A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND
THE CITY CLERK TO EXECUTE AMENDMENTS NO.18 AND NO. 19,
RESPECTIVELY, TO THE EXISTING AGREEMENT BETWEEN THE CITY OF
MIAMI BEACH AND CAMP DRESSER & McKEE, INC. (CDM), DATED JULY 18,
1992, FOR PROFESSIONAL AlE SERVICES FOR THE WATER AND WASTE
WATER PUMP STATIONS UPGRADES PROJECT AS FOLLOWS:
AMENDMENT NO. 18, IN A NEGOTIATED AMOUNT OF $277,186, FOR
ADDITIONAL PROFESSIONAL ENGINEERING AND RESIDENT INSPECTION
SERVICES, WITH FUNDING TO BE APPROPRIATED FROM GULF BREEZE
2006, FUND 423; AND AMENDMENT NO.19, IN A NEGOTIATED AMOUNT OF
$66,950, FOR ADDITIONAL PROFESSIONAL SERVICES RELATED TO ODOR
CONTROL AND SCREENING HANDLING AT PUMP STATIONS NO.1 AND NO.
28, WITH FUNDING AVAILABLE FROM PREVIOUSLY APPROPRIATED GULF
BREEZE 2006 FUND NO. 423.
WHEREAS, in 1992, the City initiated a Citywide Infrastructure Improvement Program to
address rehabilitation and upgrades to the Water, Sewer and Storm Water Systems; and
WHEREAS, pursuant to Resolution No. 92-20540, dated July 8, 1992, the Mayor and City
Commission approved an Agreement with COM, for Professional AlE Services for the Water and
Wastewater Pump Station Upgrades Project (the Agreement); and
WHEREAS, the Agreement provides for the architecture, design, engineering, permitting,
bidding, construction administration services, shop drawing review, resident inspection services and
reimbursables for the Project; and
WHEREAS, the Agreement was executed, in an amount of $ 129,442; and
WHEREAS, on August 8,1998, the City issued Invitation to Bid (ITB) No. 99-97/98, for the
Water and Wastewater Pump Station Upgrades Project (the Project) and, on February 3, 1999,
pursuant to Resolution No. 99-23061, the City Commission awarded the construction contract for
the Project to Felix Equities, Inc. (Felix), in the amount of $17,692,568; and
WHEREAS, on June 7, 2002, as a result of the default by Felix, the City terminated the
contract; and
WHEREAS, the City then procured a new contractor to resume the work that Felix had
started and, on January 14th, 2004, pursuant to Resolution No.2004-25465, the City Commission
awarded a new contract to Widell, Inc. (Widell), in the amount of $17,352,615; and
WHEREAS, the Project schedule has been impacted by several hurricanes in the past
two years, which resulted in equipment and resource shortages from several providers; and
WHEREAS, Florida Power and Light (FPL) has similarly been impacted by the hurricanes,
and attendant demands on its resources in the South Florida area have resulted in additional Project
delays and additional work by Widell; and
WHEREAS, Widell also had to deal with the consequences of accepting owner-fumished
materials previously purchased by Felix; returning defective equipment to manufacturers for
refurbishment and re-certifications; and having to replace parts and equipment that were damaged
or deteriorated while in storage; and
WHEREAS, City staff and Widell are currently negotiating an extension of approximately
six (6) months to the contract time which shall be submitted for approval to the City Commission in a
separate resolution; and
WHEREAS, change orders are being added to the Project and negotiations are still
needed; the Project is expected to be extended for another six months, and the assistance from
COM is essential to complete the Project; and
WHEREAS, accordingly, the Administration recommends that the Mayor and City
Commission approve Amendment No. 18 to the Agreement, in the amount of $277,186, which
includes additional construction administration and Resident Inspection Services for approximately
six (6) months, from January 1st, 2007, through June 29, 2007; and
WHEREAS, the odors in the vicinity of Pump Stations NO.1 and No. 28 are impacting the
neighborhoods surrounding the stations, and it is recommended that controls be installed to correct
these conditions; and
WHEREAS, accordingly, the Administration recommends that the Mayor and City
Commission approve Amendment No. 19 to the Agreement, in the negotiated amount of $66,950,
providing for the additional design services associated with the odor control and screening
improvements to Pump Stations NO.1 and No. 28 (to alleviate odors emanating from these stations,
which are located in residential areas); and
WHEREAS, funding for Amendment 18 is to be appropriated from 2006 Golf Breeze, Fund
423, and funding for Amendment No. 19 was previously appropriated from Fiscal Year 2006/2007
Capital Budget Gulf Breeze 2006, Fund No. 423.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and
City Commission hereby approve and authorize the Mayor and the City Clerk to
execute Amendments NO.18 and No. 19, respectively, to the existing Agreement
between the City Of Miami Beach And Camp Oresser & Mckee, Inc. (COM), dated
July 18, 1992, for Professional AlE Services for the Water and Waste Water Pump
Stations Upgrades Project as follows: Amendment No. 18, in a negotiated amount
of $277,186, for additional Professional Engineering and Resident Inspection
Services, with funding to be appropriated from Gulf Breeze 2006, Fund 423; and
Amendment No. 19, in a negotiated amount of $66,950, for additional Professional
Services Related to Odor Control and Screening Handling at Pump Stations NO.1
and No. 28, with funding available from previously appropriated Gulf Breeze 2006
Fund No. 423.

