98-22735 RESO RESOLUTION NO. 98-22735 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, REQUESTING THAT THE SCHOOL BOARD OF MIAMI- DADE COUNTY SET ASIDE EDUCATIONAL FACILITIES IMP ACT FEE MONIES BEYOND WHAT HAS BEEN COMMITTED FOR THE PROPOSED NEW SCHOOL FACILITY IN THE NORTH MIAMI/ MIAMI SHORES AREA TO PROVIDE FOR NEW CONSTRUCTION OF SCHOOLS AND/OR ADDITIONAL CAPITAL NEEDS, INCLUDING NEW CLASSROOM FACILITIES FOR EXISTING SCHOOLS WITHIN THE CITY OF MIAMI BEACH. WHEREAS, Miami-Dade County enacted the Educational Facilities Impact Fee Ordinance on October 1, 1995, which mandated the collection of impact fees by County building departments to be utilized for the expansion and creation of new schools according to the geographic benefit district the funds are generated in; and WHEREAS, over $1,869,000 has already been collected directly from the City of Miami Beach ("City") as a result of new residential construction activities since October 1, 1995; and WHEREAS, there is a stated intent in the ordinance to earmark funding for the construction of new capital educational facilities to accommodate school age children generated as a result of new residential development; and WHEREAS, public schools that are located within the City, particularly Biscayne Elementary School and Miami Beach Senior High School, which are experiencing burgeoning enrollment due to new construction and can utilize new classroom space; and WHEREAS, the students of Miami Beach who attend public schools will directly benefit from expanded classroom space by providing improved school facilities in a more suitable learning environment. NOW, THEREFORE, BE IT DUL Y RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, requesting that the School Board of Miami-Dade County to set aside Educational Facilities Impact Fee monies beyond what has been committed for the proposed new school facility in the North Miami / Miami Shores area to provide for new construction of schools and / or additional capital needs, including new classroom facilities for existing schools within the City of Miami Beach. ADMINISTRL\. TION RECOMMENDATION: Adopt the Resolutions. BACKGROUND: The resolutions attached have been requested by Commissioner Jose Smith based on the presentation made by Miami-Dade County School Board representative Kathy Wilbur to the Commission on March 18, 1998, there is concern that the City of Miami Beach do every1hing it can in order to assure that a fair share of funding is allocated to Miami Beach, consistent with the intent of Miami-Dade County Ordinance No. 95-79. which is intended to provide for construction of new. capital educational facilities to accommodate school age children GENERATED as a result of new residential development. There are seven Miami-Dade county public schools located within the City of Miami Beach. Many are in urgent need of funding for school improvements, renovations and repairs. The Educational Facilities Impact Fee Ordinance, was enacted on October 1,1995. This ordinance mandates that all building departments located in Miami-Dade county collect impact fees from new residential construction projects when issuing building permits. AGENDA ITEM L1J'J 5-~-~ <6 DATE COl'vIlVrrSSION l'vIEMO APRIL 15. 1998 PAGE 2 The ordinance designated three special benefit districts according to geographic location: I) northwest Miami-Dade county, 2) southwest Miami-Dade county, and 3) eastern Miami-Dade county. in \vhich the City of Miami Beach is located. To date, over $1,869.000 in impact fees have been collected directly from the City of Miami Beach. However. the funding within this area is currently allocated for construction of a new school facility in the North Miami/Miami Shores area. The ordinance currently stipulates that any impact fees collected can only be utilized for the expansion or creation of new educational facilities. ANAL YSIS: Biscayne Elementary School and Miami Beach High School are in particularly urgent need of funding for physical improvements. Subsequent funding raised by the City of Miami Beach through the Educational Facilities Impact Fee can best be utilized towards renovations of schools such as Biscayne Elementary to provide improved school facilities in a more suitable learning environment. An adjustment of the boundaries for the special benefit districts by the Miami-Dade Mayor and County Commissioners will allow for future impact fee monies to be collected and spent on public school facilities within the City of Miami Beach. Further, an adjustment to the ordinance needs to be made which would allow the funds in urbanized areas such as Miami Beach to be utilized for renovations as well as new construction. Additionally, Kathy Wilbur, representing the Miami-Dade County School Board indicated that the funds can be used to construct new classrooms and other new facilities in existing schools. A second resolution is proposed to ask the school board to allocate such funds for Miami Beach schools, particularly, Biscayne Elementary and Miami Beach High which have burgeoning enrollment due to new residential construction and require new classroom space. The City believes that there is a nexus between the new construction and the increased enrollment, consistent with the requirements of the current ordinance. CONCLUSION: The Administration recommends adoption of two resolutions of the Mayor and City Commission of the City of Miami Beach, Florida: (1.) To encourage the Miami-Dade County Mayor and Board of County Commissioners to consider adjustments to the Educational Facilities Impact Fee Ordinance [No.95-79] which would allow: (a) Funds in urbanized areas such as Miami Beach to be utilized for renovations as well as new construction and; (b) Adjustment of geographic boundaries to allow funds to be spent in the city where they are collected; and (2.)
