RESOLUTION NO. 2007-26433 A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 1 TO THE CONTRACT WITH SUPERIOR LANDSCAPING AND LAWN SERVICE, INC. FOR CITYWIDE LANDSCAPE SERVICES, FOR PHASE TWO OF THE JULIA TUTTLE, IN THE AMOUNT OF $265,000, FOR LANDSCAPE RESTORATION AND BEAUTIFICATION SERVICES AT THE JULIA TUTTLE CAUSEWAY SITE. WHEREAS, the current landscape maintenance contract (Contract No. 31- 03/04) between the City and Superior Landscaping and Lawn Service, Inc., for Citywide Landscape Services provides for the performance of additional services such as site landscape/irrigation and restoration work, as needed; and WHEREAS, the costs associated are based on their contractually established labor and material pricing; and WHEREAS, this is beneficial to the City because pricing is pre-established, through the competitive bidding process, and when the restoration is complete, the Contractor is responsible for both the material warranty and the long term maintenance of the materials; and . WHEREAS, should the contractor fail to properly care for these plantings, it must replace them as a contractual obligation, without question of liability; and WHEREAS, the design developed for the Julia Tuttle landscape includes a second phase; and WHEREAS, this gateway location received extensive irrigation repairs, along with trees, palms and ground cover plant material, during the first phase of work, in the amount of $208,633, completed in September, 2006; and WHEREAS, Phase Two is ready to proceed, with the installation of 17 shade trees; 43 palms; and an estimated 4,000 additional flowers, shrubs. and ground covers; 20.000 square feet of eco-turf; as well as mulch and irrigation modifications to support the new plant material; all with an anticipated substantial completion date prior to the Super Bowl, on February 04. 2007; and WHEREAS, funding. in the amount of $265,000. is available from the Capitol Investment Upkeep Account (CIUA) to pay for the installation of Phase Two of the landscape restoration! beautification of the Julia Tuttle Causeway; and WHEREAS, accordingly, the City Manager would recommend that the Mayor and City Commission approve Amendment No. 1 to the City's current landscaping contract with Superior, to provide for the aforestated work. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment No. 1 to the contract with Superior Landscaping and Lawn Service, Inc. for Citywide Landscape Services, for Phase Two of the Julia Tuttle, in the amount of $265.000. for landscape restoration and beautification services at the Julia Tuttle Causeway site.
