#2006-42 which calls for the lobbying of the state legislature to change
state law so as to preclude cellular telephone usage by motor vehicle
drivers while located in a school zone. As such, I am hereby transmitting

RESOLUTION 2006- 42
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DORAL,
FLORIDA RELATING TO LOB~YIN(; THE STATE LEGISLATURE TO
CHANGE STATE LAW SO AS T()PReCLUDE CELLULAR TELEPHONE
USAGE BY MOTOR VEHICLEDR1VERS WHILE LOCATED IN A
SCHOOL ZONE; PROVIDING AN EFFECTIVE DATE
WHEREAS, the Mayor and the City Council are concerned with the health, safety
and welfare of minors crossing the street in school crossing areas; and.
WHEREAS, it would promote the health, safety and welfare of all residents, and
in particular would protect the youth ofthe state if the state were to preclude the use of
cellular telephones by persons operating a motor vehicle while located in a school
crossing zone; and,
WHEREAS, the Mayor and the City Council desire to lobby the State Legislature
to amend or modify state law so as to preclude the use of cellular telephones by
persons operating a motor vehicle while located within a school crossing zone.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF DORAL, FLORIDA THAT:
Section 1. The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a part of this Resolution upon

adoption hereof.
Section 2. The Mayor and the City Council request that the State Legislature
modify existing laws so as to prohibit the use of cellular telephones by persons
operating a motor vehicle while located in a school crossing zone.

Se.ction 3. The City Manager shall. transmit a copy of this resolution to the
City's State Representatives and to the State Le~islature.
Section 4. The City Clerk shall provide executed copies of this Resolution to
the Mayor of Miami-Dade County, each member of the Miami-Dade Board of County
Commissioners, as well as each municipal clerk in Miami-Dade County for the purpose
of distributing copies to members of their respective governing councils in order to seek
support for the proposed change in state laW.
Section 5. This Resolution shall become effective upon its passage and
adoption by the City Council.

its adoption. The motion was seconded by Councilman DiPietro and upon being put to
a vote, the vote was as follows:
