HomeMy WebLinkAbout2006-26404 Reso RESOLUTION NO. 2006-26404 A RESOLUTION OF THE MAYOR AND CITY COMMISION OF THE CITY OF MIAMI BEACH, FLORIDA, RATIFYING, PURSUANT TO SECTION 2- 396 (a) OF THE MIAMI BEACH CITY CODE, AN EMERGENCY AGREEMENT BETWEEN THE CITY AND RIC-MAN INTERNATIONAL, INC., IN THE AMOUNT OF $517,000.00, FOR THE INSTAllATION OF APPROXIMATELY 2,350 LINEAR FEET OF A 121NCH WATER MAIN AND All lATERAL SERVICES ON INDIAN CREEK DRIVE, FROM 63RD STREET TO ABBOT AVENUE, AND APPROVING THE USE OF FUNDS, IN THE AMOUNT OF $517,000, FROM THE WATER AND SEWER REVENUE BOND SERIES 2006, APPROPRIATED IN THE FISACAl YEAR (FY) 2006- 07 CAPITAL BUDGET. WHEREAS, immediate replacement of the existing cast iron water main is required due to the age of the pipe, the shallow depth and leaks associated with the existing lead joints; and WHEREAS, it is the responsibility of the City, as the owner of the utility within the Florida Department of Transportation right-of-way, to replace the aforementioned old water main with leaky joints; and WHEREAS, the Florida Department of Transportation reconstruction is moving with an aggressive timeline, as requested by the community; and WHEREAS, given the prompt response by the City, the Florida Department of Transportation has agreed to indemnify and hold the City harmless for any delays attributed to the relocation of the water main along the Indian Creek Drive Corridor; and WHEREAS, the City Manger, as provided pursuant to section 2-396 (a) of the City Code, entered into an agreement with Ric-Man, International, Inc., for the procurement of the aforestated emergency services, in the amount of $517,000; and WHEREAS, Ric-Man was selected because of its proven success on prior City construction projects, its specific skill in utility and underground work, and its immediate availability to commence work. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby ratify, pursuant to Section 2-396 (a) of the Miami Beach City Code, an emergency agreement between the City and Ric-Man International, Inc., in the amount of $517,000.00, for the installation of approximately 2.350 linear feet of a 12 inch water main and all lateral services on Indian Creek Drive 63rd Street to Abbot Avenue, and approving the use of funds in the amount of $517,000.00, from the water and sewer revenue bond series 2006, appropriated in the FY 2006-2007 Capital Budget. Item Summarv/Recommendation: Due to the shallow depth of the existing water main along Indian Creek Drive and the vibrations resulting from Florida Department of Transportation's construction of the roadway, the City water main in this corridor started leaking at the joints. The City is responsible to repair and or replace City owned utilities within the Florida Department of Transportation right-of-way. The existing City water main was installed in the 1950's. The emergency repair contracting action was communicated to the Mayor and City Commission via LTC. Ric-Man International Inc. was selected by the City to proceed with the emergency contract to replace this shallow water main because of their proven City construction project success, their skill in utility and underground work and their immediate availability to commence work. Given the City's prompt response, the Florida Department of Transportation has agreed to hold the City harmless for any delays attributed to the installation of the new 12 inch water main along the Indian Creek corridor. The Administration recommends the Commission to adopt the Resolution. DATE: SUBJECT ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANAL YSIS The Florida Department of Transportation (FDOT) roadway reconstruction activities revealed that the existing City 8" water distribution main is inappropriately shallow for the final project grades and as such, the water main will need to be relocated. Vibrations resulting from FDOT construction machinery have caused this 1950's era line to break at existing joints, producing sporadic and repeated leaks along the line. The line is a cast-iron water main with lead joints which is susceptible to cracking under excessive loads and vibration. The shallow location of the pipe is also not conducive to sustaining repeated load impacts and will continue to be problematic if not replaced. During the 63rd Street Flyover Improvement project design phase, the City provided existing utility drawings that identified the location of this water line, but the depth information was not on record. The City participated in several utility coordination meetings with FDOT, the project contractor and other utility providers to address questions, concerns and possible conflicts in the construction zone. Unfortunately the need to relocate the water main, which was discovered to be shallow, was only identified when the final roadway grading elevations were being worked by the FDOT contractor. This water line provides potable water and fire suppression flows to residents along Indian Creek Drive, and at this point in time, any delays to the relocation of this water line would present a risk to the health, safety and welfare of the City residents through adverse impacts to normal and required water flow and pressure. City Commission Memorandum - Bayshore ROW September 6, 2006 Page 2 0'2 Scheduling for the replacement work as it relates to the 63rd Street Flyover project is also critical and it furthers the basis for the emergency contract. The FDOT reconstruction project is moving with an aggressive timeline, as requested by the community, to finalize the Indian Creek Drive portion of the project before year's end and thus restore normal traffic flow conditions. Prompt replacement of the water line will allow FOOT to minimize project disruption. The relocation expense for the water line is the responsibility of the City as the owner of the utility within the FOOT right of way. This responsibility is similar to the City requirement for utility owners in City right of way, such as FPL, to assume relocation expenses as required. The project awarded to Ric-Man Intemationallnc. has been awarded in two phases: Phase 1, the installation of the water main from 63rd Street to 65th Street shall be substantially completed by November 10th, 2006. Phase II, installation of the water main from 65th Street to Abbott Avenue shall be substantially completed within sixteen (16) calendar days from the issuance of the second notice to proceed. The City has incurred additional expense for the project in order to provide for a second work shift and the construction phasing that will expedite the water line project. Ric-Man international was selected by the City because of their proven City construction project success, their specific skill in utility and underground work and their immediate availability to commence work. At this time, the construction work has been completed and FDOT has not informed the City of any delays to their contract. Given the City's prompt response, FDOT has agreed to hold the City harmless for any delays attributed to the relocation of the water main along the Indian Creek Drive Corridor. FUNDING Funding, in the amount of $517,000, is being provided from the Gulf Breeze Loan 2006 Fund 423, previously appropriated in the FY 2006-07 Capital Budget Funds CONCLUSION The Administration recommends adopting the Resolution ratifying, pursuant to section 2- 396 (a) of the Miami Beach City Code, an emergency agreement between the City and Ric- Man International Inc. in the amount of $517,000.00, for the installation of approximately 2,350 linear feet of a 12 inch water main and all lateral services on Indian Creek Drive from 63rd Street to Abbot Avenue, and approving the use of funds, in the amount of $517,000 from the Gulf Breeze Loan Fund 423, appropriated in the FY 2006-07 Capital Budget.
