HomeMy WebLinkAboutAmendment No. 7a06- -16'a Y3 006 - AMENDMENT NO. 7 TO THE PROFESSIONAL LANDSCAPE ARCHITECTURAL AND ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF MIAMI BEACH, FLORIDA AND CH2M Hill, DATED MAY 16, 2001, FOR THE PROVISION OF PROFESSIONAL SERVICES NECESSARY FOR DESIGN OF BIKE LANES/ROUTES IN AN AMOUNT NOT -TO -EXCEED $58,128 FOR NEIGHBORHOOD NO. 8 — BAYSHORE AND SUNSET ISLANDS PROJECT. This Amendment No. 7 to the Agreement made and entered this day of SEAT M4 , 20 ob by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida, having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139 (hereinafter referred to as CITY), and CH2M Hill, having its offices at 800 Fairway Drive, Suite 350, Deerfield Beach, Florida, 33441(hereinafter referred to as CONSULTANT). RECITALS WHEREAS, pursuant to Request for Qualifications (RFQ) No. 134-99/00, the Mayor and City Commission adopted Resolution No. 2001-24387, on May 16, 2001, approving and authorizing the Mayor and City Clerk to execute an Agreement with CH2M Hill for Professional Services for the Bayshore and Sunset Islands Streetscape Right -of - Way Neighborhood Project (the Project); and WHEREAS, the Agreement provides for the detailed planning services for various streetscape / landscape / utility improvements within the Bayshore and Sunset Island neighborhoods; and WHEREAS, the Agreement was executed for a not -to -exceed amount of $133,174; and WHEREAS, the planning effort for the Project has been completed, and detail design activities are underway; and WHEREAS, on December 10, 2003, the Mayor and City Commission adopted Resolution No. 2003-25432, approving additional design services as Amendment No. 1 to the Agreement, for planning, design, permitting, bidding / award and construction administrative services for the Project, for a not -to -exceed amount of $1,913,302; and Page 1 of 6 MB:4008 Amendment No.7 08 16 06 WHEREAS, on February 24, 2005, Amendment No. 2 to the Agreement was executed, to re -package Sunset Islands No. 1 and 2 from Bid Package 8D, to Bid Package 8B; and WHEREAS, on November 8, 2005, Amendment No. 3 to the Agreement was executed to include the completion of a topographic survey along Pine Tree Drive, from West 28th Street to West 40'n Street, along the east side of the road, for a not -to -exceed amount of $12,850; and WHEREAS, on March 16, 2006, Amendment No. 4 to the Agreement was executed to include the evaluation, permitting and preparation of construction cost alternatives for the installation of curb/valley gutters to Sunset Islands 1 and 2, for a not - to -exceed amount of $2,500; and WHEREAS, on February 16, 2006, Amendment No. 5 to the Agreement was executed to include the installation of four (4) drainage test wells to provide additional information for the preparation of a Letter of Reasonable Assurance to be submitted to the Florida Department of Environmental Protection (FDEP), as required in the permit application for the Project, for a not -to -exceed amount of $55,863; and WHEREAS, on September 6, 2006, Amendment No. 6 to the Agreement was executed to include the installation of "P3.2" classified water main replacements required by the City's Public Works Department; for a not -to -exceed amount of $372 230; and WHEREAS, this Amendment No. 7 to the Agreement is to include the installation of bike lanes/routes required by the City's Public Works Department in a not to exceed fee of $58,128; and NOW, THEREFORE, the parties hereto, and in consideration of the mutual promises, covenants, agreements, terms, and conditions herein contained, and other good and valuable consideration, the respect and adequacy are hereby acknowledged, do agree as follows: 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment No. 7. 2. MODIFICATIONS The Agreement is amended to include Schedule "A-7", attached hereto and incorporated herein. 3. OTHER PROVISIONS. All other provisions of the Agreement, as amended, are unchanged. In this effort, the Consultant shall be bound by the requirements stipulated in TASK 2 — DESIGN SERVICES as adopted via Resolution No. 2003-25432, on December 10, 2003, approving and authorizing the Mayor and City Clerk to execute an Agreement with CH2M Hill for Professional Services for the Bayshore Neighborhood Right of Way Improvement Project. Consultant shall re -run storm water calculation models with the additional impervious areas being created by extended asphalt pavements required to implement the subject bicycle lanes. Relocation of existing and proposed catch basins that may result from the introduction of proposed bicycle lanes is included in this effort. For the scope of this Amendment, it is assumed that the primary physical components of the proposed stormwater system will not require re -design (no impact to number of wells, Pump station size, pump sizes, etc). If it is determined that the additional impervious area created by extended pavements results in impacts to the current stormwater design, a separate design revision Amendment will be requested by the Consultant. In addition to revising existing design documents as necessary to accommodate new bicycle lanes, the Consultant shall also revisit the encroachment tabulations, as new removals will result from this effort. Demolition drawings shall be revised to indicate the removal of additional encroachments. Landscape drawings shall illustrate revised sight triangle locations. In addition, bike lane and route improvements shall be added to the 90% construction cost estimate. In general, Bicycle lanes / routes shall be included as follows: • North Bay