Item Summary/Recommendation:
The scope of work in the Water and Wastewater Pump Station Upgrades Project encompasses work at 31
different sites and account for over 110 building permits. The contractor has substantially completed four Dry-pit
wastewater stations, two Dry piVbooster dual stations, six Submersible wastewater stations and one Water
Station. The project is approximately 400 days late. The schedule has been impacted by eight hurricanes in the
past two years. Florida Power and Light (FPL) has similarly been impacted by the hurricanes, and attendant
demands on their resources in the area have resulted in additional delays and additional work for Widell, by
having to work around the main panels which has subsequently resulted in twice the amount of mobilizations.
Widell also had to deal with the consequences of accepting owner-furnished materials previously purchased by
Felix Equities, the previous contractor who was defaulted. Defective equipment had to be returned to
manufacturers for refurbishment and re-certification. Finally, the excessive demand on construction trades in
the South Florida area has resulted in manpower shortages. City staff, COM and Widell are currently
negotiating additional contract time due to these circumstances. Additionally, due to the extremely deteriorated
conditions of the stations, Widell has had to respond to various emergency requests from the City to work on
stations outside of their established schedule. Widell was directed to expedite the work in some stations to
address the City's priorities and to avoid violations from authorities having jurisdiction. In the past, four change
orders have been added administratively to the Widell contract using previously allocated contingency funds;
however, the contingency funding has now been exhausted. Change Order No.5 includes 33 items; 29 of which
are for work already performed. Widell proceeded with the work in order to avoid even longer delays. The
additional services for COM are due to the increased project scope and time extension.
The originai scope of work in 1992 had an odor control component which, due to cost reduction decisions, was
eliminated from the Project. Following the receipt of several complaints from residents, the Capital Improvement
Projects Office (CIP) and Public Works Department (PWD) have worked with COM to address these conditions.
A temporary solution, utilizing an ozone system, was installed at WWPS 28 and has been in operation for the
past seven months. Amendment 19, in the amount of $66,950, to COM, provides for the additional design
services associated with the odor control systems at Pump Stations No. 28 and No.1, to alleviate odors
emanating from the stations which are located in residential areas. It is also proposed that Change Order No.6
be issued to Widell for the installation of the appropriate odor control system and a sewage grinder at WWPS
28 as part of their current contract. The work would be added as a change order to the Widell Contract and a
time extension will be issued for the contractor to perform the work. Funding, in the amount of $692,357, was
previously appropriated in the FY 2006-2007 Capital Budget for Sewer Station Odor Control, for the Water and
Wastewater Pumo Station Uoorades Proiect.

appropriated in the Fiscal Year (FY) 2006-2007 Capital Budget from Gulf Breeze 2006 Fund

