HomeMy WebLinkAbout2006-26423 Reso RESOLUTION NO. 2006-26423 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DESIGN-BUILD AGREEMENT WITH THE FIRM OF RIC- MAN INTERNATIONAL, INC., IN THE AMOUNT OF $27,110,222, PURSUANT TO INVITATION TO BID (ITB) NO. 36-05/06, FOR DESIGN/BUILD SERVICES FOR THE NEIGHBORHOOD NO. 7- NAUTILUS RIGHT-OF-WAY INFRASTRUCTURE IMPROVEMENT PROJECT; AND ALLOCATING ADDITIONAL FUNDS, IN THE AMOUNT OF $7,966,171, WHICH INCLUDES A CONTINGENCY FOR THE PROJECT, IN THE AMOUNT OF $2,700,000, AVAILABLE FROM PREVIOUSLY APPROPRIATED FUNDS FOR OTHER PROJECTS IN THE CAPITAL IMPROVEMENTS PROGRAM. WHEREAS, the City requires the services of a Design/Build Firm (DBF) for the design and construction of the Neighborhood No. 7 - Nautilus Right-of-Way Improvements Project (the "Project"); and WHEREAS, the DBF will be responsible for the design, construction, and construction management associated with the work related to earthwork, roadway narrowing, milling and resurfacing, driveway paving, sidewalk construction; water main installation and water services relocation; storm drainage infrastructure installation; roadway lighting and streetscape/planting improvements; and WHEREAS, the proposed improvements to be performed for this Project are based upon the Basis of Design Report for Neighborhood NO.7 - Nautilus, prepared by the City's AlE consultant, Reynolds, Smith and Hills, Inc.; and WHEREAS, Invitation to Bid (ITB) No. 36-05/06, for Design/Build services for the Project, was issued on June 23, 2006, with a Pre-Bid meeting held on July 20,2006; and WHEREAS, on October 11, 2006, the Mayor and City Commission authorized the Administration to enter into negotiations with the firm of Ric-Man International, Inc. (RicMan), as the best and lowest bidder; and WHEREAS, the Administration has negotiated a Design-Build Agreement with RicMan, in the amount of $27,110,222, pursuant to ITB No. 36-05/06; and WHEREAS, the Administration also recommends allocation of additional funds, in the amount of $7,966,171, previously appropriated for other projects in the Capital Improvements Program; and WHEREAS, the additional amount includes a contingency for the Project, in the amount of $2,700,000. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herby approve and authorize the Mayor and City Clerk to execute a Design-Build Agreement with the firm of Ric- Man International, Inc., in the amount of $27,110,222, pursuant to Invitation to Bid (lTB) No. 36- 05/06, for the design/build services for Neighborhood NO.7 - Nautilus Right-of-Way Infrastructure Improvement Project; and allocate additional funds, in the amount of $7,996,171, which includes a contingency for the Project, in the amount of $2,700,000, available from previously appropriated funds. 2006-26423 PASSED and ADOPTED this 6th day of December , 2006. Item Summa IRecommendation: The City of Miami Beach required the services of a Design/Build Firm for the design and construction of the Neighborhood NO.7 - Nautilus Right-of-Way Improvements Project (the "Project") to be responsible for the design, construction, and construction management associated with the neighborhood improvements. The proposed improvements to be performed for this Project are based upon the Basis of Design Report prepared by Reynolds, Smith and Hills, Inc. On June 23, 2006, the City's Procurement Division issued Invitation to Bid (ITB) No. 36-05/06 for Design/Build Services for the Neighborhood NO.7 Project. The purpose of this ITB was to obtain bids from qualified General Contractors to provide all Design/Build services for the Project. On October 11,2006, the Mayor and City Commission authorized the Administration to enter into negotiations with the firm of Ric-Man International, Inc. (RieMan), as the best and lowest bidder. RieMan submitted a bid in the amount of $27,110,222, pursuant to ITB No. 36-05/06. The City evaluated the bid submitted by RieMan and found it to be appropriate and in accordance with the required scope and timeline. Therefore, the Administration recommends approval of the RieMan bid, in the amount of $27,110,222, as presented. Funding for this Project is available from previously appropriated sources in the 2006-2007 Capital Budget, in the amount of $21,844,051. In addition, the Administration recommends allocation of funds, in the amount of $7.966, 171, previously appropriated for other projects in the Program, which will then be replaced when new bonds are issued in 2007. FUNDING: Funding for this Project is available as follows from previously appropriated sources in the 2006-2007 Capital Budget: Fund 384-2282, GO Bond, in the amount of $4,171,624; Fund 423-2282, in the amount of $1,379,867, Gulf Breeze; Fund 423-2282, in the amount of $220,370, Gulf Breeze Contingency; Fund 424-2282, in the amount of $1 ,289,351, Water & Sewer Bond, Fund 424-2282, in the amount of $424-2282, in the amount of $101 ,360, Water & Sewer Bond; Fund 424-2282, in the amount of $61 0,080, Water & Sewer Bond; Fund 428- 2282, in the amount of $711 ,292, Storm Water Bond; and Fund 428-2282, in the amount of $13,360,107, Storm Water Bond; for a total of $21 ,844,051. The total appropriation amount includes an