Road (20th ST. to Chase Ave): Bike route signage on both sides of the road is preferred approach. • Prairie Ave (Dade Blvd to 28th St.): Add 1.5 ft of pavement to the west side of the road. Identify encroachments affected by this for removal. During design, Page 4 of 6 MB:4008 Amendment No.7 08 16 06 Consultant to consider adjustments for bike lane along the planned parent drop off area at Miami Beach Senior High School.. • Prairie Avenue (28th St. to 34th St): Roadway width can accommodate 4ft bike lanes on either side of the road. • 34th Street (Chase to Pine Tree): Widen asphalt by -2.5 ft on both sides. Identify encroachments affected by this for removal. • Royal Palm Avenue (40th to 41st St) Consultant to complete survey and verify what bike lanes width can be accommodated. Depending on results, Consultant to reach agreement with PWD if existing curb lines have to be moved to meet the requirements. • Royal Palm Avenue (34th to 40th St). Widen asphalt by -2.5 ft on both sides. Identify encroachments affected by this for removal. • Flamingo Drive (Pine Tree to 23rd St): Bike route signage on both sides of the road with a connection to Pine Tree Drive near 28th St. • 33rd and 35th Streets (Pine Tree to Flamingo Drive): Bike route signage on both sides of the road. • 28th St. (N. Meridian Ave to Pine Tree Drive): Widen asphalt by 2.0 to 2.5 ft on both sides. Identify encroachments affected by this for re1noval. TIME OF COMPLETION Additional design services contemplated by this Amendment are to be completed within seven (7) months of receipt of authorization to proceed. PAYMENT AND COMPENSATION The method of calculating fees for the aforementioned proposed additional professional architectural and engineering services is established in Exhibit 'A-7' attached, based on estimated labor plus direct costs. The total fee proposed for this Scope of Work shall be on a not -to -exceed basis in the amount of $58,128.00. Invoicing will be monthly and based on hourly rates as defined in the current Agreement between CH2M Hill and the City of Miami Beach. CONSULTANT's request for additional services is attached for reference purposes. COMPENSATION • Original Agreement amount $133,174.00. • Amendment No. 1 (Design services for the Bayshore and Sunset Islands Neighborhood) amount $1,913,302.00. The fee requested to perform this work is $58,128 as detailed in the attached Summary Sheet and backup information. The detailed Scope of Work of the Design Services to be provided is as follows: Bike Lanes: New bike lanes and "bike route" signage in the Bayshore neighborhood are based on the attached neighborhood map and assumptions. Detailed Scope of Work for new bike lanes and "bike route" signage is as follows: 1. Lower North Bay Road: Install "bike route" signs both sides of the street. No bike lanes provided. 2. W 34th St from Chase Ave. to Pine Tree Dr.: Two 4 ft wide bike lanes, one each each side of the street. This will require widening street 4ft to 5ft total (reducing existing road to 10 ft lanes). 3. Royal Palm from W 34th St. to W 41st St.: Two 4ft wide bike lanes, one each side of street. This will require widening street 5ft to 6ft total (reducing existing road to 10 ft lanes). 4. Flamingo Dr. from Dade to W 41st St.: Install 'bike route" signs. 5. W 33rd and W 35th Streets from Pine Tree Dr. to Flamingo Dr.: Install "bike route" signs. 6. W 28th Street from Meridian to Pine Tree Dr.: Two 4ft wide bike lanes, one each side of street. This wit require widening street 3ft to 5ft total (reducing existing road to 10 ft lanes). Travel lanes will be reduced to 11 ft and 1.5ft of road widening will be required on the west side. 8. Prairie from W 28th to W 34th: Two 4ft bike lanes, one each side of street. This will not require any road widening (reducing existing road to 10 ft lanes). The services to be provided for new bike lanes and "bike route" signage are as follows: o Modify existing Design Documents for the Bayshore neighborhood, as necessary, to incorporate new bike lanes and "bike route" signage. o Modify/re-run existing stormwater calculation models with the additional impervious areas. Existing catch basins will be relocated as needed. o For Package A, submit the bike lanes and "bike route" signage drawings as part of the overall 60% submittal package to the Program Manager for review eight (8) weeks from the Notice to Proceed. o For Package B, submit the bike lanes and "bike route" signage drawings at the 60% design stage to the Program Manager for review four (4) weeks for the Notice to Proceed. a For Package C, submit the bike lanes and "bike route" signage drawings at the 60% design stage to the Program Manager for review four (4) weeks for the Notice to Proceed. o Revise and incorporate the design drawings for the new bike lanes and "bike route" signage into the 90% Design Documents for Packages 13 and C within four (4) weeks of receipt of Program Manager's 60% review comments. o Revise Opinion of Probable Construction Cost to include bike lanes. The additional design services to be provided for new bike lanes and "bike route" signage are based on the following assumptions: o Storrnwater system will not require re -design (no impacts to number of wells, pump station sizes, nor pump sizes). If the additional impervious area affects current stormwater design, a separate design and proposal will be needed. o Re-evaluation of encroachments will be needed with new road widths. Demolition drawings will show removal of additional encroachments, existing aprons and swales. Landscape drawings will show revised sight triangle locations.
