A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH CALLING FOR A SPECIAL ELECTION TO BE
HELD ON SEPTEMBER 5, 2000, FOR THE PURPOSE OF SUBMITTING TO
THOSE CITY OF MIAMI BEACH ELECTORS VOTING IN PRECINCT
NUMBERS 23, 24, 27, 28, 29, 30, 31 AND 32, A QUESTION CONCERNING
THE PROPOSED LEASE AMENDMENT OF CITY PARKLAND
PROPERTY TO MIAMI BEACH JEWISH COMMUNITY CENTER, INC.
BE IT RESOL YED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH:
SECTION 1.
In accordance with provisions of the Charter of the City of Miami Beach, Florida and the
general laws of the State of Florida, a Special Election is hereby called and directed to be held in
precinct numbers 23, 24, 27, 28, 29, 30, 31 and 32' in the City of Miami Beach, Florida, from 7:00
a.m. to 7:00 p.m. on September 5, 2000 for the purpose of submitting to said electorate the question
as set forth hereinafter.
SECTION 2.
That the appropriate and proper Miami-Dade County election officials shall conduct the said
Special Election hereby called, with Miami-Dade County's certification of the results of said Special
Election being accepted by the City Commission. The official returns for each precinct involved
shall be furnished to the City Clerk of the City of Miami Beach as soon as the ballots from all such
precincts have been tabulated and results duly accepted by said appropriate Miami-Dade County
Officials.
SECTION 3.
Said voting precincts in the City of said Special Election shall be as established by the proper
and appropriate Miami-Dade County Election Officials. All electors shall vote at the polling places
. Per Miami-Dade County Charter Section 6.02(J), this Special Election shall be limited to
those electors residing in voting precincts any part of which is within 1 mile of the subject park land
property .
and the voting precincts in which the OFFICIAL REGISTRATION BOOKS show that the said
electors reside. A list of the voting precincts and the polling places therein (subject to change by the
Supervisor of Elections of Miami-Dade County, in accordance with the laws of Florida) is attached
hereto as Exhibit A.
SECTION 4.
Registration of persons (residing in the subject precincts) desiring to vote in the Special
Election shall be in accordance with the general law of the State of Florida governing voter
registration. Qualified persons may obtain registration forms to vote at the Office of the City Clerk,
City Hall, 1700 Convention Center Drive, Third Floor, Miami Beach, Florida 33139, each and every
day until Aug. 7, 2000, between the hours of 9:00 a.m. and 5:00 p.m., and at such other voter
registration centers and during such times as may be provided by the Supervisor of Elections of
Miami-Dade County. Each such person desiring to become a registered voter shall be responsible
for properly filling out the registration form and returning it to the Miami-Dade County Elections
Office. All registration forms must be received by the Miami-Dade County Elections Office and
clocked in no later than Aug. 7, 2000at 5:00 P.M. in order for a person to vote in this Special
Election. All questions concerning voter registration should be directed to the Miami-Dade County

SECTION 5.
Copies of the proposed lease amendment and relevant Concept Plan shall be made available
to the subject electors at the office of the City Clerk from 9:00 a.m. to 5:00 p.m. each day, Saturdays,
Sundays, and holidays excepted, not later than thirty days prior to the date of said election.
SECTION 6.
Not less than thirty days' notice of said Special Election shall be given by publication in a
newspaper of general circulation in Miami Beach, Miami-Dade County, Florida. Such publication
shall be made at least once each week for four consecutive weeks next preceding said Special
Election.

SECTION 9.
Absentee voters residing in the subject precincts participating in said Special Election shall
be entitled to cast their ballots in accordance with the provisions of the laws of the State of Florida
with respect to absentee voting.

SECTION 10.
That the City of Miami Beach shall pay all expenses for conducting this Special Election and
will pay to Miami-Dade County or directly to all persons or firms, upon receipt of invoice or
statement approved by the Supervisor of Elections of Miami-Dade County, Florida.
SECTION 11.
This resolution shall be effective immediately upon its passage.

RECOMMENDATION
Adopt the Resolution.
ANALYSIS
On June 3,1981 the City first leased to the Jewish Community Centers of South Florida, Inc., City
property at 4221 Pine Tree Drive, also known as lots 5, 6 and 7 of Flamingo Bay Subdivision, as
recorded in Plat Book 6 at Page 101 of the public records of Miami-Dade County, Florida.
(Resolution 81-16678). The City's lease was amended and extended on three occasions, such tbat
the present lease term extends through to October 31, 2015, with two additional ten-year options,
and is now assigned to Miami Beach Jewish Community Center, Inc., a not-for-profit corporation
(Resolutions 84-17863, 85-18280, and 88-19226).
On March 15,2000, the City Commissionreferred a request by the Miami Beach Jewish Community
Center, Inc. ("JCC") to consider several amendments to their lease, to the Planning Board. The
proposed expansion of the JCC will require an amendment to the existing Lease Agreement to clarifY
the uses of the property, will extend the lease term for 99 years and will allow the structure to be
rebuilt or modified to increase its floor area to the maximum allowable FAR, which is .5.
County Charter:
The proposed lease amendment is subject to the provisions of Miami-Dade County Charter section
6.02(J) requiring submittal of the sale or lease or extension of any existing lease of city-owned "mini
or neighborhood parks" to an election, and would thus require submittal of the proposed lease
extension to voters residing within precincts located within one mile ofthe subject property.

As Miami-Dade County Charter Section 6.02, restricting the sale or lease of city-owned mini or
neighborhood park land, applies to this transaction, the Commission should adopt a Resolution
placing the matter on the ballot for consideration by voters residing "in voting precincts any part of
which is within one mile of the park. The proposed lease amendments would be subject to the
affirmative vote of a majority of the electorate.
Therefore, and in accordance with provisions of the Charter of the City of Miami Beach, Florida and
the general laws of the State of Florida, a Special Election is hereby called and directed to be held
in precinct numbers 23, 24, 27, 28, 29, 30, 31 and 32 in the City of Miami Beach, Florida, from 7:00
a.m. to 7:00 p.m. on September 5, 2000 for the purpose of submitting to said electorate the question
as hereinafter set forth.