ANALYSIS
In 1992, the City initiated a citywide infrastructure improvement program to address
rehabilitation and upgrades to the water, sewer and storm water systems. On August 8,
1998, the City issued an Invitation to Bid (ITB) for the Water and Wastewater Pump Station
Upgrades Project (Bid No. 99-97/98), and on February 3,1999, under Resolution 99-23061,
the City Commission awarded the construction contract for the project to Felix Equities, Inc. in
the amount of $17,692,568.
On June 7, 2002, as a result of the default of Felix Equities, the City terminated the contract,
and entered into litigation against the contractor and its surety bonding company (United
States Fidelity & Guaranty Company). During the course of the litigation, all sides agreed to
settle the cases and in Resolution 2004-25765A, the City of Miami Beach approved the
settlement amount.
The City then procured a new contractor to resume the work that Felix Equities had started.
Pursuant to Resolution 2004-25465, the City Commission awarded the re-procurement
contract to Widell, in the amount of $17,352,615, and work commenced throughout the City.
On March 16, 2005, Resolution 2005-25847 approved the appropriation of additional funds to
include a new telemetry system and add miscellaneous scope to the project.
The scope of work includes furnishing and installing all necessary materials, equipment,
supplies and associated work including labor, excavation, etc. to complete the major
renovation of twelve (12) dry-pit wastewater pump stations (WWPS), two of which are dual
stations that also feature booster pumps that pressurize the force main; renovation of four
(4) water pump stations; construction of six (6) electrical/generator buildings; installation of a
new system-wide process instrumentation and control system; and the replacement of
eleven (11) submersible wastewater pump stations. The project encompasses work at 31
different sites and accounts for over 110 building permits which require multiple inspections
and final certifications.
The contractor has substantially completed the following pump stations and the City is
already benefiting from the operation of the new pumps and control system;

subcontractor who has been extremely busy and slow in responding to the project needs.

demands on their resources in the area have resulted in additional delays in energizing the
stations causing additional work on Widell, who has been forced to perform around the main
electrical panels and later return to complete other activities, which has resulted in twice the
amount of mobilizations. These events have also impacted CDM and City staff who have
had to provide additional coordination of the work.
Widell also had to deal with the consequences of accepting owner-furnished materials
previously purchased by Felix Equities. The need to return defective equipment to the
manufacturers for refurbishment and re-certification, as well as having to replace parts and
equipment that were damaged or deteriorated, while in storage, also contributed to the
overall delay. Finally, the excessive demand on construction trades in the South Florida area
in the last tow years has resulted in manpower shortages, especially with qualified electrical
subcontractors that are very critical to this industrial project. City staff, CDM and Widell are
currently negotiating additional contract time due to these circumstances.
Additionally, due to the extremely deteriorated condition of the stations, Widell has had to
respond to various emergency requests from the City to work on stations outside of their pre-
established schedule. A number of aged pumps at several stations had ceased to operate
prior to Widell's work commencing and the City had to by-pass those stations in order to
maintain the flows in the area. Widell was directed to expedite the work in those stations to
address the City's priorities and to avoid violations from authorities having jurisdiction.
In the past, four change orders have been added administratively to the Widell contract
using previously allocated contingency funds; however, the contingency funding has been
exhausted. The work included in the previous change orders is as follows (See Attachment 1

Since a construction extension contract is anticipated, and the contract for construction
administration and resident inspection services includes work through December 2006, there

