2000-24037 RESO RESOLUTION NUMBER 2000-24037 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER PERTAINING TO THE RANKING OF THE PROPOSALS RECEIVED IN RESPONSE TO REQUEST FOR PROPOSALS (RFP) NO. 101-99/00 FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID WASTE, YARD TRASH, BULK WASTES, AND OPERATION OF THE CITY'S SOLID WASTE MANAGEMENT; AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOP-RANKED FIRM, BFI WASTE SYSTEMS OF NORTH AMERICA, INC., TO PROVIDE THE SANITATION SERVICES; AND FURTHER AUTHORIZING THE ADMINISTRATION TO NEGOTIATE WITH THE SECOND RANKED FIRM OF REPUBLIC SERVICES, INC., SHOULD THE ADMINISTRATION NOT BE ABLE TO SUCCESSFULLY NEGOTIATE A CONTRACT WITH THE TOP-RANKED FIRM. WHEREAS, the City's existing Agreement with Onyx Florida, LLC, for residential solid waste and yard trash collection services is due to expire on October 18, 2000; and WHEREAS, the City's existing Agreement with Onyx Florida, LLC, for the operation of the Solid Waste Management Facility (alk/a Stash Area) located within the Bayshore Golf Course at 28th Street and Meridian Avenue, is also due to expire on October 18, 2000; and WHEREAS, the Administration fmds it in the public interest to promote consistency in delivery of waste collection and disposal services; therefore, the collection of residential solid waste and yard trash was combined with the operation of the Solid Waste Management Facility into one service Agreement; and WHEREAS, the Mayor and Commission authorized the issuance of Request for Proposals (RFP) No. 101-99/00 for collection and disposal of residential solid waste, yard trash, bulk wastes, and operation of the city's solid waste management on May 24, 2000; and WHEREAS, the RFP was issued on June 9, 2000, with an opening date of July 14, 2000, and a total of seven (7) responses were received; and WHEREAS, an Evaluation Committee met on July 17, 2000, to review all the responses received; and WHEREAS, after evaluating the proposals, the Evaluation Committee ranked BFI Waste Systems of North America, Inc. as the top-ranked firm, and Republic Services, Inc. as the second-ranked firm; and WHEREAS, in accordance with the terms of the RFP, the City Manager has reviewed the Evaluation Committee's recommendation and concurs with its ranking of responses. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein accept the rankings recommended by the City Manager and the Administration is hereby authorized to enter into negotiations with the top-ranked firm, BFI Waste Systems of North America, Inc., and is further authorized to negotiate with the second- ranked firm, Republic Services, Inc., should the Administration not be able to successfully negotiate a contract with the top-ranked firm. ANALYSIS: The City's existing Agreement with Onyx Florida, LLC, for residential solid waste and yard trash collection services is due to expire on October 18, 2000. The existing Agreement with Onyx Florida, LLC, for the operation of the Solid Waste Management Facility (a.k.a. Stash Area) located within the Bayshore Golf Course at 28th Street and Meridian Avenue, is also due to expire on October 18, 2000. Based on negotiations with Onyx, the Administration determined that the renewal options contained in the Agreements cannot be exercised, because the Contractor has indicated that it was unable to renew the service agreements within the cost constraints included in the renewal options. AGENDA ITEM _P-lF , DATE.:J- 2h-<:j:) Because the Administration found it in the public interest to promote consistency in delivery of waste collection and disposal services, the collection of residential solid waste and yard trash was combined with the operation ofthe Solid Waste Management Facility into one Service Agreement. In order to provide for the competitive selection of a new service provider in sufficient time to allow for a smooth transition, the City Commission authorized the issuance of Request for Proposals (RFP) No. 101-99/00 on May 24, 2000. The RFP was issued on June 9, 2000, with an opening date of July 14, 2000. A total of seven (7) responses were received from the following firms: Waste Management, Inc. Eagle Sanitation, Inc. Delta Sanitation, Inc, Onyx Florida, LLC Republic Services, Inc, BFI Waste Systems of North America Inc. Disposal, Inc. On July 17, 2000, the Evaluation Committee met to review all the responses received. The Committee consisted of the following individuals: *Matthew Schwartz, Assistant City Manager *Robert Thomas, Sanitation Director *Patricia D. Walker (or designee), Finance Department *Bruce Henderson, Environmental Specialist Community Representatives: Mike Rothbart Bill Williams *Roberto Datorre Diana Patton *Deborah Jacobson Those denoted with an asterisk were in attendance. Roberto Datorre was selected as the Committee Chairperson. Each member in attendance reviewed and evaluated all responses in accordance with the criteria listed in the RFP The evaluation criteria included the proposer's ability to provide quality services, their previous industry experience and their financial stability, however, pricing was considered to be the most important criteria and was assigned 50% of the weight in the evaluation scoring. Onyx Florida, LLC After evaluating the proposals, the committee members submitted their individual score sheets to the Chairperson. The committee unanimously agreed to short list the field of proposers to the two top-ranked firms, BFI Waste Systems of North America, Inc. and Republic Services, Inc. because they were both deemed to be far superior to the other proposals received. The evaluation committee's scoring of the two top ranked firms was extremely close. In fact, the two firms tied in ranking based on the non-cost related criteria. Because of the weight given to cost criteria, the final scoring from the committee ranked the firm of BFI Waste Systems of North America, Inc. as the top-ranked firm, and Republic Services, Inc. as the second-ranked firm. The Committee's recommendation was provided to the City Manager for his consideration. In accordance with the terms of the RFP, the City Manager has reviewed the Evaluation Committee's recommendation and concurs with its ranking of responses. The Mayor and City Commissioners are not bound by either the City Manager's or the Evaluation Committee's recommendations. The ability of the top-ranked proposers to deliver quality services should be given primary consideration in making the fmal selection. Because of the closeness in the ranking between the two top-ranked firms, their representatives have been invited to attend the City Commission meeting to answer any questions the Commissioners may have regarding their proposals. It should be noted that since the top ranked and lowest cost proposal prices are approximately $4/unit/month higher than the existing contract rates paid by the City, a corresponding rate increase will be passed-through to the residential service customers. The total increase in cost per single family home will be approximately $4/month or $48 annually. Under their former contract, BPI Waste Systems, Inc. charged the City $15.40 per unit for both Single and Multifamily facilities. The Mayor and Commission should accept the ranking recommended by the City Manager, and authorize the Administration to enter into negotiations with the top-ranked firm of BFI Waste Systems of North America, Inc., and further, authorize the Administration to negotiate with the second-ranked firm of Republic Services, Inc., should the Administration not be able to successfully negotiate a contract with the top-ranked firm.
