RESOLUTION NO. 2006-26307
A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING
THE APPROPRIATION OF $65,000; SAID FUNDS
REPRESENTING THE FULL AND FINAL SETTLEMENT
BETWEEN THE CITY AND GAMBRO HEAL THCARE RENAL
CARE (TENANT) FOR EARLY TERMINATION OF ITS
LEASE ON THE 3RD FLOOR OF THE 1701 MERIDIAN
AVENUE BUILDING; AUTHORIZING SAID FUNDS TO BE
USED TO COMPLETE DEMOLITION AND REPAIRS OF THE
INTERIOR PREMISES FORMERLY OCCUPIED BY TENANT.
WHEREAS, on July 1, 2005, the City reached a Mutual Release and Settlement
Agreement with Gambro Healthcare Renal Care, Inc; and
WHEREAS, the Mutual Release and Settlement, relative to Gambro's early
termination of its Lease for the third floor premises at the 1701 Meridian Avenue building,
called for Gambro Healthcare Renal Care, Inc. to pay to the City $65,000, in full and final
settlement of all claims; and
WHEREAS, the $65,000 settlement has been held by the City in a separate
account; and
WHEREAS, the Administration now recommends that the $65,000 be allocated and
appropriated to complete the demolition and repairs to the interior spaces on said third
floor premises which were occupied by the Gambro.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the appropriation of the $65,000 in settlement funds,
currently held by the City in a separate account; said settlement representing the full and
final settlement between the City and Gambro Healthcare Renal Care for early termination
of its Lease on the 3rd floor of the 1701 Meridian Avenue Building, and to be used now by
the City for demolition and repair of said premises.

Item Summary/Recommendation:
The Mutual Release and Settlement Agreement dated July 1, 2005 between the City and Gambro
Healthcare Renal Care, Inc. provided $65,000 as full and final settlement of Tenant's share of costs
to repair and restore City-owned property at, 777 17th Street, Suite 300 for Tenant's liability of
damages.
These settlement funds need to be appropriated immediately to demolish all the interior spaces on
the third floor of 777 Building. The third floor was occupied by a medical laboratory and to make it
suitable for building out City offices all interior walls, suspended ceilings, floor finishes, duct work,
electrical wiring and plumbing work must be removed..
Administration recommends adopting the Resolution.