is also a need for a new Amendment 18, negotiated with CDM for another six months, which
should allow sufficient time for Widell to complete the work. (Attachment "A")
Some of the pump stations that are located within residential areas, such as WWPS 1,
WWPS 15, WWPS 19, WWPS 21 and WWPS 28, have odors emanating from the wet wells
which impact the surrounding neighborhoods. The original scope of work in 1992 had an
odor control component which, due to cost reduction decisions, was eliminated from the
Project. The current construction codes require that ventilation be provided to the wet wells
and pump rooms, a feature not required in previous codes. The ventilation criteria in the new
code requires that wet wells be provided with exhaust ventilation systems, thus contributing
to the odor conditions in the immediate areas.
Following the receipt of several complaints from residents, the Capital Improvement Projects
Office (CIP) and Public Works Department (PWD) have been working with CDM to address
these conditions. A temporary solution, utilizing an ozone system, was installed at WWPS 28
and has been in operation for the past seven months. An engineering specialist studying the
site conditions has submitted a proposal for a permanent solution that includes not only the
odor control system, but also additional equipment to mechanically grind all solids at
WWPS1 and WWPS 28. This will be a significant improvement to the existing conditions
and the operation of these stations. CDM will evaluate WWPS 15, 19,21 and propose a
recommendation on whether the additional odor control will be necessary at those locations.
Amendment No.19, in the amount of $66,950, to an existing agreement with CDM, dated
July 8, 1992, provides for the additional design services associated with the odor control
systems at Pump Stations No. 28 and No.1, to alleviate odors emanating from these
stations which are located in residential areas. The necessary additional Professional
Engineering Services for the design of odor control and screening improvements to Pump
Stations #1 and #28, are defined by the CDM Consultant Service Order, dated July 12,
2006, and revised December 15, 2006 (Attachment "B").
The odor control system will be designed by CDM for WWPS28 and WWPS1, but only
initially installed at WWPS 28, and consists of two components. The first component grinds
all solids traveling through the system. This protects the pumps and eliminates the current
need by PWD personnel to rake and remove the solids from the wet well. Presently, the
pump stations are being manually raked and the material removed by truck several times a
day. This process has been identified as a major contributor to the odor permeating the
surrounding neighborhoods. The second component consists of a filtration system which will
be engineered in accordance to the flow capacity of the station.
It is also proposed that Change Order NO.6 (Attachment No.6) be issued to Widell for the
installation of the appropriate odor control system and a sewage grinder at WWPS 28 as
part of their current contract. The equipment will be installed above ground and additional
work will be required to buffer the equipment via the use of additional landscaping and/or a
fence. The landscaping component will be addressed as part of a previously funded initiative
to improve the landscaping at major pump stations throughout the City. The fence will be
included as part of the odor control equipment installation. It is in the best interest of the
Project, currently in progress, to use previously appropriated funds now in order to avoid any
further delays in the existing contract with Widell.
The Water and Wastewater Pump Station Project, including the odor control equipment at
Pump Station 28, is expected to be completed in the third quarter of 2007. Funding for this

work was previously appropriated as part of the FY 2006/2007 Capital Budget. The work
would be added as a change order to the Widell Contract and a time extension will be
issued for the contractor to perform the work.
CONCLUSION
The Administration recommends appropriating funds, in the amount of $277,186, for
Amendment No. 18 for additional construction administration and resident inspection
services for Camp Dresser and McKee inc.; and for Change Order NO.5 to Widell Inc., in
the amount of $416,643, from Gulf Breeze 2006 Fund No. 423. Further recommends
authorizing additional design services to CDM associated with odor control at Pump Stations
No. 28 and No.1, in the amount of $66,950; and approval of Change Order NO.6 to Widell,
in the amount of $625,407, for odor control equipment installation at Pump Station No. 28;
with funding, in the amount of $692,357, previously appropriated in the FY 2006-2007
Capital Budget, from Gulf Breeze 2006 Fund 423, for Sewer Station Odor Control, for the
Water and Wastewater Pump Station Upgrades.

PURPOSE. AIA Document G701 is for implementing changes in the Work agreed to by the Owner, Contractor and Architect.
E)lecution of a completed G701 indicates agreement upon all the tenns of the change, including any changes in the Contract
Sum (or Guaranteed Maximum Price) and Contract Time.

Technological advances in generator design since the project was

During construction, operational difficulties were discovered
related to the sonic level detector at WWPS 28. it was
determined that the problem was due to the distance between

was decided to relocate the HydroRanger from its the local
control panel closer to the wetwell. The same issue would we
anticipated at WWPS 21 and 11 due to the distance. It was
decided to relocate all three. [Reference RFP No. 27].

the work that was deemed fair and reasonable. Adjusting for

with the installation of piles for the new E&G building.

WWPS 28 & 29 OFM Gate Valve Inspection
During construction the City requested the Contractor to
submit a proposal to repair twelve existing large valves (six
each in WWPS 28 and 29). The exiting valves were
manufactured by a company no longer in business. The
Contractor engaged the services of a technician from another
valve company to explore the possibility of repairing the
valves in-place. It was subsequently determined the repair was
not an option. Thereafter, Contactor submitted a proposal to
replace the valves with new valves. Due to budgeting
concerns, the proposal was not acted on. The amount
requested is for actual costs incurred by Contractor to respond
to City's request for proposal. [Reference RCO 019].

