A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER
PUBLIC COMMENT REGARDING A FIRST AMENDMENT TO THE LEASE
BETWEEN THE CITY AND THE MIAMI BEACH POLICE ATHLETIC LEAGUE,
INC.; SAID AMENDMENT, IN PART, CHANGING THE TERM OF THE LEASE
FROM JULY 1, 1996, TO JUNE 30, 2001, TO JULY 1, 1998, TO JUNE 30, 2023.
WHEREAS, on May 15, 1996, the City and the Miami Beach Police Athletic League, Inc.,
executed a Lease Agreement for lease of property located in Flamingo Park, 999 11 th Street, for the
period of July 1, 1996, to June 30, 2003; and
WHEREAS, in...! 997, the Miami Beach Police Athletic League, Inc. was awarded grant
funding, in the amount of $225,000.00, from Miami-Dade County under the Safe Neighborhood
Parks Bonds Program to assist in the funding of the cost of the new Miami Beach Police Athletic
League, Inc. Youth Resources Center; and
WHEREAS, one requirement of the Safe Neighborhood Parks Bonds Program is that grant
funds used for the purposes of development, improvement, rehabilitation or restoration be expended
only on lands owned by a grantee, or on lands for which the grantee holds a lease or other use
agreement for an unexpired term of twenty-five (25) years; and
WHEREAS, the original Lease Agreement was approved by the Mayor and City
Commission for a five year term; and
WHEREAS, the Administration has negotiated a proposed First Amendment to the current
Lease Agreement, effectively changing the term therein to twenty five (25) years, thereby making
the Miami Beach Police Athletic League, Inc., eligible to receive its funding under the grant pursuant
to the Safe Neighborhood Parks Bond Program; and
WHEREAS, pursuant to Ordinance 92-2783, which establishes procedures for the sale
and/or lease of City property and, in part, requires that the Mayor and City Commission hold a
public hearing advertised not less than fifteen (15) days prior to the hearing in order to obtain citizen
input into a proposed sale and/or lease, the City Attorney's Office has recommended that, as
proposed First Amendment to the Lease Agreement designates a considerably longer term than
stated in the original Lease Agreeement, it be subject to this public hearing requirement, so as to
fully inform the general public and hear comment as to the proposed action.
NOW THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing be
scheduled for Wednesday, June 17,1998, at !0:45am the City Commission Chambers, 3rd Floor, City
Hall, 1700 Convention Center Drive, Miami Beach, Florida, to consider public comment regarding
a First Amendment to the Lease Agreement between the City and the Miami Beach Police Athletic
League, Inc.; said Amendment, in part, changing the term of the Lease from July 1, 1996 to June 30,
2003, to July 1, 1998, to June 30,2023.

Adopt the Resolution.
BACKGROUND
On May 15, 1996, the Mayor and City Commission executed a Lease Agreement with the Miami Beach Police Athletic
League, Inc., to lease the property at Flamingo Park, 999 11th Street. The lease was for the period of five (5) years.
In 1997, the Miami Beach Police Athletic League was awarded a grant funding from Miami-Dade County under the Safe
Neighborhood Parks Bond Program to assist in funding the building of the new Miami Beach Police Athletic League
Youth Resources Center. One requirement of the Safe Neighborhood Parks Bond Program is that grant funds used for
the purposes of development, improvement, rehabilitation or restorations are expended only on lands owned by a
Grantee or on lands for which the Grantee holds a lease or other use agreement for an unexpired term of twenty-five
(25) years.
This amendment will only change the length of the lease, from five (5) years to twenty-five (25) years.
ANAL YSIS
The Miami Beach Police Athletic League has been awarded this grant and is eligible for future grant funding under the
Miami-Dade County Safe Neighborhood Parks Bond Program. However, funding is contingent upon the Miami Beach
Police Athletic League holding a twenty-five (25) year lease.
CONCLUSION
The Mayor and City Commission should approve the resolution, following the public hearing.
