HomeMy WebLinkAbout2006-26346 Reso RESOLUTION NO. 2006-26346 ARESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO.6, TO THE EXISTING DESIGN BUILD AGREEMENT WITH RIC - MAN INTERNATIONAL, INC., FOR THE WASHINGTON AVENUE IMPROVEMENTS PROJECT; SAID AMENDMENT IN THE AMOUNT OF $197,960, TO PROVIDE FOR THE INSTALLATION OF ADDITIONAL DRAINAGE WELLS IN 7TH AND 8TH STREETS, BETWEEN WASHINGTON AND COLLINS AVENUES; WITH FUNDING AVAILABLE FROM PREVIOUSLY APPROPRIATED FUNDING SOURCES FOR THE FLAMINGO/LUMMUS BID PACK 10A, OF WHICH THE WORK IS A COMPONENT. WHEREAS, on January 14, 2004, the Mayor and City Commission adopted Resolution No. 2004-25463, approving and authorizing the Mayor and City Clerk to execute a Guaranteed Maximum Price Contract with RIC-MAN International, Inc. (Ric-Man) (the Agreement), pursuant to Invitation to Bid No. 22-02/03 for Design Build Services to Design and Construct The Washington Avenue Improvements - Phases II, IV and V Streetscape and Utility Improvement Project; and WHEREAS, the Agreement executed for a Guaranteed Maximum Price of $12,104,429, provided for the design, permitting, construction and construction engineering services during construction for the Washington Avenue Improvements Project, Phase II, IV and V, from 5th Street to 16th Street (the Project); and WHEREAS, on April 20, 2005, the City approved Amendment No. 1 to the Agreement, in the amount of $555,783, for the inclusion of scope that coordinated improvements in the Flamingo and Lummus neighborhoods, and provided for the upsizing of drainage on Washington Avenue; and WHEREAS, on October 19, 2005, the City approved Amendment No. 2 to the Agreement, in the amount of $686,880, and also executed an agreement with Miami-Dade County for the inclusion of traffic signal improvements on 11th, 1ih, 13th, and 14th Streets on Washington Avenue; and WHEREAS, on January 11, 2006, 2006, the City approved Amendment NO.3 to the Agreement, in the amount of $1 ,642,301, for the inclusion of planned improvements along and beneath th and 8th Streets, between Washington Avenue and Ocean Drive; and WHEREAS, on February 8, 2006, the City approved Amendment No. 4 to the Agreement, in the amount of $574,560, forthe inclusion of Green Malayan Coconut Palms in the medians from the 600 to the 1600 block of Washing ton Avenue; and WHEREAS, on May 10, 2006, the City approved Amendment No. 5 to the Agreement, in the amount of $1 ,094,815, for the inclusion of improvements to the drainage on 16th Street, and other miscellaneous improvements along the Washington Avenue corridor; and WHEREAS, Amendment No.6 to the Agreement, in the amount of $197,960, provides for the installation for two (2) additional drainage wells in th and 8th Streets, between Washington and Collins Avenue, and will result in a total Project cost to date of $17,646,945. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, approving and authorizing the Mayor and City Clerk to execute Amendment No.6, to the existing Design Build Agreement with Ric - Man Intemational, Inc., for the Washington Avenue Improvements Project; said Amendment, in the amount of $197,960, to provide for the installation of additional drainage wells in th and 8th Streets, between Washington and Collins Avenues; with funding available from previously appropriated funding sources for the Flamingo/Lummus Bid Pack 10A, of which the work is a component. COMMISSION ITEM SUMMARY Condensed Title: A Resolution amending an existing design build Agreement with Ric - Man International, in the amount of $197,960, to provide for the installation of two additional drainage wells on ih and 8th Streets between Washington and Collins Avenues, adding to the scope of work for the Washington Avenue Improvements, with funding available from previously appropriated funding sources for the Flamingo/Lummus Bid Pack 10A of which the work is a component. Item Summary/Recommendation: As part of the Lummus neighborhood project, modifications meant to improve the control and management of traffic along the Ocean Drive Corridor, included changing ih and 8th streets, between Ocean Drive and Washington Ave. to one direction as follows: ih Street traffic would flow in an East-bound direction and 8th Street traffic would flow in a West-bound direction. The proposed improvements to 7th and 8th Streets, were added to the Ric-Man Washington Ave. Agreement via Amendment, and approved previously by the City Commission. These improvements are currently in construction and it has been recently discovered that additional wells will be required to complete the drainage in the neighborhood. This Amendment No.6 requests the approval of the additional wells and the allocation of funds, in the amount of $197,960, already appropriated for the Lummus neighborhood to implement the work. Amending the