A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FWRlDA, APPROVING A FIRST AMENDMENT TO THE
AGREEMENT BE1WEEN THE CITY OF MIAMI BEACH
AND CH2M Hll..L, INC. FOR PROFESSIONAL
ENGINEERING SERVICES FOR THE DEVELOPMENT
OF THE STORMWATER MANAGEMENT PROGRAM
AND AUfHORIZlNG THE MAYOR AND CITY CLERK.
TO EXECUTE SAME.
WHEREAS, on December 1, 1993, the Mayor and City Commission approved
Resolution No. 93-20980, authorizing the Mayor and City Clerk to execute an agreement
between the City of Miami Beach and CH2M Hill Inc., for professional engineering services
in four phases for a Citywide Stormwater Management Program (the "Agreement") and
further authorizing Phases I and II under the Agreement; and
WHEREAS, on December 16, 1993, the Consultant cqntracted with the City
for performance of engineering and related professional services for Phases I and II at a
Lump Sum cost of $317,000; and,
WHEREAS, in preparation for the Series A Revenue Bond Issue accelerated
stormwater planning services are now required, resulting in a First Amendment to the
Agreement at a cost of $50,300, attached as "Exhibit A".
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND "
CITY COMMISSION OF THE CITY OF MIAMI BEACH, FWRlDA, that the Mayor and
City Clerk are authorized to execute the attached First Amendment to the Agreement
between the City of Miami Beach and CH2M Hill, INC., for professional engineering
services for a Citywide Stormwater Management Program to be paid through the Storm
Water Utility.

PROGRAM.
ADMINISTRATION RECOMMENDATION
The Administration recommends that the .City Commission approve a first amendment to
the existing CH2M Hill, Inc. contract for professional engineering services for the
development of the Stormwater Management Program at a cost of $50,300.
BACKGROUND
On December 1, 1993, the City Commission approved Resolution No. 93-20980 which
authorized entering into a contract with CH2M Hill, Inc. to provide engineering services
for a City-Wide Storm water Management Program. The contract documents provide for
four phases of work to be added to the contract by amendment and authorize Phases I and
II at a lump sum cost of $317,000.
Accelerated stormwater planning services are required in preparation for the Series A
Revenue Bond Issue. While the overall goals of the master plan remain the same, there
is a need to identify specific stormwater management improvement projects early in the
planning process. Additionally, a preliminary engineering report for inclusion in the bond
issue later this year and additional coordination with the Program Manager is required.
ANALYSIS
The existing master plan approach will be modified to include the following elements:
1) Preparation of order-of-magnitude cost opinion;
2) Selection of priority basins for detailed analysis, including five basins for analysis
during the pilot study which will identify projects for inclusion in the Series A
Revenue Bond Issue;
3) Preparation of a preliminary engineering report for theses five basins which
identifies stormwater management projects in more detail for the bond issue; and,
4) Provide for additional coordination with the Program Manager during Phases I and 143
II of the Stormwater Master Plan.

CONCLUSION
It is recommended that the City Commission approve a resolution appropriating funds and
authorizing the Mayor and the City Manager to execute an amendment to the agreement
between the City of Miami Beach and CH2M HILL for Amendment No.1 with funding to
be obtained from the Storm Water Utility.

DEVELOPMENT OF THE STORMWATER MANAGEMENT
PROGRAM.
This First Amendment is made and entered into as of 'S o*^day of ~, , 1994 by and
between the CITY OF MIAMI BEACH, a municipal corporation existing under the laws of
the State of Florida (hereinafter referred to as "City" or "Owner"), having its principal offices
at 1700 Convention Center Drive, Miami Beach, Florida 33139, and CH2M HILL, INC., a
Florida corporation, whose address is 2828 Coral Way Building, 2828 Coral Way, Suite 440,
Miami, Florida 33145 (hereinafter referred to as "Consultant").
WITNESSETH:
WHEREAS, the City intends to develop a STORMWATER MANAGEMENT
PROGRAM (hereinafter referred to as the "Project"), and has engaged the Consultant for
the Project; and,
WHEREAS, on December 16, 1993, the Consultant contracted with the City for
performance of engineering and related professional services relative to this Project
including development of a stormwater management master plan, design, preparation of
Construction Documents and construction administration services and field representative
services (the "Agreement"); and,
WHEREAS, the parties now wish to amend the Agreement to modify Phases I & II
of the project.
NOW, THEREFORE, in consideration of the mutual covenants herein contained,
and other good and valuable consideration, the receipt and adequacy of which is hereby
acknowledged, the parties hereby agree as follows:
1. The Agreement shall be amended to include the Task Order No. 1 - 1st
Amendment Phases I and II, attached hereto as Schedule "A".
2. The parties hereby ratify and confirm all other terms and conditions of the
Agreement, which remain unchanged.

