HomeMy WebLinkAboutAmendment No. 6~~~~1~~ - C 7~ AMENDMENT NO. 6 ;~t^ T!-!F PROFESSIONAL LANDSCAPE ARCHITECTURAL AND ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND CH2M Hill, DATED MAY 16, 2001, FOR THE PROVISION OF PROFESSIONAL SERVICES NECESSARY FOR DESIGN OF "P3.2" CLASSIFIED WATER MAINS IN AN AMOUNT NOT-TO-EXCEED $372,230.00 FOR NEIGHBORHOOD NO. 8 - BAYSHORE AND SUNSET ISLANDS PROJECT. This Amendment No. 6 to the Agreement made and entered this day of sE~-Mt3,~ , 2000, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida, having its principal offices at 1700 Convention Center C?rive, Miami 3each, Florida 33139 (hereinafter referr.,d to as CITY), and CH2M Hill, having its offices at 800 Fairway Drive, Suite 350, Deerfield Beach, Florida, 33441(hereinafter referred to as CONSULTANT). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No. 134-99/00, the Mayor and City Commission adopted Resolution No. 2001-24387, on May 16, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with CH2M Hill for Professional Services forthe Bayshore and Sunset Islands Streetscape Right-of- Way Neighborhood Project (the Project); and WHEREAS, the Agreement provides for the detailed planning services for various streetscape /landscape /utility improvements within the Bayshore and Sunset Island neighborhoods; and WHEREAS, the Agreement was executed fora not-to-exceed amount of $133,174; and WHEREAS, the planning effort for the Project has been completed, and detail design activities are underway; and Page 1 of 6 M8:4008 Amendment No.6 08 16 O6 WHEREAS, on December 10, 2003, the Mayor and City Commission adopted Resolution No.2003-25432, approving additional design services as Amendment No. 1 to the Agreement, for planning, design, permitting, bidding /award and construction administrative services for the Project, for snot-to-exceed amount of $1,913,302; and WHEREAS, on February 24, 2005, Amendment No. 2 to the Agreement was executed, to re-package Sunset Islands No. 1 and 2 from Bid Package 8D, to Bid Package 8B; and WHEREAS, on November 8, 2005, Amendment No. 3, to the Agreement was executed to include the completion of a topographic survey along Pine Tree Drive, from West 28th Street to West 40t Street, along the east side of the road, for snot-to-exceed amount of $12,850; and WHEREAS, on March 16, 2006, Amendment No. 4 to the Agreement was executed to include the evaluation, permitting and preparation of construction cost alternatives for the installation of curb/valley gutters to Sunset Islands No.1 and 2, for a not-to-exceed amount of $2,500; and WHEREAS, on February 16, 2006, Amendment No. 5 to the Agreement was executed to include the installation of four (4) drainage test wells to provide additional information for the preparation of a ! etter of Reasonable Assurance to be s~ ~bmit±~d to the Florida Department of Environi~nental Protection (FDEP), as required in the permit application for the Project, for snot-to-exceed amount of $55,863; and WHEREAS, this Amendment No. 6 to the Agreement, in the amount of$372,230, is to include the installation of "P3.2" classified water main replacements required by the City's Public Works Department. NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 6. 2. MODIFICATIONS The Agreement is amended to include Schedule "A-6", attached hereto and incorporated herein. Page 2 of 6 M8:4008 Amendment No.6 08 16 06 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. 4. RATIFICATION. The City and Consultant ratify the terms of the Agreement, as amended by this Amendment No. 6. In this effort, the Consultant shall be bound by the requirements stipulated in TASK 2 - DESIGN SERVICES as adopted via Resolution No. 2003-25432, on December 10, 2003, approving and authorizing the Mayor and City Clerk to execute an Agreement with CH2M Hill for Professional Services for the Bayshore Neighborhood Right of Way Improvement Project. (See Exhibit A-1 ). ADD the following under Task 6 - REIMBURSABLES, Task 6.6 -Reproduction Services for "P3.2 Classified" Water Mains The Consultant shall be reimbursed at the usual and customary rate for reproduction of reports, contract documents and miscellaneous items, as may be requested by the CITY. Unused amounts in this allowance shall be credited back to the CITY at the completion of the project. Task 6.7 - Survey for "P3.2 Classified" Water Mains The consultant shall arrange and coordinate the efforts of licensed surveyors to include an Page 4 of 6 M8:4008 Amendment No.6 OS 16 06 additional estimated 2600 linear feet of "P3.2" Water Mains within the project limit to meet the intent of the approved project Scope. This effort shall meet the requirements set forth in Task 2.1. Unused amounts in this allowance shall be credited back to the CITY at the completion of the project. Task 6.8 - Geotechnical Evaluation for "P3.2 Classified" Water Mains The Consultant shall arrange the services of a professionally licensed geotechnical firm to perform boring /test excavations as necessary to ascertain soil conditions, in an effort to identify existing conditions for pipe bedding considerations. The scope of such services shall be subject to review and acceptance by the City. Costs shall be limited to snot-to-exceed amount. Unused amounts shall be credited back to the City at the completion of the project. Task 6.9 -Underground Utility verification for "P3.2 Classified" Water Mains The consultant shall arrange the services of an underground utility location service to perform additional vacuum extraction excavations forthe work related to the "P3.2 classified" water mains. Actual locations shall be as directed by the Consultant and subject to review and acceptance by the City. Costs shall be limited to an not-to-exceed amount. Unused amounts in this allowance shall be credited back to the CITY at the completion of the project. TIME OF COMPLETION Additional design services contemp~ated by this Amendment are to be ~~crr,pletec~ withi. seven (7) months of receipt of authorization to proceed. PAYMENT AND COMPENSATION The method of calculating fees for the aforementioned proposed additional professional architectural and engineering services is established in Exhibit `A-6' attached, based on estimated labor plus direct costs. The total fee proposed for this Scope of Work shall be on anot-to-exceed basis in the amount of $372,230. Invoicing will be monthly and based on hourly rates as defined in the current Agreement between CH2M Hill and the City of Miami Beach. CONSULTANT's request for additional services is attached for reference purposes. In the particular situation of Bayshore, there are scattered sites a.caund the project. Fach time there is a different location one must take into consideration mobilization, safety, traffic, horizontal ax,d vertical control. Additionally, acrd as I Dave said many times FRS does not price any project based on linear footage and each site is reviewed. Some azeas may zloi have a large amount of improvements or obstacles that affee# the project, and many do. To cite an example, cozz~pare the true cost of the two projects, Bayshore and Normandy Isles, that FR$ hag completed for CH2M HILL. You will find that the cost for Normandy Isles, per linear foot, was much less than Bayshore The Bayshore site contains very crowded city streets while Normandy Isles is a quiet residential neighborhood.
