2000-24043 RESO RESOLUTION NO. 2000-24043 A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER EXECUTE A MEMORANDUM OF UNDERSTANDING BETWEEN THE MIAMI CITY BALLET AND THE CITY OF MIAMI BEACH REGARDING THE USE OF THE MIAMI CITY BALLET BUILDING LOCATED AT 2200 LIBERTY A VENUE AS A FORWARD COMMAND POST DURING SPECIFIED HURRICANE CONDITIONS. WHEREAS, The City of Miami Beach desires to use the Miami City Ballet building for a Forward Command Post and Landfall team shelter for category 2 and 3 hurricanes; and WHEREAS, the Miami City Ballet building will require a number of temporary modifications to the building to be paid for by the City of Miami Beach according to plans first approved by the Miami City Ballet; and WHEREAS, this limited use of the Miami City Ballet building is subject to the agreement between the parties for the terms and conditions of such use. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager is authorized to execute a Memorandum of Understanding between the Miami City Ballet and the City of Miami Beach regarding the use of the Miami City Ballet building located at 2200 Liberty A venue as a Forward Command Post during specified hurricane conditions. ADMINISTRATIVE RECOMMENDATION Adopt the Resolution. ANALYSIS The City of Miami Beach desires to use the Miami City Ballet building for a Forward Command Post and Landfall Team Shelter for Category 2 and 3 Hurricanes. Once the Miami City Ballet facility is certified by the Structural Engineer it can be used up to and including a Category 5. This will require modifications to the building, to be paid for by the City of Miami Beach according to plans first approved by the Miami City Ballet as listed below: ESTIMATED COSTS OF THIS PROJECT Information Technology Department Estimated Costs (attached quotes): Phone and radio wiring, adding phone lines into the building and placing a portable fixed beam antenna to the roof: I. ASE Inc. Telecommunications and Data 2. Motorola 3. Bell South $ 760 $12,337 $ 3,000 * There are no generator costs as generator rental is covered under FEMA Category "B." Equipment purchased and included in the estimated cost above will remain the property of the City and can be utilized in other City facilities. The Memorandum of Understanding defines the roles and responsibilities of both agencies prior to, during and after a hurricane emergency operation conducted on Miami City Ballet property. MEMORANDUM OF UNDERSTANDING BETWEEN MIAMI CITY BALLET and THE CITY OF MIAMI BEACH 1. This memorandum of understanding outlines the agreement between Miami City Ballet (MCB) and the City of Miami Beach (CMB) regarding the use of the MCB building located at 2200 Liberty Avenue (the facility) during specified hurricane conditions. 2. The CMB fully recognizes and understands that the MCB facility is private property and that MCB has authority over what takes place on its premise. 3. The CMB desires to use MCB building for a Forward Command Post and Landfall Team shelter for Category 2 and 3 Hurricanes. To accomplish this, the CMB needs to provide for temporary backup electrical power in the form of transfer switching gear and generators, as well as run additional phone lines inside the building. A small rooftop antenna is also required. All work performed at the building is to be paid for by the CMB, according to plans first approved by MCB. Any changes made by CMB will maintain the aesthetic appearance of the facility. 4. All work done at MCB will be properly permitted and done to CMB code requirements. 5. The CMB assumes liability of repairing any damage to the building during this work or damage caused by its personnel, others allowed into the facility by CMB, or CMB equipment during occupancy. 6. The CMB will return the building to MCB after each usage in the same condition it was prior to the hurricane emergency, excepting any damage to the building caused by the hurricane. If, however, such hurricane damage to the facility or its contents is the result of any intentional or negligent act or omission of CMB employees or others allowed by CMB into the facility, then repair of said damage will be the responsibility of the CMB. 7. This agreement shall become effective upon the date of the last party to sign. The agreement shall be renewed on an annual basis by June I, prior to the start of the storm season. 8. The CMB employees shall occupy the facility 36 hours before projected landfall, as declared by the National Hurricane Center. The City will vacate the facility as soon as it is deemed safe for City employees by the CMB. 9. The CMB will leave the generators on site for use by MCB, until electrical service . has been restored to MCB' s facility. MCB will bear all costs for the generators after CMB vacates the facility. 10. The MCB Facilities Director and other designees, as well as their spouses will have the right to stay in the facility during occupancy by the CMB to assist with any questions about the facility.