On August 23, 1994, we received a facsimile transmittal from Ruth Rahmani outlining Mr. Roger
Carlton's comments on the two letters we submitted to you on June 29, 1994. This letter addresses
Mr. Carlton's comments.
On the June 29, 1994, letter providing a general description of the City's Stormwater Management
Program, Mr. Carlton requested an updated schedule to complete Phases I and II of the program. We
provided an updated schedule with the May 3, 1994, letter we submitted to you describing the required
acceleration and modification to Phases I and II to support the Series A Revenue Bond Issue.
However, because of the delays in resolving the bond issue needs, that schedule is outdated. We are
submitting with this letter a new schedule for completing Phases I and II. In preparing this schedule,
we assumed that the basins to be included in the bond issue are selected by September 1994 and the
bond issue will be prepared by the first quarter in 1995.
On the June 29, 1994, letter providing a summary of the May 3, 1994, letter, Mr. Carlton had some
comments on Page 2, Items 1 throug..i. 4. These comments arc addressed by the items below.
Item 1 Mr. Carlton stated that development of order-of -magnitude costs from similar
experience in the region is included in CH2M IllLL's original scope of work. Our
scope of work provides for the development of planning-level present worth costs
based on the stormwater management improvement projects analyzed and identified
in the master plan (phase II, Task B). Because these costs were required by April
1994, well before any stormwater improvement projects have been identified, we had
to estimate costs based on similar experience in the region. Planning-level costs will
still need to be developed, once improvement projects are identified.
Item 2 Mr. Carlton stated that the additional cost to develop a preliminary engineering
report to support the Series A Revenue Bond Issue is $8,000, by modifying the
original Pilot Basin Study task. As described in the May 3 and June 29 letters,

Therefore, the net additional cost to modify the Pilot Basin Study task to a
preliminary engineering report is $16,500.
Item 3 Mr. Carlton feels that this task could be eliminated if you and your staff identify 25
basins, from the 100 total delineated basins, to be modeled in detail. However, the
master plan ~eeds to address the other 75 basins in some fashion, because citizens
living in the basins not selected may question why their basins were net analyzed.
This task will provide documentation of the basin prioritization methodology.
Item 4 Mr. Carlton questions why our original scope or work does not include any
coordination tasks with the Infrastructure Program Manager (CDM). Nevertheless,
our original scope of work does not include the level of coordination now requested
with the Program Manager. We have discussed with CDM the required coordination
not included in our original scope of work.
We also submitted a letter to you on July 19, 1994, as a follow up to the June 29 letters. We have not
received any comments on this letter. Please call me if you or Mr. Carlton have any additional

Management Program to meet the City's needs. Since our June 29, 1994 letter, CH2M HILL
has coordinated with the Infrastructure Program Manager, COM, and this lettBr includes
input provided by COM on the June 29. 1994 letter. in tenns of timing and the City'. bond
ill1lO needs.
The followinC is a summary of the required scope and fce changca to Phases I and D to meet
the City'. neeclln preparation ofthc Series A Revenue Bond Issues, as we now understand
them:
1. The Infrastructure Program Manager requested from CH2M HIlL ordcr-of-mapitudo
costa for ltormwater infrastructun: improvements. CH2M HILL developed tIICIc colts
from simflar experience in the region. This task was not iDcluded in the oriSiJIal tut
order. CH2M HILL spent $6,100 in fees on this out-oC-scope task. This task II labeled
II Task J. Phase I. outUncd in Table I.
2. To develop pre1imiIwy CDglneering design drawings and engineering cost eBti11l8ta for
stonnwater improvement projects to be included in the Series A Revenue Bond Issues,
CH2M HILL proposes to modify the Pilot Basin Study task (Phase I, Task Fl) to a
Pmliminary Engineering Report. The Preliminary Engineering Report wm develop
prc1iminar)' cnpeering drawings and engineering cost estimates for up to five (5)

Buin Selection task (Phase L Task PI) is required to priorittt.e the balina to be modeled
for the Series A BOAc:l Issues. In addition, the original task order for Pbascs I and D
included detailed mocIclins for 2S sub-basina, However, duriDg sub-basm delineation.

prosram included minimal coordination time with the Infrastructum Program Manqcr, u
directecl by the previous Public Worb Director. The level of effort included for tbiJ
c:oordinadon was limited to providing copies of each task deliverable to the Program
Manapr. However, the overall program has evolved in a ImIIIIIcr that mom cxt.=naive
coordirumon is requiIed with the Program Manager. Therefore. to coordinate the
Stormwatcr Manapment Program with the soheduled roadway improvements, water and
wutcwatel' infrastructun: improvements, and III mduction measures planned, addltioll8l
coordiDation will be mquired with the Program Manlp'.
Based on discuuioDS with the Program Manager, this additioll8l coonIinaUon would
involve aueadios meetings aDd communicating with the Program Maupr. The Program
~A1U.ser cstimSl'- the required level of effort wiD be attcndlna 5 briof monthly and one
detail-:d qlllll'tetly JIleetipS in Phase I and 8 brief monthly meetings and 2 detailed

After coordinating with the Program Manager, the additional fee increase required to moctify
Phases I and n (Task Order No.1) of the Stonnwater Management Program to meet the
requimnents of the Series A Revenue Bond Issues is $50.300, which is an amount smaller