Construction Services (Amendment 18 - Task 3.0) - Allowance Increase
Dear Mr. Slaba:
The current construction contract for the above referenced project is projected to extend past
the current contractual substantial completion date of December 31, 2006. Based on the
Contractor's latest construction schedule dated October 24,2006 substantial completion work
on the project is projected to extend to February 14, 2007.
The contract between the City and COM for general services and resident inspection services
was intended to run concurrently with the construction contract. Based on the additional time
the Contractor is expected to complete the project, we respectfully request an increase in our
contract allowance to extend our services for General Services and Resident Inspection
Services.
For budgeting purposes, we are using a reduced fee of $600 per day for General Services
based on an anticipated activity level of the Contractor to complete the work. Similarly, we
are using a Resident Inspection Services rate of $923 per day. This rate anticipates the use of
an additional inspector to supplement tile inspector and provide coverage of the multiple
pump stations under construction.
As discussed, the proposed extension covers a period of 6 months (26 weeks) commencing on
January 1, 2007 through June 29, 2007, avoiding a lapse to our current services on this project.
The total allowance for the above described services is a not to exceed amount of $277,186.

Engineering Services for the referenced project, CDM will assist the City in designing odor

Accordingly, the professional fees have been adjusted to reflect the revised scope of work.

PUMP STATIONS No.1 and 28 ODOR CONTROL AND SCREENINGS HANDLING

BACKGROUND
This proposal is submitted in response to a request by the City of Miami Beach (City) to
provide assistance with the design of odor control systems at Pump Stations (PS) No.1
and 28. To assist the City in its endeavor to reduce odors, Consultant will provide
engineering design to install the following:
· Standard prefabricated biological filters at Pump Stations No. 28.
· Standard prefabricated carbon adsorption unit for Pump Station No.1.
· Each unit will require slab on grade and 480 volt power as well as a water source
and a drain.
Additionally the Consultant will assist in the installation of screenings macerating units
at Pump Stations No.1 and 28. The macerators at Pump Station No, 1 and 28 will be
used to grind screening material in the wastewater flow stream before they reach the
pumping equipment.
It is anticipated in the design approach that the recommended improvements will be
implemented as a construction change order to the current on going pumps station
improve. The Consultant will undertake the following scope of work to implement the
project's objectives.
SCOPE OF SERVICES
TASK 1 - Preliminary Engineering
1.1 Consultant will determine the feasibility of adding odor control and screening
handling equipment at the Pump Stations. Consultant will identify spacing and
hydraulic constraints that must be considered during equipment selection.
Consultant will use proven technologies and equipment with a positive track
record.
1.2 Consultant will identify up to two local installations of the proposed macerator
equipment and coordinate a field visit to selected facilities. City representative(s)
will accompany Consultant to observe an actual installation of the proposed
equipment. Consultant will phone contact at least two installation of the
proposed equipment and submit the results to the City.

1.3 Consultant will install an odor logger for monitoring hydroges sulfide at PS No.
1 and 28 for approximately a 7-10 day period each. Consultant will analyze the
data in establishing design selection criteria for the odor control equipment.
1.4 Consultant will prepare a technical memorandum documenting the efforts of the
preliminary engineering task. The memorandum will present the equipment
selected, placement and an opinion of probable cost of construction, Equipment
catalog sheets and conceptual drawings for the installation will be included in
the appendix.
TASK 2 - Detailed Design
2.1 Upon completion and acceptance by the City of Task 1, Consultant shall proceed
to develop the final design for use in the construction of the proposed facilities.
Consultant proposes to produce drawings and specification in sufficient detail
for the construction Contractor to submit a cost proposal. It is assumed that a
majority of the support specifications (concrete, electrical, etc.) will be reused
from the current construction contract. A preliminary list of drawings will be
required for each station for this Task as follows:

2.2 Consultant shall submit a fifty percent complete set of contract documents to the
City and the Contractor for their review and comment. Consultant shall meet
with the City to discuss review recommendations and commentary.
2.3 Once comments are received, Consultant shall prepare the final contract
documents for the 100 percent submittal to the City. This may include a fence or
other type of simple screen as required by the Planning Department.

