98-22765 RESO RESOLUTION No. 98-22765 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE FIRST AMENDMENT TO THE BUDGET AND APPROPRIATING FUNDS FOR THE POLICE SPECIAL REVENUE - CAPITAL ACCOUNT FOR FISCAL YEAR 97/98, IN THE AMOUNT OF $24,515.00, SUCH ACCOUNT FUNDED BY UNCLAIMED EVIDENCE CURRENTLY HELD IN THE POLICE SPECIAL REVENUE - CAPITAL ACCOUNT. WHEREAS, Section 705.105, Florida Statutes, "Procedures for Unclaimed Evidence", provides that title to unclaimed evidence in the custody of the court from a criminal proceeding or seized as evidence by and in the custody of a law enforcement agency, shall vest permanently in the law enforcement agency sixty (60) days after the conclusion of the proceedings; and WHEREAS, such funds have been in the custody of the Police Property Management Unit past the sixty (60) day waiting period, and these funds have now been placed in the Police Special Revenue - Capital Account Fund, as provided by Resolution No. 90-19931, adopted on March 7, 1990. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT $24,515.00 WHICH IS CURRENTLY BEING HELD IN THE POLICE SPECIAL REVENUE - CAPITAL ACCOUNT BE APPROPRIATED FOR THE FUNDING OF THE FIRST AMENDMENT TO THE OPERATING BUDGET FOR THE 1997/98 FISCAL YEAR FOR THE PURCHASE OF ITEMS LISTED ON EXHIBIT "A"; CURRENT BUDGET INCREASE AMENDED BUDGET $36,550.00 $24,515.00 $61,065.00 17th :::o~~e , 1998. This is required by standards for accreditation for law enforcement agencies. MISCELLANEOUS FURNITURE/SMALL EQUIPMENT AS FOLLOWS: Criminal Investigations Division: Global Super Pneumatic drafting chairs (3) to be used with computers located on a custom built desk which has a very high counter top. These computers are NCIC, FCIC AND DADE COUNTY terminals ($150.00 ea $450.00); Dehumidifiers (2) - To eliminate odors from the new Crime Scene Room due to previous water leaks at $250.00 ea = $500.00; 18 medium height chairs at $260.00 ea = $4,680 and 12 guest chairs at $150.00 ea = $1,800.00 for the Strategic Investigations Unit; MINI BLINDS - Purchase and installation of blinds in the Person's Unit ($140.00). Frequently, witnesses and victims are interviewed within this office and these blinds will provide the privacy needed during these interviews. Patrol - Date/Time stamper for the Patrol Division ($110.00); Work table for the Crime Prevention Unit - $240.00 and one high back chair for the Captain in the North Sub-Station at $265.00. REPLACEMENT BOAT LIFT FOR THE MARINE PATROL UNIT: The boat lift includes a remote control switch. The boat lift will be used to raise the boat out of the water when not being used. Leaving the boat in the water increases the chance of electrolysis which will damage the boat and motors. Removal of the boat will also safe-guard the boat from sinking when not attended and facilitate routine maintenance on the boat and motors. The existing boat lift could not be repaired due to extensive damage caused by age and the elements. PROFESSIONAL SERVICES - Unfunded Crime Prevention Programs, including the Flamingo Park Fun & Games, Big Brothers/Big Sisters, law enforcment publications, Take your Child to Work Day, the State Police Officers Memorial and miscellaneous expenses for the Hispanic Advisory Board, Coalition of United Black Employees and the Civilian of the Year Award. $3,200 $8,185 $6,600 $5,000 MIAMI BEACH POLICE DEPARTMENT SPECIAL REVENUE-CAPITAL ACCOUNT 1st AMENDMENT FY 97/98 PAGE 2 OF EXHIBIT "A" Improvements to the Rocky Pomerance Plaza Four distinct memorial plaques have been in place for many years and have been damaged by the elements. ADMINISTRA TION RECOMMENDATION Adopt the Resolution. BACKG~OUND Florida Statute 705.105 "Procedure for Unclaimed Evidence" provides that unclaimed evidence in the custody of the court from a criminal proceeding, or seized as evidence by and in the custody of a law enforcement agency. shall become the property of that law enforcement agency 60 days after the conclusion of the proceedings. In March 1990 a special account was established, titled "Police Special Revenue - Capital Account" in the Special Revenue Fund. Funds for this account are made available in the Police Property Management Unit, as unclaimed evidence, in accordance with Florida Statute 705.105, outlined above. ANALYSIS In accordance with Florida Statute 705.105, unclaimed evidence totaling $24,515.00 has been in the custody of the Police Property Management Unit past the sixty (60) day waiting period. These funds have now been placed in the Police Special Revenues - Capital Account Fund, as provided in Resolution 90-19931, passed on March 7, 1990. CONCLUSION The Administration recommends that the Mayor and City Commission adopt the First Amendment to the budget for the Police Special Revenue- Capital Account, and appropriate the amount of $24,515.00 to provide funds for the purchase of miscellaneous items for the Police Department (Exhibit "A").
