2000-23917 RESO RESOLUTION NO. 2000-23917 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACKNOWLEDGING NEW CONSTRUCTION HOURS FOR A ROADWAY PROJECT ON AlA/COLLINS AVENUE, FROM LINCOLN ROAD TO 26TH STREET, AS PROPOSED BY THE ADMINISTRATION AND THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), AND ALLOWED BY THE MIAMI BEACH CITY CODE, CHAPTER 46., ARTICLE IV., SUBSECTIONS 46-156(2)(a) AND 46-157(8); THE NEW CONSTRUCTION HOURS BEING FROM 8:00 A.M. TO 9:00 P.M., SIX DAYS A WEEK, FROM LATE APRIL 2001, TO EARLY JULY 2002, OR APPROXIMATELY SIXTEEN MONTHS; AND FURTHER ENCOURAGING THE CITY AND FDOT TO KEEP THE NOISE LEVELS DOWN FROM 8:00 A.M. TO 9:00 A.M., AND PRESCRIBE ANY REASONABLE CONDITIONS NECESSARY TO MINIMIZE THE POTENTIAL ADVERSE EFFECTS TO THE COMMUNITY. WHEREAS, the Florida Department of Transportation (FDOT) has programmed a roadway reconstruction project for AlA/Collins Avenue, from Lincoln Road to 26th Street, beginning in late April 2001, and ending in early July 2002 (Project); and WHEREAS, the Project has been divided into two segments to guarantee that construction is completed within the first segment, the hotel area from Lincoln Road to 23rd Street, prior to the tourist season or no later than early December 2001; and WHEREAS, in negotiations with FDOT, the Administration was able to reduce the construction timeline from the original 2.5 years to the above-mentioned sixteen (16) months, but only if longer construction hours are permitted for this Project; and WHEREAS, Chapter 46. "Environment," Article IV. "Noise," Section 46-156 "Temporary Permits," and Section 46-157 "Exemptions," Sub-Section (8) allow for certain "activities of a temporary duration" to be exempted, administratively, from the regular construction hours established by Sub-Section 46-156(2)(a)" Construction Hours," of the CityCode; and WHEREAS, both the Administration and FDOT are proposing new construction hours for the Project and, although not required by the City Code, wish to have them acknowledged by the Mayor and City Commission. NOW, THEREFORE, BE IT RESOL VED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby acknowledge new construction hours for a roadway project on AlA/Collins A venue, from Lincoln Road to 26th Street, as proposed by the Administration and the Florida Department of Transportation (FDOT), and allowed by the Miami Beach City Code, Chapter 46., Article IV., Sub-Sections 46-156(2)(a) and 46-157(8); the new construction hours being from 8:00 A.M. to 9:00 P.M., six days a week, from late April 2001, to early July 2002, or approximately sixteen months; and further encourage the City and FDOT to keep the noise levels down from 8:00 A.M. to 9:00 A.M., and prescribe any reasonable conditions necessary to minimize the potential adverse effects to the community. ANALYSIS The Administration and the Florida Department of Transportation (FDOT) feel it imperative to establish longer construction hours for a Collins Avenue Reconstruction Project, from Lincoln Road to 26th Street, ifthe project is to be completed within the scheduled 16-month timeframe. Chapter 46. "Environment," Article IV. "Noise," Section 46-156 "Temporary Permits," and Section 46-157 "Exemptions," Subsection (8) of the City Code, allow for certain "activities of a temporary duration" to be exempted, administratively, from the regular construction hours established by Subsection 46-156(2)(a) " Construction Hours" of the Code. The Administration has succeeded in negotiating important concessions from the Florida Department of Transportation for the upcoming $5.7 million Collins Avenue reconstruction project, from Lincoln Road to 26th Street, the most effective of these concessions being as follows: AGENDA ITEM f<-,L 5-ID -'On DATE May 10,2000 Commission Memorandum Construction Hours-Collins Avenue Project Page 2 1. The construction time line was reduced to sixteen (16) months from the original 650 work days or 2.5 years. The reduction is possible only if construction hours are extended to 7:00 a.m. to 9:00 p.m., six days a week. 2. In order to prevent disruption to the hotel area during tourist season, the Collins Avenue project construction was divided into two segments, as follows: * From Lincoln Road to 23rd Street, scheduled to begin in late April 2001 and end in early December 2001, lasting approximately 9 months; and * From 23rd Street to 26th Street, from December 2001 to early July 2002, or approximately 7 months. 3. FDOT has scheduled an additional $1 million in bonus pay as an incentive for early completion of the project, as well as a substantial penalty for construction delays to be assessed on a daily basis, as applicable. 4. FDOT reduced from 16 feet to 10 feet the proposed take back of private encroachment on State right-of-way that will be used to construct wider sidewalks in the area. In addition, the City has been an active and effective participant in the project's public involvement and mitigation efforts, has held several meetings with the interested Collins Avenue property owners and hoteliers, has recently met individually with each hotel owner/representative, and will continue its leading role up to the project's completion. The types of mitigation actions the City is already promoting for Collins Avenue to assist in reducing the impacts to hotels and condominiums during the construction period are herein attached as Exhibit A. Longer construction hours are essential if the Collins Avenue reconstruction project is to be completed within the 16-month timeframe.