TASK 3 - Contractor Proposal Negotiation
3.1 Consultant will assist the City in securing a formal cost proposal from the Pump
Station Upgrades Contractor. Consultant shall review scope and cost proposal
and request clarifications and modifications as necessary to ensure
implementation of project as intended.
TASK 4 - Permitting (Allowance)
4.1 The Consultant will prepare permits as necessary for the project.
4.2 At this time permits are not anticipated from DERM.
4.3 Consultant shall submit the drawings to the City Building Department for" dry"
run review at the 50 percent design submittal stage.
4.4 Additional landscaping may be required based on the comments from the City's
Planning Department.
SERVICES NOT INCLUDED/CLARIFICATIONS
1. No surveying services are anticipated for this project. Consultant shall use the
survey prepared for each of the Pump Stations from the upgrade project.
2. Consultant assumes that work will be added as a negotiated change order to the
ongoing Pump Station Upgrades construction contract.
3. City will review documents and prepare written comments within fifteen (15)
calendar days after the submittal date, Upon receipt of comments from the City,
Consultant will submit within two weeks the final version of documents to the
appropriate agencies for permitting.
4. City will pay for any permitting fees.
SCHEDULE (TIME OF PERFORMANCE)
Consultant will commence work within two weeks after receipt of a formal Notice to
Proceed. CONSULTANT will complete this scope of work for Tasks 1 through 4
(submittal of permit application) within 90 days from the Notice to Proceed.
DELIVERABLES
Consultant will prepare the following deliverables as part of this Scope of Work:
1. Consultant will prepare and submit a draft Technical Memorandum with respect to
the preliminary engineering phase of the project. Consultant will meet with the City
to review and discuss the draft memorandum. A final version shall be delivered to

the City after incorporating appropriate review comments. Five copies of the
memorandum shall be distributed to the City.
2. Consult shall prepare drawings and specifications for the implementation of the
odor control and screening handling measures. Five sets of Contract Documents
shall be prepared.
3. If required, Consultant will prepare signed and sealed permit applications for
regulatory agencies,
4. Consultant will submit design documents (i.e. plans and specifications) to the
construction contractor to obtain proposal for the work on a change under basic.
PAYMENI AND COMPENSATION
Invoicing shall be monthly on a percent of completion basis for the lump sum portion,
Task 1-3, and on a time and materials basis for the upper limit, Task 4, at the
Consultant's prevailing hourly billing rates plus other direct costs a written monthly
status xeport will accompany each progress billing. The total lump sum for Tasks 1
through 3 is $5~,950 and the not-to-exceed allowance for Task 4 is $10,000. The total not-
t:o-exceed amount for this authorization is $66,950. A fee structure breakdown is
provided in Attachment 1.

FOR THE PROVISION OF ADDITIONAL GENERAL ENGINEERING AND RESIDENT
CONSTRUCTION SERVICES NECESSARY TO COMPLETE
THE WATER WASTEWATER PUMP STATION UPGRADES PROJECT.
This Amendment No. 18 to the Professional Services for AlE services for the Water and
Wastewater Pump Station Upgrades Project (the Agreement), made and entered this 17th day of
January, 2007, by and between the CITY OF MIAMI BEACH, a Municipal Corporation existing under
the laws of the State of Florida, having its principal offices at 1700 Convention Center Drive, Miami
Beach, Florida 33139 (hereinafter referred to as City), and CAMP DRESSER & MCKEE, INC.,
having its offices at 800 Brickell Avenue, Suite 710, Miami, Florida 33131 (hereinafter referred to as
Consultant).
RECITALS:
WHEREAS, pursuant to Resolution No. 92-20540, dated July 8, 1992, the Mayor and City
Commission approving an Agreement with Consultant, for Professional AlE Services for the Water
and Wastewater Pump Station Upgrades Project (the Agreement); and
WHEREAS, the Agreement provides for the architecture, design, engineering, permitting,
bidding, construction administration services, shop drawing review, resident inspection services ,and
reimbursables for the Project; and
WHEREAS, the Agreement was executed, in an amount of $ 129,442; and
WHEREAS, change orders are being added to the Project and negotiations are still needed;
the Project is expected to be extended for another six months, and the assistance from CDM is
essential to complete the Project; and
WHEREAS, accordingly, the Administration recommends that the Mayor and City
Commission approve Amendment 18 to the Agreement, in the amount of $277 ,186, which includes
additional construction administration and Resident Inspection Services for approximately six (6)
months, from January 1st, 2007, through June 29, 2007; and
WHEREAS, this Amendment No. 18 increases the Agreement fee by $277 ,186, for a total
fee of $4,198,603.
NOW. THEREFORE. the parties hereto, and in consideration of the mutual promises,

