RESOLUTION NO. 2006-26292
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, RETROACTIVELY
AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
SUBMIT THE FOLLOWING GRANT FUNDING APPLICATIONS:
1) FEDERAL EMERGENCY MANAGEMENT AGENCY
(FEMA), FOR FISCAL YEAR (FY) 2005/06 HAZARD
MITIGATION PROGRAM FUNDING, IN AN AMOUNT NOT TO
EXCEED $1,000,000, FOR PROTECTIVE SHUTTERS FOR
CRITICAL CITY FACILITIES; 2) FEDERAL MEDIATION AND
CONCILIATION SERVICE, FOR FUNDING, IN AN AMOUNT NOT
TO EXCEED $125,000, FOR THE FY 2005/06 CYCLE OF THE
LABOR MANAGEMENT COOPERATION PROGRAM; 3) MIAMI
BEACH VISITOR AND CONVENTION AUTHORITY (VCA) FOR
FUNDING, IN AN AMOUNT NOT TO EXCEED $50,000 FOR THE
BASS MUSEUM'S "CONSTRUCTING NEW BERLIN"
EXHIBIT; AND, 4) MIAMI-DADE COUNTY, FOR FUNDING, IN AN
AMOUNT NOT TO EXCEED $78,000, FOR THE ADA PARKING
FINES GRANT; FURTHER APPROPRIATING THE GRANTS AND
MATCHING FUNDS, IF APPROVED AND ACCEPTED BY THE
CITY AND AUTHORIZING THE EXECUTION OF ALL
NECESSARY DOCUMENTS RELATED TO THESE
APPLICATIONS.
WHEREAS, the Hazard Mitigation Grant Program (HMGP) is authorized
under Section 404 of the Robert T. Stafford Disaster Relief and Emergency
Assistance Act, and is administered by the Federal Emergency Management
Agency (FEMA); and
WHEREAS, funding is provided through grants to states and local
governments to implement long-term hazard mitigation measures after a major
disaster declaration with the goal of reducing the loss of life and property; and
WHEREAS, the Administration requests approval to submit a grant
application to the Federal Emergency Management Agency (FEMA), FY
2005/06 Hazard Mitigation Program for funding, in an amount not to exceed
$1,000,000, for protective shutters for the following critical City facilities: Police
Station, City Hall, Fire Station #1, and Fire Station #3; and
WHEREAS, the City has previously applied for these projects through
other disaster mitigation programs but has not been successful to date in
obtaining funding; and
WHEREAS, a 25% match is required of this grant that is included as part
of the FY 2006/07 Operating Budget; and
WHEREAS, this project supports the Key Intended Outcome: Ensure
well-maintained facilities; and
WHEREAS, the Federal Mediation and Conciliation Service (FMCS)
provides funding assistance in the establishment and operation of labor
management committees which are established to improve labor management
relationships, organization effectiveness and communication; and
WHEREAS, the application was completed and submitted as a joint
product between the City Administration and the City's unions to provide
educational opportunities for employees by providing written, language and
communication skills training; and
WHEREAS, the grant requires a 10% match which will be provided by the
City Administration and the City unions, the City has matching funds available in
participating department budgets Citywide; and
WHEREAS, retroactive approval is requested for a grant application
submitted to the Federal Mediation and Conciliation Service (FMCS) FY 2005/06
Labor-Management Cooperation Grants Program, for funding, in an amount not
to exceed $125,000, for a series of training and communication courses for City
employees; and
WHEREAS, this project supports the Key Intended Outcome: Attract and
maintain a quality workforce; and
WHEREAS, Constructing New Berlin is the first major survey of
contemporary art made in post-Wall Berlin, which is increasingly being
recognized as a global nexus for contemporary art, and the exhibit includes
sixteen (16) Berlin-based artists of various nationalities working in painting,
sculpture, photography, film, installation, video-installation, sound, and
performance art, with the majority of works from the 21 st century, including a
number of new pieces made specifically for this project; and
WHEREAS, Constructing New Berlin provides a snapshot of global and
local artistic practices generated in Europe's emerging art capital in the first
decade of the new millennium; and
WHEREAS, the grant does not require matching funds; and
WHEREAS, approval is requested to submit a grant application to the
Visitor and Convention Authority (VCA) for funding, in an amount not to exceed
$50,000, for funding for the Bass Museum's Constructing New Berlin exhibit; and
WHEREAS, this project supports the Key Intended Outcome: Increase
community rating of cultural activities; and
WHEREAS, the City entered into an Interlocal Agreement with Miami-
Dade County on April 18, 2001, for the distribution of funds collected for the
misuse of specially marked parking spaces for people with disabilities; and
WHEREAS, eligible City projects, if mandated by federal, state, or local
law must be matched in at least an equal amount by other funding, other City
projects or programs may be funded up to 100% by disabled permit parking fine
monies, without matching funds; and
WHEREAS, the City proposes using the grant funds for disability access
programs and projects which includes the following projects: Citywide curb
ramps; real-time captioning for commission meetings; sign language interpretive
services, purchase/installation of audible pedestrian signals; beach access/power
and manual chairs (maintenance); advertisements and training; and
WHEREAS, the grant will be matched with City funds, as necessary, from
the following City departments: Public Works, City Clerk's Office, Parks and
Recreation and Neighborhood Services; and
WHEREAS, funds are eligible to be used to improve accessibility and
equal opportunity to qualified physically disabled persons and to conduct public
awareness programs concerning physically disabled persons.; and
WHEREAS, the grant was outlined at the July 24, 2006 meeting of the
City's Disability Access Committee (DAC); and
WHEREAS, retroactive approval is requested to submit a grant application
to Miami-Dade County for funding, in an amount not to exceed $78,000, for the
ADA Parking Fines Grant; and
WHEREAS, this project supports the Key Intended Outcome: Increase
community satisfaction with City services.
NOW THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH that the Mayor and City
Commission hereby authorize the City Manager to retroactively submit the
following grant applications: 1) Federal Emergency Management Agency
(FEMA), for Fiscal Year 2005/06 Hazard Mitigation Program funding, in an
amount not to exceed $1,000,000, for protective shutters for critical City
facilities; 2) Federal Mediation and Conciliation Service for funding, in an amount
not to exceed $125,000, for the FY 2005 Cycle of the Labor Management
Cooperation Program; 3) Visitor And Convention Authority (VCA) for funding, in
an amount not to exceed $50,000, for funding for the Bass Museum's
"Constructing New Berlin" exhibit; and 4) Miami-Dade County for funding, in an
amount not to exceed $78,000, for the ADA parking fines grant; further
appropriating the grants and matching funds, if approved and accepted by the
City, and authorizing the execution of all necessary documents related to these
applications.