existing Design Build Agreement with Ric - Man to incorporate this additional work will offer the advantage of completing these im~rovements sooner since Ric-Man is already involved in the construction ofthe improvements on 7th and 8 h Streets. Funding for the additional wells is available from previously appropriated Stormwater funds for the Flaminoo/Lummus Bid Pack 10A. PROJECT FUNDING Project funding, in the amount of $197,960, from Stormwater Fund 428, was previously appropriated into Account No. 428-2330-060357 for the Flamingo/Lummus Neighborhood Bid Pack 10A. ADMINISTRATION RECOMMENDATION Adopt the resolution. ANALYSIS As part of the Lummus neighborhood project, modifications meant to improve the control and management of traffic along the Ocean Drive Corridor, included changing th and 8th streets, between Ocean Drive and Washington Ave. to one direction streets as follows: th Street traffic would flow in an East-bound direction and 8th Street traffic would flow in a West- bound direction. This work is already in progress and was approved by the Mayor and City Commission by Resolution 2006-26128 in the January 11, 2006 Commission meeting and added to the Ric-Man International, Inc. (RMI) Washington Ave. Phases II, IV and V Agreement. The advanced design status (90% complete) of the Lummus Right of Way (ROW) Infrastructure Improvement Project, which included the improvements to th and 8th Streets currently in construction, by RMI in conjunction with the Washington Ave. project, affords the City the opportunity of adding two drainage wells to the scope of the project. The City's Program Manager, Hazen and Sawyer, (H&S), and the CIP Office, have evaluated the scope and cost of the drainage wells improvements and have found them to Commission Memorandum October 11, 2006 Amendment to Agreement with Ric-MAN International, Inc., 7th & 8th Streets Improvements Page 2 of 2 be acceptable and within industry standards. The requirement of these two wells was recently discovered to be part of the scope of Flamingo South Bid Pack 10A and is necessary for the proper completion of the drainage improvements in the subject two streets within the Lummus neighborhood. It is advantageous that they be added to the scope of RMI's project now and be constructed together with the other improvements in the area. Therefore both H&S and CIP recommend that the additional wells be added to the RMI Washington Ave. project scope of work already in place for ih and 8th Streets. Amendment No. 6 included herein will provide for the inclusion of this work and will amend the RMI Agreement, in the amount of $197,960, for the design and construction of the two additional wells (Attachment A). CONCLUSION The Administration recommends that the Mayor and City Commission adopt the resolution, and amend the DESIGN BUILD professional service Agreement with Ric- Man International, Inc., in the amount of $197,960, to provide engineering and installation of the additional wells for the ih & 8th Streets improvements currently in construction. Project funding is available from Stormwater Fund 428, previously appropriated for the Flamingo/Lummus Neighborhood Bid Pack 10A of which the work is a component:. In this effort, the Flamingo Neighborhood was divided into the following bid packages: Bid Package 10A _ Flamingo South, Bid Package 10B - Lummus, Bid Package 10C - Flamingo North fEast f West and BP 100 - Washington Avenue. The original intent of the Flamingo Neighborhood design was to construct the Washington (BP 100) and Lummus (BP 10B) portions of the neighborhood first with subsequent South (BP 10A) and North fEast f West areas (BP 10C) in latter fiscal years of the Program. However, in an effort to expedite the one-way modifications to 7th and 8th Streets - a component of the Lummus portion of the project . the City determined that amending the Washington Avenue BP 100 contract was in its best interest. As a result, the BP 100 Contractor was issued Amendment NO.3 for the DESIGN - BUILD implementation of improvements to 7th and 8th Street corridors. This work was subsequently deleted from the remainder of the Flamingo neighborhood design Consultant's scope of services. The BP10D Contractor, during completion of the design of the 7th and 8th Street improvements noted that two drainage wells, required for the proper operation of the drainage component of the 7th and 8th Street improvements, were proposed for inclusion in the BP 10A Flamingo South Project by the Flamingo Design Consultant. These two drainage wells were not included in the anticipated DESIGN - BUILD cost for the 7th and 8th Street Amendment. This Change Order (Amendment No.6) is intended to authorize the appropriate stormwater funding from the BP 10A Project to the BP 100 Project to fund the installation of the noted gravity wells.
