A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING
THE SIXTH AMENDMENT TO THE POLICE CONFISCATION
TRUST FUND FOR FISCAL YEAR 1997/98, IN THE
AMOUNT OF $169 , 728 , TO BE FUNDED FROM THE
PROCEEDS OF STATE CONFISCATED FUNDS.
WHEREAS, Section 932.705, Florida Statutes, addresses the
purposes and procedures to be utilized for the appropriation and
expenditures of the Police Confiscation Trust Fund; and
WHEREAS, the Chief of Police of the City of Miami Beach has
determined that the need for the appropriation and expenditures
exists and the appropriation and the expenditure of forfeiture
funds is in compliance with Section 932.705, Florida Statutes, and
with Federal guidelines; and
WHEREAS, such funds are available in the Police Confiscation
Trust Fund.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission hereby adopt the Sixth Amendment to the 97/98
Police Confiscation Trust Fund Budget for the City of Miami Beach,
in the amount of $169,728, as reflected in the attached Exhibit
"A".

I, Richard Barreto, Chief of Police, City of Miami Beach, do hereby
certify that the aforementioned proposed request for expenditures
from the City of Miami Beach Police Confiscation Trust Fund, for
the 1997/98 fiscal year providing funds for expenditures as
indicated on Exhibit "A" complies with the provisions of Section
932.704 (3) (a), Florida Statutes and federal guidelines.

STATE FUNDS:
MATCHING FUNDS FOR THE LAW ENFORCEMENT
BLOCK GRANT
DISTRACTION DEVICES, GUN STEEL BODY (12 @$59.27 = $711.24 );
DISTRACTION DEVICE RELOADS (36 @$23.94 = $861.84) AND
DISTRACTION DEVICE CLEANING KIT (1 @14.89).
DISTRACTION DEVICE TAP ($22.03). These devices
are used by the Warrant Service Team during the service of high risk
warrants. The device temporarily disorients subjects reducing their
ability to resist. This reduces the chance of injury to both officers
and subjects thereby reducing liability to the City. The team is no longer
allowed to use shock lock rounds for entries which creates a greater
dependence on disorientation.
PLAIN PAPER FAX MACHINES (one for the Criminal Investigation
Division to replace a model which is old, and can not handle the
heavy load of this unit; and one for the Crime Scene Unit.
The Crime Scene unit has been relocated to an office out of the main building.
This amount includes maintenance for a year and initial supplies needed.
REIMBURSEMENT TO THE GENERAL FUND FOR OVERTIME
generated by the South Florida Impact Task Force during the third quarter
of fiscal year 97/98
FURNITURE FOR THE RENOVATED ROLL CALL ROOM -
Three (3) round tables and twelve (12) stack chairs
FITNESS CENTER - Miscellaneous repairs to gym equipment ($675.00)
and maintenance agreement from July 1998 to March 99
PURCHASE OF ONE (1) ALL TERRAIN VEHICLE (ATV) to enhance
our presence on the beach and to be used during special events
QUALITY OF LIFE STUDY - The Police Department, in cooperation with
MBCDC, has agreed to fund the cost of a study to be conducted by
a non-profit organization from Washington, D.C. Mr. Rob Tier of
"The Center for Livable Cities", and his associates, will provide the
Administration with a comprehensive document that will outline
recommendations for improving the City and its quality of life.
MBCDC is providing $2,000 from a Grant and the Police Department
is providing this amount from its Confiscation Fund.

NIKON 28-85 MACRO LENSES FOR CRIME SCENE CAMERAS
The Crime Scene unit has only 3 macro lenses. The purchase of seven
macro lenses will allow each Crime Scene Technician to have their
own individual lens.

office ($4,425.00); Adapter lenses - $600.00 (10) - one for each crime scene

Generators (3) = $1,800.00; and assorted small tools for the Crime
Scene Vans.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
BACKGROUND
Florida Statute 932.705 provides for, but is not limited to,
expenditure of forfeiture funds for crime prevention, other law
enforcement purposes and contribution to an organization that
benefits the youth of Miami Beach.
The Chief of Police of the City of Miami Beach has determined that
the need for the appropriation and expenditures of forfeiture funds
is in compliance with Section 932.705, Florida State Statutes.
ANALYSIS
The Administration requests authorization to adopt the Sixth
Amendment to the operating budget for the FY 97/98 Police
Confiscation Trust Fund in the amount of $169,728 from State funds
to be used to provide funding for the expenditures listed in
Exhibit "A".

In accordance with Florida State Statute 932.705, forfeiture funds
have been deposited in the Police Confiscation Trust Fund. The
City has complied with all statutory procedures involved in the
transaction of these funds.
CONCLUSION
The attached Resolution provides for the Sixth Amendment to the FY
97/98 Police Confiscation Trust Fund in the amount of $169,728 to
be used for the expenditures listed in Exhibit "A".