Item Summary/Recommendation:
The City Proposes Submitting Grant Applications For The Following Projects/Programs: 1) The Hazard
Mitigation Grant Program For Storm Shutters For City Buildings, In Order To Mitigate Potential Future
Damage To These Properties And To Protect The Lives Of Persons. The Buildings Include The Following
Critical City Facilities: Police Station, City Hall, Fire Station #3, And Fire Station #1; 2)The FMCS For A

ANALYSIS
1. Approval to submit a arant application to The Federal Emeraencv Manaaement

Amount Not To Exceed $1.000.000. For Protective Shutters to critical City Facilities
The Hazard Mitigation Grant Program (HMGP) is authorized under Section 404 of the Robert
T. Stafford Disaster Relief and Emergency Assistance Act, and is administered by the
Federal Emergency Management Agency (FEMA). Funding is provided through grants to
States and local governments to implement long-term hazard mitigation measures after a
major disaster declaration. The purpose of the program is to reduce the loss of life and
property due to natural disasters and to enable mitigation measures to be implemented
during the immediate recovery from a disaster. Any community that was impacted by
Hurricane Wilma is eligible to apply.

The City proposes submitting an application for funding through the Hazard Mitigation grant
program for storm shutters for City buildings in order to mitigate potential future damage to
these properties and to protect the lives of persons. The buildings include the following
critical City facilities: Police Station, City Hall, Fire Station #1, and Fire Station #3.
The buildings listed above require protection in the event of a significant weather event. As
a barrier island, Miami Beach is subject to high winds, missile hazards and significant
impact damage. The City is replacing many of the existing, and deteriorated shutters with
new shutters and installing new shutters on facilities that currently do not have protection.
The City has previously applied for these projects though other disaster mitigation programs
but has not been successful to date in obtaining funding.
A 25% match is required of this grant that is included as part of the FY 2006/07 Operating
Budget. This project supports the Key Intended Outcome: Ensure well-maintained facilities.

photography, film, installation, video-installation, sound, and performance art. The majority

Since the fall of the Berlin wall in 1989, Berlin has increasingly been recognized as a global
nexus for contemporary art. Artists of diverse nationalities have flocked to the new capital of
re-unified Germany, lured by generous grant programs, abundant and inexpensive studio
spaces, and an expansive gallery scene. The Bass Museum of Art will be presenting the
first major survey of contemporary art made in Europe's emerging art capital, post-Wall

Berlin. Constructing New Berlin, a multi-generational survey, includes approximately
eighteen Berlin-based artists of various nationalities working in painting, sculpture,
photography, film, installation, video-installation, sound and performance art.
The greatly anticipated cultural resurgence of Berlin reflects a confluence of events that
accompanies the end of the Soviet era. In the historical areas of the former East Berlin,
world-class institutions are undergoing major, state-sponsored renovations. This matrix of
old and new art institutions in Berlin is emblematic of the city itself.
The unique and vast composition of Berlin's urban structure will allow continual growth and
evolution as a locus of cultural activity. Constructing New Berlin provides a snapshot of
global and local artistic practices generated in Europe's emerging art capital in the first
decade of the new millennium. The City proposes applying for funds in the amount of
$50,000. This grant does not require matching funds.
This project supports the Key Intended Outcome: Increase community rating of cultural
activities.
4. Retroactive Approval to submit a arant application to Miami-Dade County for Fundina
in an amount not to exceed $78.000 for the ADA Parkina Fines Grant
The City of Miami Beach entered into an Interlocal Agreement with Miami-Dade County on
April 18, 2001 for the distribution of funds collected for the misuse of specially marked
parking spaces for people with disabilities. The agreement is based on Section 316.1967,
Florida Statutes, and Section 30-447 of the Code of Miami-Dade County, which authorizes
the charging of fines for misuse of specially marked parking spaces for people with
disabilities. Eligible City projects, if mandated by federal, state, or local law must be matched
in at least an equal amount by other funding. Other City projects or programs may be
funded up to 100% by disabled permit parking fine monies, without matching funds.
The City proposes using the grant funds for disability access programs and projects which

not to exceed $1,000,000, for protective shutters for critical city facilities; 2) Federal

amount not to exceed $78,000 for the ADA parking fines grant; further appropriating the
