RESOLUTION NO. 2006-26349
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND THE CITY
CLERK TO EXECUTE A USE AGREEMENT WITH THE SCHOOL BOARD
OF MIAMI-DADE COUNTY FOR THE USE OF FLAMINGO PARK
BASEBALL STADIUM BY THE MIAMI BEACH SENIOR HIGH SCHOOL
BASEBALL TEAM DURING ITS BASEBALL SEASON, AT THE INITIAL
ANNUAL COST OF $15,600, AND PROVIDING FOR ANNUAL INCREASES
AND ADDITIONAL CHARGES AS STIPULATED IN THE AGREEMENT; THE
INITIAL TERM OF THIS AGREEMENT SHALL BE FOR FIVE (5) YEARS
AND, PROVIDED THAT THE BOARD IS NOT IN DEFAULT UNDER THIS
AGREEMENT, AND UPON WRITTEN NOTICE BY THE BOARD, THE
AGREEMENT MAY BE EXTENDED FOR AN ADDITIONAL FIVE (5) YEAR
TERM.
WHEREAS, the City, through its Parks and Recreation Department, has historically
worked in cooperation with the School Board of Miami- Dade County (School Board) for the past
several years to coordinate School Board use of various City recreational facilities, including the
City's Flamingo Park Baseball Stadium, for use by Miami Beach Senior High School organized
team sports programs; and
WHEREAS, in accordance with that mutual cooperation, the City and School Board
were parties to an agreement governing the terms and conditions for the School Board's use of
the Baseball Stadium by the Miami Beach Senior High School team, during its baseball season,
which agreement is set to expire; and
WHEREAS, the attached Use Agreement provides for an initial term of five (5) years,
with an initial annual payment by the School Board, in the amount of $15,600.00, with a
provision for annual increases and additional charges; and
WHEREAS, the Miami Beach Senior High School Baseball season begins in January
and concludes in May, and it is anticipated the Miami Beach Senior High School baseball team
will utilize the Stadium for up to a maximum of 118 days per year during the School's baseball
season (for approximately 100 practice days, 5 day games, and 13 night games); and
WHEREAS, the Administration would recommend that the Mayor and City
Commission approve the Use Agreement.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby authorize the Mayor and City Clerk to execute the attached Use Agreement
with the School Board of Miami-Dade County for the School Board's use of the Flamingo Park

Baseball Stadium (for up to a maximum of 118 days per year) for the Miami Beach Senior High
School baseball team, during its baseball season; said Agreement having an initial term of five
(5) years, at an initial annual cost of $15,600.00 per year, and providing for annual increases
and additional charges; the initial term of this Agreement shall be for five (5) years and shall
provide for an additional five (5) year renewal term, provided the Board is not in default, and
upon timely notice to the City.

Item Summary/Recommendation:
The Parks and Recreation Department has worked cooperatively with the School Board of
Miami-Dade County for the past several years to coordinate the use of its recreational facilities to
accommodate the Miami Beach Senior High School organized team sports programs. This
includes the City's Flamingo Park Baseball Stadium. The City's prior agreement with the School
Board for the use of the Baseball Stadium has expired.
The approval of the attached Use Agreement will continue this excellent partnership between the
City, the Miami Beach Senior High School and the Miami-Dade County School Board for an initial
five (5) year term with the possible extension for another five (5) years while generating income
to the Parks & Recreation Department in the amount of $15,600 per year for the initial year.
The Agreement must also be formally accepted by the Miami-Dade County School Board and will
be in effect when fully executed by both parties.

ADDITIONAL CHARGES AS STIPULATED IN THE AGREEMENT; THE
INITIAL TERM OF THIS AGREEMENT SHALL BE FOR FIVE (5) YEARS
COMMENCING ON THE DATE IT IS FULLY EXECUTED BY ALL PARTIES
AND PROVIDED THAT THE BOARD IS NOT IN DEFAULT UNDER THIS
AGREEMENT, AND UPON WRITTEN NOTICE BY THE BOARD, GIVEN TO
AND ACCEPTED BY THE CITY NO LATER THAN 180 DAYS PRIOR TO
EXPIRATION OF THE INITIAL FIVE (5) YEAR TERM, THIS AGREEMENT MAY
BE EXTENDED FOR AN ADDITIONAL FIVE (5) YEAR TERM.
ADMINISTRATION RECOMMENDATION

Adopt the Resolution.
ANALYSIS
The Parks and Recreation Department has worked cooperatively with the School Board of
Miami-Dade County for the past several years to coordinate the use of its recreational
facilities to accommodate the Miami Beach Senior High School organized team sports
programs. This includes the City's Flamingo Park Baseball Stadium, Memorial Field, Scott
Rakow Youth Center and various tennis facilities throughout the city. The City's prior
agreement with the School Board for the use of the Baseball Stadium has expired.
During this time the City has continued to improve the turf management program at the
Stadium, renovate the dugouts, install new water fountains and focused on increasing
maintenance standards for the field's playing surface. As a result, the relationship with the
School Board and with Miami Beach High School officials continues to be a positive one.
While the City and Board have agreed on a base fee, the fee for the field does not fully
recover City costs or investment and as such represents a cost savings for the sport
programs. The cost for the expiring lease was $15,000. The last year of the new lease
represents a 4% increase in costs and 4% each lease year thereafter.
The Miami Beach Senior High School Baseball season begins in January and concludes in
May. It is anticipated the Miami Beach Senior High School baseball team will utilize the
stadium for up to a maximum of 118 days per year during Miami Beach Senior High School's
baseball season for approximately 100 practice days, 5 day games, and 13 night games.
Hours of use for practice days shall be approximately from 3:00 p.m. to 6:30 p.m.; day and
night games shall be from one and one half (1 ~) hours before the game to one (1) hour
after the game.
The Agreement must also be formally accepted by the Miami-Dade County School Board
and will be in effect when fully executed by both parties.
CONCLUSION
The Administration recommends that the Mayor and the City Commission approve this
Agreement which will again reinforce the City's working relationship with our Miami Beach
Senior High School and the Miami-Dade County School Board while ensuring the continued
high standards of Flamingo Park Baseball Stadium are maintained.
