RESOLUTION NO. 2006-26294 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING A WAIVER, BY 5/7THS VOTE, OF THE COMPETITIVE BIDDING PROCESS, FINDING SUCH WAIVER TO BE IN THE CITY'S BEST INTEREST, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY AND MUSCO LIGHTING FOR THE PROVISION OF A MAINTENANCE FREE SPORTS LIGHTING SYSTEM AT THE FLAMINGO PARK POOL, IN AN ESTIMATED AMOUNT OF $168,700.00. WHEREAS, a new Flamingo Park Pool was constructed in 2001/02 as part of the City of Miami Beach Parks Master Plan Bond Program, adopted by the City Commission on June 19, 1996; and WHEREAS, at the time of construction it was anticipated a deck mounted sports lighting system suitable to permit evening swimming would be installed in the Pool facility at a later date when additional resources were identified; and WHEREAS, while the review and permitting ofthe construction documents is being performed, the sports lighting system can be procured and installed; and WHEREAS, an advantage of undertaking the sports lighting improvement is that residents and visitors will be able to enjoy night time use of the Pool; and WHEREAS, the design, permitting process, and installation of the sports lighting package can be performed independently of the rest of the Park's improvements; and WHEREAS, it is in the best interest of the City to undertake this improvement as expeditiously as possible; and WHEREAS, Musco Lighting (Musco) has specialized in sports lighting and has already installed sports lighting systems at the City's North Shore Park and Tennis Center; Flamingo Baseball Field; Palm Island Tennis Courts; Crespi, the Tatum and Stillwater Park basketball courts; and Fairway Park; and WHEREAS, Musco's proposal for the furnishing and installation of the system includes a twenty-five (25) year parts and labor warranty for the Flamingo Park Pool lighting equipment; and WHEREAS, with the number of City projects already completed, Musco is also proposing to extend this warranty to all future projects with the City; and WHEREAS, Musco's own technology will provide monitoring of the sports lighting system, which includes the ability to evaluate lamp outages, fuses blown, breaker trips, and lamp recycling; and WHEREAS, Musco will guarantee lighting levels for 20,000 hours free maintenance; and WHEREAS, Musco will provide next business day repair service when an outage has occurred; and WHEREAS, Musco provides a 24 hour call center with live staff to answer all calls and verify that schedules have processed, real time monitoring of all schedules to insure they have progressed; and WHEREAS, Musco is an industry leader in controlling unwanted light and glare into surrounding neighborhoods; and WHEREAS, Musco's design is based on the premise to light the project with 40% fewer fixtures than other manufacturers in the marketplace, which has the potential' to translate to 40% less energy costs per month and 40% less demand charges from Florida Power and Light (FPL); and WHEREAS, Musco's proposed Agreement, in the amount of $168,700, provides for the lighting system equipment detailed planning, design, permitting, and installation services; and WHEREAS, funds, in the amount of $125,000, are available from the Pay As You Go Capital Fund, and $43,700 from the Parks and Recreation Department General Fund, which have been previously appropriated. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve a waiver, by 5/7ths vote, of the competitive bidding process, finding such waiver to be in the City's best interest, and authorize the Mayor and City Clerk to execute an agreement with Musco Lighting to be the provider of a maintenance free sports lighting system at Flamingo Park Pool, in the estimated amount of $168,700. Item Summary/Recommendation: A new Flamingo Park Pool was constructed in 2001/02 as part of the City of Miami Beach Parks Master Plan Bond Program, adopted by the City Commission on June 19, 1996. At the time of construction it was anticipated a deck mounted sports lighting system suitable to permit evening swimming would be installed in the pool facility at a later date when additional resources were identified. Since the opening of the new Flamingo Pool the residents' use of the facility has increased dramatically. This increased usage combined with expanded programming has created the need for extended evening swim hours. The addition of a sports lighting system, as originally envisioned at the Flamingo Park Pool, will extend the hours of operation and enable our residents to enjoy the use of the facility later into the evening when most working adults have the time to take advantage of their leisure opportunities. The City has utilized Musco Lighting (Musco) extensively throughout the parks system. Musco lights are presently installed at the City's North Shore Park and Tennis Center, Flamingo Baseball Field, Palm Island Tennis Courts, Crespi, Tatum and Stillwater Parks Basketball Courts and Fairway Park's sports field. Since the installation of the first system the City has been very satisfied with the quality of the Musco lighting systems, service and support. Additionally, the Parks & Recreation Department has researched other systems and found Musco to be competitively priced and had an excellent reputation in the parks and recreation field. Musco Lighting's proposal includes the planning, design, permitting, and installation services for the lighting equipment at the Flamingo Park Pool. It also includes a 25 year parts and labor warranty. The Administration recommends the approval of this Resolution. In addition to this benefit, and with the number of City projects already completed by Musco, they are proposing to extend this warranty to all future projects with the City of Miami Beach, Florida. The City and Musco Agreement provides for the lighting system equipment detailed planning, design, permitting, and installation services for the lighting equipment at the Flamingo Park Pool. It is in the best interest of the City to approve this improvement as expeditiously as possible, so the residents can enjoy the use of the Pool facilities during evening swim hours. CONCLUSION The Administration recommends that the City Commission approve a waiver, by 5/7ths vote, of the competitive bidding process, finding such waiver to be in the City's best interest; and authorize the Mayor and City Clerk to execute an agreement between the City of Miami Beach, Florida and Musco Lighting to be the provider of a maintenance free sports lighting system at Flamingo Park Pool in an estimated amount of $168,700, to be installed at the Pool facility of Flamingo Park. The contract balance is due no later than 20 days after invoice date. Late payment will be subject to service charges of 1 %% per month (18% APR). Musco will attempt 10 coordinate shipment so that delivery corresponds with the customer's payment schedule. It will be the responsibility of the wholesaler to ensure that Musco is aware of this delivery timeframe. We will expect payment within the terms described above unless there is a written statement from Musco's corporate headquarters stating the acceptance of different terms. Delivery to the job site from the time of order, submittal approval, and confirmatIon of order details including voltage and phase, pole locations is approximately 3045 days.
