HomeMy WebLinkAbout2006-26367 Reso RESOLUTION NO. 2006-26367 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, GRANTING AN "AFTER-THE-FACT" CERTIFICATE OF APPROPRIATENESS FOR DEMOLITION FOR THE DEMOLITION OF THE CORAL ROCK WALL PREVIOUSLY LOCATED AT THE EASTERN TERMINUS OF 77TH STREET, AND LOCATED WITHIN THE ALTOS DEL MAR LOCAL HISTORIC DISTRICT. WHEREAS, on May 11, 2004, the Historic Preservation Board (HPB) approved a streetscape project within the Altos del Mar Local Historic District (HPB File No. 2170) that included the construction of a perimeter wall around the properties fronting Collins Avenue, Atlantic Way, the north side of 7ih Street, 78th Street, and the south side of 79th Street. Such approval also included controlled access for Atlantic Way (a private street), with gates on the north side of 7ih Street, the north and south sides of 78th Street, and the south side of 79th Street, as well as new pavers for the side streets and Atlantic Way, along with ornamental street lighting; and WHEREAS, on April 10, 2006, the HPB approved modifications to the streetscape plan approved on May 11, 2004 (HPB File No. 2170), including new bump-outs along Collins Avenue, in order to address safety concerns raised by FDOT for existing curb cuts, the modification of sidewalks accessing the beachwalk on 7ih and 79th Streets, minor revisions to the design and location of street pavers and beachwalk access pavers, modifications to the decorative street lighting, modifications to the exterior wall piers proposed for 7ih, 78th and 79th Streets and modifications to the landscape plan in order to install different types of palm trees; and WHEREAS, the Coral Rock Wall previously located at the eastern terminus of 7ih Street was located on a City owned right-of-way within the Altos del Mar Local Historic District; and WHEREAS, the procedures for granting or denying a request for a Certificate of Appropriateness for Demolition of a structure located on City owned right-of-way within a locally designated historic district require that the City's Historic Preservation Board hold a public hearing and transmit a recommendation to the City Commission; the City Commission then makes the final decision on the request. The notice and public hearing requirements applicable to the Historic Preservation Board's review of this request have been interpreted to apply to the City Commission's review as well; and WHEREAS, on April 10, 2006, the Historic Preservation Board (HPB) considered the proposed revisions to HPB File No. 2170, including the request for an "After-the-Fact" Certificate of Appropriateness for Demolition for the unauthorized removal of an historic Coral Rock Wall at the eastern terminus of 7th Street and resolved, in its advisory capacity, to recommend to the City Commission approval of the request for the demolition of the structure; and WHEREAS, before a demolition permit can be issued, the City Commission is required to grant an "After-the-Fact" Certificate of Appropriateness for Demolition for the demolition of the Coral Rock Wall previously located at the eastern terminus of 7ih Street; and WHEREAS, on September 6, 2006 the City Commission considered the HPB recommendation and, pursuant to City of Miami Beach City Code Section 118-563, approved a Resolution setting a public hearing to consider granting an After-the-Fact Certificate of Appropriateness for Demolition. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the request for an "After-the-Fact" Certificate of Appropriateness for Demolition for the demolition of the Coral Rock Wall previously located at the eastern terminus of 7ih Street is hereby granted. The HPB voted to recommend to the City Commission that an "After-the-Fact" Certificate of Appropriateness for Demolition of the coral rock wall previously located at the eastern terminus of 77th Street within the Altos del Mar Local Historic District be granted. On September 6, 2006 the City Commission considered the HPB recommendation and, pursuant to City of Miami Beach City Code Section 118-563, approved a resolution setting a public hearing to consider granting a Certificate of Appropriateness for Demolition. This is the same process utilized by the HPB when it considers the demolition of a historic building. The Administration recommends approval of the HPB recommendation and requests the City Commission rant the After-the-Fact Certificate of A ro riateness for Demolition. ANAL YSIS On May 11,2004, the Historic Preservation Board (HPB) approved a streetscape project within the Altos-del-Mar local Historic District that included the construction of a perimeter wall around the properties fronting Collins Avenue, Atlantic Way, the north side of 7ih Street, 78th Street, and the south side of 79th Street. At the April 1 0, 2006 meeting, the HPB also considered a request for an "After-the- Fact" Certificate of Appropriateness for Demolition for the unauthorized removal of an historic coral rock wall at the eastern terminus of 7ih Street. Pursuant to Article X of the Land Development Regulations of the City Code, the Historic Preservation Board action with regard to such request is advisory only. This request must go before the City Commission for final approval, as the Coral Rock Wall was located within a City owned right-of-way. The Historic Preservation Board and the Administration have expressed some concern with the haphazard, egregious and careless manner in which the historic coral rock wall was removed. Notwithstanding these concerns, it is not recommended that the wall be reconstructed for 2 reasons. First, the area at the eastern terminus of 7th Street no longer functions as a defined street-end; rather, such area will be combined with the City property to the immediate south and form a much larger public park. Without the wall, the vistas of the ocean will be more expansive. Secondly, the City's Environmental Division has a concern with regard storm surges and the impact that a wall would have on the ability of a storm to recede. In order for the project to proceed as approved by the HPB, it is necessary for the City Commission to approve the request for an "After-the-Fact" Certificate of Appropriateness for Demolition for the demolition of the Coral Rock Wall previously located at the eastern terminus of 7ih Street. The Administration recommends that the City Commission adopt the Resolution and grant the "After-the-Fact" Certificate of Appropriateness for Demolition.
