98-22766 RESO RESOLUTION No. 98-22766 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE SIXTH AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1997/98, IN THE AMOUNT OF $169 , 728 , TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS. WHEREAS, Section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures exists and the appropriation and the expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Sixth Amendment to the 97/98 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $169,728, as reflected in the attached Exhibit "A". ') Q~~ Richard Barreto Chief of Police Miami Beach Police Department 6 - 2- ~ 't Date POLICE CONFISCATION TRUST FUND SIXTH BUDGET AMENDMENT FISCAL YEAR 97/98 STATE FUNDS: MATCHING FUNDS FOR THE LAW ENFORCEMENT BLOCK GRANT DISTRACTION DEVICES, GUN STEEL BODY (12 @$59.27 = $711.24 ); DISTRACTION DEVICE RELOADS (36 @$23.94 = $861.84) AND DISTRACTION DEVICE CLEANING KIT (1 @14.89). DISTRACTION DEVICE TAP ($22.03). These devices are used by the Warrant Service Team during the service of high risk warrants. The device temporarily disorients subjects reducing their ability to resist. This reduces the chance of injury to both officers and subjects thereby reducing liability to the City. The team is no longer allowed to use shock lock rounds for entries which creates a greater dependence on disorientation. PLAIN PAPER FAX MACHINES (one for the Criminal Investigation Division to replace a model which is old, and can not handle the heavy load of this unit; and one for the Crime Scene Unit. The Crime Scene unit has been relocated to an office out of the main building. This amount includes maintenance for a year and initial supplies needed. REIMBURSEMENT TO THE GENERAL FUND FOR OVERTIME generated by the South Florida Impact Task Force during the third quarter of fiscal year 97/98 FURNITURE FOR THE RENOVATED ROLL CALL ROOM - Three (3) round tables and twelve (12) stack chairs FITNESS CENTER - Miscellaneous repairs to gym equipment ($675.00) and maintenance agreement from July 1998 to March 99 PURCHASE OF ONE (1) ALL TERRAIN VEHICLE (ATV) to enhance our presence on the beach and to be used during special events QUALITY OF LIFE STUDY - The Police Department, in cooperation with MBCDC, has agreed to fund the cost of a study to be conducted by a non-profit organization from Washington, D.C. Mr. Rob Tier of "The Center for Livable Cities", and his associates, will provide the Administration with a comprehensive document that will outline recommendations for improving the City and its quality of life. MBCDC is providing $2,000 from a Grant and the Police Department is providing this amount from its Confiscation Fund. The purchase of seven macro lenses will allow each Crime Scene Technician to have their own individual lens. $4,000 ESSENTIAL ITEMS FOR THE CRIME SCENE UNIT Video cameras (5) to equip four crime scene vans and one for the office ($4,425.00); Adapter lenses - $600.00 (10) - one for each crime scene technician), and flash slaves (10) - $500.00; Tripods (3) - $450.00; Generators (3) = $1,800.00; and assorted small tools for the Crime Scene Vans. $7,775 ADDITIONAL ITEMS REQUIRED BY THE CRIME SCENE UNIT: Arson bags, evidence cones, laser measuring instruments, ultra- violet lights with protector gogles, trace evidence lifters, hand-held metal detectors, sand sifters, portable fuming chambers, Polaroid cameras, and re-chargeable flashlights $6,000 COLOR LASER COPIER FOR THE CRIME SCENE UNIT This color laser copier will enable our darkroom to produce color laser prints from negatives, slides or photos in minutes while at the same time reducing per print costs $28,000 COLOR PAPER PROCESSOR FOR THE CRIME SCENE UNIT The color processor presently in use in the darkroom is 17 years old.. New advancements in technology makes the latest version of this item superior to the one we are now using $15,000 LASER/ALTERNATIVE LIGHT SOURCE - This item is used to detect evidence not visible to the eye at crime scenes. The laser/light source is portable, can be transported to crime scenes and operates on 115 or 220 house current $19,000 AUXILIARY LIGHTS FOR CRIME SCENE VANS The Crime Scene Unit vans have no exterior emergency light bars or blue lights attached to them. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND Florida Statute 932.705 provides for, but is not limited to, expenditure of forfeiture funds for crime prevention, other law enforcement purposes and contribution to an organization that benefits the youth of Miami Beach. The Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures of forfeiture funds is in compliance with Section 932.705, Florida State Statutes. ANALYSIS The Administration requests authorization to adopt the Sixth Amendment to the operating budget for the FY 97/98 Police Confiscation Trust Fund in the amount of $169,728 from State funds to be used to provide funding for the expenditures listed in Exhibit "A". The City has complied with all statutory procedures involved in the transaction of these funds. CONCLUSION The attached Resolution provides for the Sixth Amendment to the FY 97/98 Police Confiscation Trust Fund in the amount of $169,728 to be used for the expenditures listed in Exhibit "A".