covenants, agreements, tenms, and conditions herein contained, and other good and valuable
consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this Amendment
No. 18.
2. MODIFICATIONS
The Agreement is amended to provide the necessary additional services required to provide
additional Construction Administration and Resident Inspection Services, as set forth by the
attached Camp, Dresser & McKee Inc. Consultant Service Order dated November 13, 2006,
and revised on January 4, 2007 (Attachment "A"), in the corresponding negotiated amounts
of $109,200, for Construction Administration, and $167,986, for Resident Inspection
services; for a total of $277 ,186 for services through June 29, 2007.
3. OTHER PROVISIONS
All other provisions of the Agreement remain unchanged.
4. RATIFICATION
The City and Consultant ratify the terms of the Agreement, as per this Amendment No. 18.

Amendment 19 to the Agreement, in the negotiated amount of $66,950, provides for the additional
design services associated with the odor control and screening improvements to Pump Stations No.
1 and No. 28 (to alleviate odors emanating from these stations which are located in residential
areas); and
WHEREAS, this Amendment No. 19 increases the Agreement fee by $66,950, for a total fee
of $4,265,553.
NOW. THEREFORE. the parties hereto, and in consideration of the mutual promises,
covenants, agreements, terms, and conditions herein contained, and other good and valuable

consideration, the respect and adequacy are hereby acknowledged, do agree as follows:
1. ABOVE RECITALS
The above recitals are true and correct and are incorporated as a part of this Amendment
No. 19.
2. MODIFICATIONS
The Agreement is amended to provide the necessary additional services required to provide
additional design services related to Odor Control at Pump Station No.1 and No. 28 for the
Project, as set forth by the attached Camp, Dresser & McKee Inc. Consultant Service Order
dated July12, 2006, and revised January 4,2007 (Attachment "B"), in the corresponding
negotiated amount of $66,950, for Odor Design Services at Pump Stations No. 28 and No.
1.
3. OTHER PROVISIONS
All other provisions of the Agreement remain unchanged.
4. RATIFICATION
The City and Consultant ratify the terms of the Agreement, as per this Amendment No. 19.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 19 to be

Per your request, we are pleased to submit a revised proposal to provide Professional
Engineering Services for the referenced project. COM will assist the City in designing odor
control and screening improvements to Pump Stations 1 and 28 pursuant to the July 11, 2006
meeting with the CIP Office and the Public Works Department.
Accordingly, the professional fees have been adjusted to reflect the revised scope of work.
The requested total not to exceed amount for the project is $66,950. An itemized fee structure
breakdown is provided in Attachment 1. All other terms remain unchanged from the
proposal dated June 6, 2006.

BACKGROUND
This proposal is submitted in response to a request by the City of Miami Beach (City) to
provide assistance with the design of odor control systems at Pump Stations (PS) No.1
and 28. To assist the City in its endeavor to reduce odors, Consultant will provide
engineering design to install the following:
. Standard prefabricated biological filters at Pump Stations No. 28.
. Standard prefabricated carbon adsorption unit for Pump Station No. 1.
. Each unit will require slab on grade and 480 volt power as well as a water source
and a drain.
Additionally the Consultant will assist in the installation of screenings macerating units
at Pump Stations No.1 and 28. The macerators at Pump Station No, 1 and 28 will be
used to grind screening material in the wastewater flow stream before they reach the
pumping equipment.
It is anticipated in the design approach that the recommended improvements will be
implemented as a construction change order to the current on going pumps station
improve. The Consultant will undertake the following scope of work to implement the
project's objectives,
SCOPE OF SERVICES
TASK 1 - Preliminary Engineering
1.1 Consultant will determine the feasibility of adding odor control and screening
handling equipment at the Pump Stations. Consultant will identify spacing and
hydraulic constraints that must be considered during equipment selection.
Consultant will use proven technologies and equipment with a positive track
record.
1.2 Consultant will identify up to two local installations of the proposed macerator
equipment and coordinate a field visit to selected facilities. City representative(s)
will accompany Consultant to observe an actual installation of the proposed
equipment. Consultant will phone contact at least two installation of the
proposed equipment and submit the results to the City.

