98-22764 RESO RESOLUTION NO. 98-22764 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDED REIMBURSEMENT AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION AND APPROPRIATING $359,808 FOR THE COLLINS AVENUE RECONSTRUCTION PROJECT FROM THE MIAMI BEACH REDEVELOPMENT AGENCY SERIES 1996 B BONDS WHEREAS, the Florida Department of Transportation (FDOT) and the City entered into a Reimbursement Agreement for the full reconstruction of Collins Avenue on September 24, 1998; and WHEREAS, the schedule to complete the work contemplated under the Agreement was determined to be incompatible with the opening of the Convention Center Hotel in October 1998; and WHEREAS, the City desires to implement an interim plan for the reconstruction of Collins Avenue from 15th Street to Lincoln Road that will meet the scheduled opening of the Convention Center Hotel; and WHEREAS, the interim plan consists of replacing the sidewalks, curb and gutter and the milling and reasphalting of the roadway in lieu of fully reconstructing the roadway in phases; and WHEREAS, FDOT has agreed to fund the interim plan, in the amount of $359,808 and have prepared an Amended Reimbursement Agreement for the Project; and WHEREAS, funds are available for appropriation from the Miami Beach Redevelopment Agency Series 1996 B Bonds in the amount of $359,808 for the Project; and WHEREAS, the City and FDOT wish to enter into the attached Amended Reimbursement Agreement which provides for reimbursement of the incremental expenses to be incurred by the City for the construction and construction-inspection of this Project. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission approve and authorize the Mayor and the City Clerk to execute the attached Amended Reimbursement Agreement between the Florida Department of Transportation and the City of Miami Beach, in the amount of $359,808 in State Funds, for the Collins Avenue Reconstruction Project, from 15th Street to Lincoln Road, which Project is to be constructed by a City contractor in 1998, on an expedited schedule. da~f! BACKGROUND: On September 24, 1997 the City Commission approved Resolution 97-22536 authorizing the Mayor and the City Clerk to execute a reimbursement agreement between the Florida Department of Transportation (FDOT) and the City of Miami Beach in the amount of $1.43 million for the purpose of reconstructing Collins Avenue from Espanola Way to Lincoln Road. Under the terms of this agreement the City is to bid and construct the project on behalf of the FDOT. The City is also required to advance the necessary funds to construct the project and seek reimbursement from the FDOT when the work is completed. The final reconstruction plans designed by the FDOT engineers were estimated to cost approximately $2 million and take nine (9) to twelve (12) months to build. The plans required the contractor to completely remove the entire roadway to the sub-grade and replace it in phases. The schedule to complete this work was determined to be incompatible with the opening of the Convention Center Hotel in October 1998. On March 17, 1998 City staff met with FDOT officials and discussed the City's desire to implement an interim plan for the reconstruction of Collins Avenue from 15th Street to Lincoln Road, which will meet the scheduled opening of the Convention Center Hotel. The interim plan consists of replacing the sidewalks, curb and gutter and the milling and resurfacing of the roadway. Agenda Item R 1 en Date ~ - 3 - CJ 8 The cost to accomplish the interim plan is estimated at $359,808. The FOOT officials have agreed to fund the interim plan and have prepared an amended reimbursement agreement for the project that reflects the proposed work. ANAL YSIS: The amended reimbursement agreement with FOOT provides $329,808 for construction and $30,000 for construction engineering inspection (CEI). The funds have been budgeted by FDOT in fiscal year 1997-1998. The total of $359,808 in State funds will be available for disbursement to the City, on an incremental basis, after the FDOT receives and approves the contractor invoices as the work progresses. The City utilizes a bidding procedure that complies with State rules and regulations, which will be required for the construction of this project. Construction, utilizing existing bids, is scheduled to begin July 1, 1998 and be completed by October 1, 1998. Funds in the amount of$359,808 are available for appropriation into a work order from the Miami Beach Redevelopment Agency series 1996 B bonds. CONCLUSION: The Administration recommends that the City Commission adopt the resolution authorizing the amended reimbursement agreement with the FDOT as essential for the City to meet the scheduled completion d t at has been established. AMENDED REIMBURSEMENT AGREEMENT WITH CITY OF MIAMI BEACH, FLORIDA STATE PROJECT NUMBER 87060-3574 W.P.I. NUMBER: 6114325 COLLINS AVENUE RECONSTRUCTION FROM: ESPANOLA WAY TO: LINCOLN ROAD This agreement, made and entered into this go day of "Jun-e- , 1998 by and between the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, an agency of the State of Florida, hereinafter called the "DEPARTMENT" and CITY OF MIAMI BEACH, hereinafter called the "CITY". WITNESSETH WHEREAS, the DEPARTMENT and the City heretofore on the 24th day of September, 1997 entered into a Reimbursement Agreement; and WHEREAS, the CITY desires to accomplish certain project items as outlined in the Attachment "A" appended hereto; and WHEREAS, the DEPARTMENT desire to participate in all eligible items for this project as outlined in Attachment "A" for a total DEPARTMENT share of $359,808.00 NOW, THEREFORE THIS INDENTURE WITNESSETH: that for and in consideration of the mutual benefits to flow from each to the other, the parties hereto agree that the following paragraphs of the Reimbursement Agreement shall be amended as follows: 2. The CITY will prepare the plans, specifications and estimates for the project. Projects on the State Highway System will incorporate Department Standards and will be reviewed and approved by the DEPARTMENT and the FEDERAL HIGHWAY ADMINISTRATION to perform the appropriate PROJECT phase. The CITY will apply for a permit from the DEPARTMENT in order to construct the PROJECT within the DEPARTMENT's Right-of-Way. 7. The DEPARTMENT shall provide the CITY the DEPARTMENT'S project estimated eligible cost as follows: a. Construction Engineering Inspection (C.E.I.) Up to $ 30,000 and construction up to the contract amount ($ 329,808) for work items identified as the CITY'S scope of work indicated in Attachment "A". Schedule of Disbursements: The disbursements for the incurred engineering construction and C.E.I. expenses shall only be made on a reimbursement basis upon submission to the DEPARTMENT of paid consultants and/or contractor's invoices. The disbursements shall not exceed $359,808, the total funds available for fiscal year 1998/1999. This Amended Reimbursement Agreement is the entire modified agreement between the parties hereto. All provisions of the original reimbursement agreement not specifically amended or modified by this agreement shall remain in tact. (l . ~/Z- ~/~ <1 o e - 3 - ATTACHMENT "A" The original scope of this agreement was for the DEPARTMENT to design the PROJECT (State Project Number 87060-3574) and for the CITY to construct the PROJECT. However, the new scope of the PROJECT is for the CITY to both design and construct the PROJECT (No State Project Number). The scope of the new CITY'S PROJECT is as follows: Milling and Resurfacing ofS.R. AlA (Collins Avenue) in the City of Miami Beach from 15th Street to Lincoln Road. Included in this project is updating the lighting, minor improvements to the existing storm drainage system, and signing & pavement markings. The PROJECT will mill & resurface the pavement, reconstruct the curb & gutter, as well as the sidewalk throughout the project limits up to the RlW Line. This PROJECT will improve the existing drainage system along Collins Avenue at Lincoln Road. It will include the installation of new lighting along the corridor. This PROJECT WILL NOT include any work required to construct 16th Street between Washington Avenue and Collins Avenue, including the signal at Collins Avenue and 16th Street. No State Funds shall be used for the construction of 16th Street. - 4 -
