which to continue operating these Markets would be through this RFP process.
As originally envisioned, during the RFP process and negotiation process, the Markets
concept was moved forward and approved with the caveat that local merchants would not be
adversely impacted by said markets operations. As such, a conflict resolution process was
included in all market agreements, in order to provide aggrieved parties a method by which
to request relief.
As the agreements for the Green (Farmers) Market on Lincoln Road, the Street Market on
Espanola Way, and the Street Market in Normandy Village, had expired on March 31,2006,
and the Antique and Collectibles Market on Lincoln Road is expiring on September 30,2006,
the City Commission at its April 11, 2006 meeting authorized the issuance of an RFP, and
further approved the extensions of said agreements on a month-to-month basis.
RFP PROCESS
On May 31, 2006, RFP No. 30-05/06 was issued and notices sent to over 40 firms, which
resulted in the receipt of proposals from the following firms, for the following Markets:
· Lincoln Road Green (Farmers) Market -The Market Company, Inc.
· Street Market on Espanola Way - The Market Company, Inc. and Universal Light of
the Blind, Inc.
· A Street Market in Normandy Village -The Market Company, Inc.
· Antique and Collectibles Market on Lincoln Road - Production Sud, Inc.
On July 28, 2006, the City Manager via Letter to Commission No. 191-2006 appointed an
Evaluation Committee (the "Committee"), consisting of the following individuals:

Volume and quality of surveys submitted by clients.
The Committee discussed each of the proposals and proceeded to score them. There was
only one proposal submitted for each the Lincoln Road Green (Farmers) Market; A Street
Market in Normandy Village; and the Antique and Collectibles Market on Lincoln Road, and
the proposals submitted were from the firms currently under contract for the same.
The Committee scored the single proposals for these Markets as follows:

The Committee further scored the two proposals received for the Market on Espanola Way

The Committee did not have a comfort level with proposal from Universal Light of the Blind,
to manage the Espanola Way Market. This proposal did not provide financial background,

Overall, the Committee was pleased with the current contractors for the four Markets, and
voted unanimously in favor of going forward with new contracts. In addition to discussing the
evaluation criteria, the deliberations touched on the current Markets as they have been
operating, and recommendations relative to them.
The time of day of the set-up and breakdown/move-out of the Markets was discussed
relative to how this affects the neighborhood restaurants and businesses, particularly on
Lincoln Road. The suggestion was made, for contract negotiation purposes, that the vendor
loading and breakdown either occur before 7:00 p.m. or after 11 :00 p.m., so as to limit the
impact on the dinner hours on Lincoln Road. It was noted that this may not be possible with
the Antique and Collectibles market as their load time was 4 hours minimum.
A suggestion was also tabled relative to negotiating an assurance that the vendors for all
four Markets be diligent in continuously cleaning trash and debris from their areas
throughout the day.
The consensus of the Committee was that the Markets do bring additional business to the
merchants in the area, which is particularly beneficial in the summer and off-season months.
CONCLUSION
The Administration recommends that the Mayor and City Commission approve the attached
resolution, which recommends the acceptance of the ranking of the firms pursuant to
Request for Proposals (RFP) No. 30-05/06, authorizing the Administration to enter into
negotiations with the The Market Company, Inc. for a Green (Farmers) Market; with the
Market Company, Inc. for a Street Market on Espanola Way; with the Market Company,
Inc. for a Street Market in Normandy Village; and with Production Sud, Inc. for an Antique
and Collectibles Market on Lincoln Road; and further authorizing the Mayor and City Clerk to
execute agreements upon the completion of successful negotiations by the Administration.