1.3 Consultant will install an odor logger for monitoring hydroges sulfide at PS No.
1 and 28 for approximately a 7-10 day period each, Consultant will analyze the
data in establishing design selection criteria for the odor control equipment.
1.4 Consultant will prepare a technical memorandum documenting the efforts of the
preliminary engineering task, The memorandum will present the equipment
selected, placement and an opinion of probable cost of construction. Equipment
catalog sheets and conceptual drawings for the installation will be included in
the appendix.
TASK 2 - Detailed Design
2.1 Upon completion and acceptance by the City of Task 1, Consultant shall proceed
to develop the final design for use in the construction of the proposed facilities.
Consultant proposes to produce drawings and specification in sufficient detail
for the construction Contractor to submit a cost proposal. It is assumed that a
majority of the support specifications (concrete, electrical, etc.) will be reused
from the current construction contract. A preliminary list of drawings will be
required for each station for this Task as follows:

2.2 Consultant shall submit a fifty percent complete set of contract documents to the
City and the Contractor for their review and comment. Consultant shall meet
with the City to discuss review recommendations and commentary.
2.3 Once comments are received, Consultant shall prepare the final contract
documents for the 100 percent submittal to the City. This may include a fence or
other type of simple screen as required by the Planning Department.

TASK 3 - Contractor Proposal Negotiation
3.1 Consultant will assist the City in securing a formal cost proposal from the Pump
Station Upgrades Contractor. Consultant shall review scope and cost proposal
and request clarifications and modifications as necessary to ensure
implementation of project as intended,
TASK 4 - Permitting (Allowance)
4.1 The Consultant will prepare permits as necessary for the project.
4.2 At this time permits are not anticipated from DERM.
4.3 Consultant shall submit the drawings to the City Building Department for "dry"
run review at the 50 percent design submittal stage.
4.4 Additional landscaping may be required based on the comments from the City's
Planning Department.
SERVICES NOT INCLUDED/CLARIFICATIONS
1. No surveying services are anticipated for this project. Consultant shall use the
survey prepared for each of the Pump Stations from the upgrade project.
2, Consultant assumes that work will be added as a negotiated change order to the
ongoing Pump Station Upgrades construction contract.
3. City will review documents and prepare written comments within fifteen (15)
calendar days after the submittal date. Upon receipt of comments from the City,
Consultant will submit within two weeks the final version of documents to the
appropriate agencies for permitting.
4. City will pay for any permitting fees.
SCHEDULE (TIME OF PERFORMANCE)
Consultant will commence work within two weeks after receipt of a formal Notice to
Proceed. CONSULTANT will complete this scope of work for Tasks 1 through 4
(submittal of permit application) within 90 days from the Notice to Proceed.
DELIVERABLES
Consultant will prepare the following deliverables as part of this Scope of Work:
1. Consultant will prepare and submit a draft Technical Memorandum with respect to
the preliminary engineering phase of the project. Consultant will meet with the City
to review and discuss the draft memorandum. A final version shall be delivered to

the City after incorporating appropriate review comments. Five copies of the
memorandum shall be distributed to the City.
2. Consult shall prepare drawings and specifications for the implementation of the
odor control and, screening handling measures. Five sets of Contract Documents
shall be prepared.
3. If required, Consultant will prepare signed and sealed permit applications for
regulatory agencies.
4. Consultant will submit design documents (i.e. plans and specifications) to the
construction contractor to obtain proposal for the work on a change under basic.
PAYMENT AND COMPENSATION
Invoicing shall be monthly on a percent of completion basis for the lump sum portion,
Task 1-3, and on a time and materials basis for the upper limit, Task 4, at the
Consultant's prevailing hourly billing rates plus other direct costs a written monthly
status report will accompany each progress billing. The total lump sum for Tasks 1
through 3 is $56,950 and the not-to-exceed allowance for Task 4 is $10,000. The total not-
to-exceed amount for this authorization is $66,950. A fee structure breakdown is
provided in Attachment 1.
