RESOLUTION NO. 2006-26371
A RESOLUTION OF THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, REAFFIRMING THE CITY OF MIAMI BEACH'S
CULTURAL AND BUSINESS EXCHANGE PROGRAM
WITH CHINA AS SERVING A PUBLIC PURPOSE, AND
AUTHORIZING THE ACCEPTANCE OF DONATIONS
MADE TO THE CITY FOR THIS CITY PROJECT; AND
FURTHER ACCEPTING FUTURE DONATIONS FOR THIS
PURPOSE, SUBJECT TO RATIFICATION BY THE
MAYOR AND CITY COMMISSION; AND AUTHORIZING
THE CITY MANAGER OR HIS DESIGNEE TO MAKE
SUCH EXPEDITURES AND/OR REIMBURSEMENTS
FROM THE AFORESTATED DONATIONS, AS WELL AS
FUTURE DONATIONS, IN FURTHERANCE OF AND
CONSISTENT WITH THE AFORESTATED CULTURAL
AND BUSINESS EXCHANGE PROGRAM.
WHEREAS, during the Miami Beach City Commission's April 29, 2006 Annual
Retreat, Vice-Mayor Jerry Libbin was authorized to work on a cultural and business
exchange Program with China, which Program would involve minimal use of City
personnel and be at no cost to the City; and
WHEREAS, this Program was authorized in recognition of the need to promote
art, cultural, educational and business/tourism exchanges between the City of Miami
Beach and Beijing, and the public benefit resulting there from; and
WHEREAS, the City Commission reaffirmed the public purpose for this cultural
and business exchange Program at its September 21, 2006 Committee of the Whole
Meeting; and
WHEREAS, in furtherance of this Program, the following persons and/or entities
have made the below-listed donations for use by the City towards this cultural and
business exchange Program with China:

WHEREAS, it is hereby recommended that the Mayor and City Commission
further authorize the acceptance of future donations, in furtherance of this Program,
subject to ratification of same by the City Commission at a future meeting; and
WHEREAS, in order to avoid any appearance of conflicts, there will be no
solicitation or acceptance of future donations for this project from a lobbyist or vendor;
and
WHEREAS, it is further recommended that the Mayor and City Commission
hereby authorize the City Manager or his designee to make any necessary
reimbursements and/or expenditures of the afore stated donations, as well as future
donations, in furtherance of and consistent with the aforestated cultural and business
exchange Program
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami
Beach's cultural and business exchange Program with China, originally approved by the
City Commission on April 29, 2005 as serving a public purpose and further
acknowledged by the City Commission at its Committee of the Whole Meeting on
September 21, 2006, is herein further recognized as serving a valid public purpose; the
cash donations set forth hereinabove to the City of Miami Beach for its use in achieving
its public purpose associated with its cultural and business exchange Project with China
are thus hereby accepted; and further providing for the acceptance of future donations
for this purpose, subject to ratification by the Mayor and City Commission; and
authorizing the City Manager or his designee to make such expenditures and/or
reimbursements from the afore stated donations, as well as future donations, in
furtherance of and consistent with the aforestated cultural and business exchange
Program.

The Miami Beach City Commission has authorized Vice-Mayor Jerry Libbin to work on a cultural and

Program and formally accepts donations which have been received by the City for this exchange program.
Additionally, the resolution authorizes the acceptance of future donations, subject to ratification by the City
Commission, and authorizes the City Manager to make expenditure and/or reimbursements from the
donations in furtherance of the Program.
