DATED SEPTEMBER 6, 2006 FOR THE PROVISION OF ADDITIONAL PROFESSIONAL SERVICES NECESSARY FOR DESIGN AND CONSTRUCTION ADMINISTRATION OF MULTIPURPOSE MUNICIPAL PARKING GARAGE PROJECT. This Amendment NO.2 to the Professional Architectural and Engineering (AlE) Services Agreement (Agreement) made and entered this 6th day of September, 2006, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under the laws of the State of Florida, having its principal offices at 1700 Convention Center Drive, Miami Beach, Florida 33139(hereinafter referred to as City), and PERKINS + WILL, INC., having its offices at 999 Ponce De Leon Suite 915, Coral Gables, Florida 33134 (hereinafter referred to as Consultant). RECITALS: WHEREAS, pursuant to Request for Qualifications (RFQ) No. 69-02/03, the Mayor and City Commission adopted Resolution No. 2004-25543, on April 14, 2004, approving and authorizing the Mayor and City Clerk to execute an Agreement with Consultant for professional AlE services for the Multipurpose Municipal Parking Garage (the Project); and WHEREAS, the Agreement provides for the planning, design, landscape architecture, engineering services bidding and award, construction administration and reimbursables for the Project; and WHEREAS, the Agreement was executed for a not-to-exceed amount of $1 ,200,788; and WHEREAS, Amendment NO.1 to the Agreement, in the amount of $167,980, was also approved pursuant to Resolution No. 2004-25543, for a total fee of $1 ,368,768; and WHEREAS, at this time, the City has negotiated Amendment No.2, for the provision of additional services relative to the addition of the seventh floor to the Parking Garage; and 1. ABOVE RECITALS The above recitals are true and correct and are incorporated as a part of this Amendment NO.2. 2. MODIFICATIONS The Agreement is amended to provide the necessary additional services required to add a seventh parking level to the Project, as defined by the attached Perkins + Will request for additional services, in their letters dated July th, 14th and 2th respectively (Attachment "A"), in the corresponding negotiated amounts of $34,006, $147,826, and $201,780, for a total of $383,612, plus an additional $31,604 for reimbursable expenses; for a grand total of $415,216. 3. OTHER PROVISIONS All other provisions of the Agreement remain unchanged. 4. RATIFICATION The City and Consultant ratify the terms of the Agreement, as per this Amendment NO.2. It covers the additional time required for departmental meetings, design, multiple design review meetings, coordination with the architectural and MEP component of the project and managements of the process. Additionally, there is also the relocation of the Main IT closet to the fourth floor and the relocation of the Domestic Water and Fire Pump Rooms necessary in order to provide an IT receiving area on the ground floor. Please note that this proposal does not include the time necessary for the assembly of this portion of the work into a separate bid package nor does it cover any additional time necessary for the preparation of separate Building Department documents or its review. The following is a breakdown of our scope of services: I. SCOPE OF SERVICES: A) Perkins + Will (Interiors/Architecture) · Meet with Department head for programming purposes. · Provide new design layouts and prepare new floor plans. · Prepare for and attend additional Design Meetings · Modify existing plans affected by new layouts changes. · Coordination with MEP/FP $28,506.00 B) JALRW (MEP/FP) . Services not included or outlined above are additional services. Additional services shall be billed on an hourly rate as per Schedule C of the Professional Service Agreement between the City of Miami Beach and Perkins + Will. The scheduled hourly rate shall be adjusted as per the consumer price index as stipulated in the CM B/P+W Agreement.