additional contingency, in the amount of $2,700,000, for the Project. ANALYSIS The City of Miami Beach required the services of a Design/Build Firm for the design and construction of the Neighborhood NO.7 - Nautilus Right-of-Way Improvements Project (the "Project"). The Design/Build Firm (DBF) will be responsible for the design, construction, and construction management associated with the work related to earthwork, roadway narrowing, milling and resurfacing, driveway paving, sidewalk construction; water main installation and water services relocation; storm drainage infrastructure installation; roadway lighting and streetscape/planting improvements. A Design Criteria Package was prepared Commission Memorandum - RieMan Nautilus ITS No. 36-05/06 December 6, 2006 Page 20f3 which included conceptual specifications and plans for the civil, electrical, mechanical, structural and landscaping disciplines. The work to be performed under this Contract consists of providing all tools, equipment, materials, supplies, and manufactured articles and furnishing all labor, transportation, and services, including fuel, power, water, and essential communications, and performing all work, or other operations required for the fulfillment of the Contract in strict accordance with the Contract Documents. The work shall be complete, and all work, materials, and services not expressly indicated or called for in the Contract Documents which may be necessary for the complete and proper design and construction of the work in good faith shall be provided by the Design/Build Firm. The Project is located in the "Middle Beach" area and bounded by the Surprise Waterway to the North, Biscayne Bay to the West, Pine Tree Drive to the East, and State Road 112/Arthur Godfrey Road (W. 41st Street) to the South. Areas to be affected by the proposed improvements include but are not limited to North Bay Road, Nautilus Drive, Nautilus Court, Michigan Avenue, Jefferson Avenue, Adams Avenue, N. Meridian Avenue, Chase Avenue, Prairie Avenue, Post Avenue, Royal Palm Avenue, Sheridan Avenue, W. 48th Street, W. 47th Street, W. 47th Court, W. 46th Street, W. 45th Street, W 44th Street, W 44th Court, W 43rd Street and Court, and W 42nd Street. The Flamingo Waterway Historic District lies within the boundary of the Nautilus Neighborhood. The neighborhood is divided in two by the Biscayne Waterway. The area to the West of the Biscayne Waterway is commonly known as Nautilus West and the area to the East of the Biscayne Waterway as Orchard Park. The proposed improvements to be performed for this project are based upon the Basis of Design Report for Neighborhood No.7 - Nautilus prepared by Reynolds, Smith and Hills, Inc. On June 23, 2006, the City's Procurement Division issued Invitation to Bid (ITB) No. 36- 05/06 for Design/Build Services for Neighborhood No. 7 - Nautilus Right-of-Way Infrastructure Improvement Project. The purpose of this ITB was to obtain bids from qualified General Contractors to provide all Design/Build services for Nautilus Neighborhood No.7. On October 11 , 2006, the Mayor and City Commission authorized the Administration to enter into negotiations with the firm of Ric-Man International, Inc. (RicMan), as the best and lowest bidder. RicMan submitted a bid in the amount of $27, 110,222, pursuant to ITB No. 36-05/06. The City evaluated the bid submitted by RicMan and found it to be appropriate and in accordance with the required scope and timeline. Therefore, the Administration recommends approval of the RicMan bid, in the amount of $27,110,222, as presented. In addition, the Administration recommends allocation of funds, in the amount of $7,966,171, previously appropriated for other projects in the Program, which will then be replaced when new bonds are issued in 2007. The project was procured using the Best Value procurement method consistent with the recent approach established by the Administration. The best value procurement method requires that the contractor provide a Risk Assessment Plan (RAP) which includes an evaluation of potential risks to the Project as well as a value for the risks. RicMan provided the RAP with a total value for several risks related to storm drainage, pavement, trenching, fire hydrants, and others. The value of the risks adds up to a potential increase in the cost to the Project of +/-$1 0,000,000. The contractor is obligated to minimize or eliminate the risks during the completion of the Project design and the City will then evaluate the remaining values and negotiate an appropriate cost with RicMan at that time. CONCLUSION The Administration recommends approval of the attached Resolution, authorizing the Mayor and City Clerk to execute an Agreement with the firm of Ric-Man International, Inc., the lowest and best bidder, in the amount of $27, 11 0,222, pursuant to Invitation to Bid (ITB) No. 36-05/06, for the design/build services for neighborhood No. 7 - Nautilus Right-of-Way Commission Memorandum - RieMan Nautilus ITS No. 36-05/06 December 6, 2006 Page 3 0'3 infrastructure improvement project; and allocating additional funds, in the amount of $7,966,171, which includes a contingency for the project, in the amount of $2,700,000.
