2000-24025 RESO RESOLUTION NO. 2000-24025 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING, BY 5/7THS VOTE, THE WAIVER OF FORMAL COMPETITIVE BIDDING AND AUTHORIZING THE DIRECTOR OF PROCUREMENT TO NEGOTIATE A PURCHASE ORDER WITH SPECIFIED ARCHITECTURAL SYSTEMS, INe., IN AN AMOUNT NOT TO EXCEED $100,000, FOR THE REMOVAL AND REPLACEMENT OF 25 KALWALL PANELS AND ASSOCIATED BATTENS AND FLASHING, AND FOR THE CLEANING AND RESTORATION OF EXISTING KALW ALL PANELS OVER THE SKYWALK, THE EXECUTIVE OFFICES AND THE EAST ENTRANCE ATRIUM AREAS OF THE MIAMI BEACH CONVENTION CENTER TO PREVENT WATER INTRUSION AND TO IMPROVE THE APPEARANCE OF THESE AREAS. WHERF;AS, the City is desirous of maintaining the Miami Beach Convention Center in good condition; and WHEREAS, the Skywalk area of the Convention Center has been subjected to water intrusion due to leakage around certain of the panels which make up the translucent roof; and WHEREAS, the Skywalk roof has been evaluated, and the City received a proposal from the exclusive representative of the Kalwall Corporation, Specified Architectural Systems, Inc., for the replacement of a number of the existing Kalwall panels, and cleaning and re-sealing the remaining panels in order to make this area watertight; and WHEREAS, the Kalwall Company is the sole supplier of the translucent panels of the type used in the Skywalk roof, and no other fmu has been located which will provide a five year warranty on the entire Skywalk roof area following partial replacement and resealing ofthe remaining panels; and WHEREAS, funds for the project are available from the Convention Center Capital Plan Floor Resealing Account No. 441.2215.069358, which will be reallocated to a new work order to be established for this project; and WHEREAS, the Administration recommends that the Mayor and City Commission waive competitive bidding and authorize the representative of the Kalwall Company to repair and renovate the Skywalk FOof in accordance with the proposal submitted to the City, finding such waiver to be in the best interest of the City. NOW THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission authorize, by 517ths vote, the waiver of competitive bidding and authorize the Director of Procurement to negotiate a purchase order with Specified Architectural Systems, Inc., in an amount not to exceed $100,000.00, for the removal and replacement of25 Kalwall Panels and associated battens and flashing, and for the cleaning and restoration of existing Kalwall Panels over the Skywalk, the Executive Offices and the East Entrance Atrium areas of the Miami Beach Convention Center, to prevent further water intrusion and to improve the appearance of these areas. Since that time, this area has deteriorated, and has begun to experience nmnerous leaks, and the walls and floor under this section have suffered continuing damage as a result. At the request of SMG Corporation, the Convention Center Managers, we have evaluated this section of the roofto determine an appropriate solution. The original vendor of this roofing material is Kalwall Corporation. Their representative, Specified Architectural Systems, Inc. (SAS) was contacted and asked to survey the roof and report to the City on the results. Following their examination of the roof, SAS recommended that the problems could be solved through the replacement of some of the roof panels which were most seriously deteriorated, and undertaking a process of cleaning, re-fastening, applying a weather resistant coating, and re-sealing the existing panels which were not to be replaced, would restore the translucent roof to a weather-tight condition, and following this process, the vendor will issue a five- year warranty against further leakage for the entire system, consisting of new and refurbished existing panels. The City's consultant for the Convention Center Roof, Brown and Brown Architects, have advised that this product will meet the City's requirement for the repair of the Skywalk roof area. Furthermore, the Kalwall Corporation is the only firm which manufactures a translucent panel product for roofing use which has met the Miami-Dade County Product Acceptance Standard. Specified Architectural Systems, Inc. Is Kalwall's exclusive representative for all of Florida except the panhandle area. Therefore, based on our research, we believe that they are the only qualified vendor for this product which can meet the City's needs. FL Kalwall Skyroofs We are pleased to submit the following revised bid regarding the Kalwal! Translucent Insulated Skyroofs: DESCRIPTION: PANEL REPLACEMENT Type "A" skyroof (long, multiple bay ridge) - Removal and replacement of (25) chosen Kalwall panels and associated connector battens and flashing. Type "B" skyroof (single bay ridge) - Total removal and replacement of Kalwall panels and flashing. Note: Replacement of the above Kalwall panels is recommended due to the inability to restore panels from effects caused by long-tenn weathering. CLEANING AND RESTORING EXISTING KALWALL PANELS (Excluding Pyramid Tower) Work shall consist of cleaning and light sanding of the exterior surface of Kalwall panels. We shall then apply a clear coat of Kalwall Weatherseal to help reduce the weathering effects and insure the longevity of the Kalwall system. In addition. we shall secure all fastener connections and panel battens to insure a watertight application of the Kalwall system. Note: Periodic cleaning of the Kalwall panels is still recommended to help reduce dirt buildup and insure panel perfonnance. Included in this proposal is our five- (5) year watertight warranty for the Kalwall system. TOTAL COSTS: $85,300.00. ADD # 1 - Pyramid Tower Work shall consist of cleaning and restoring Kalwall panels for pyramid entrance tower with procedure described above. We are providing this as an ADD cost due to the good appearance of these panels and the equipment required to perfonn the work. TOTAL COSTS: $3260.00 NOTES: 1) Hoisting equipment is included in this proposal. 2) The face sheet of the new panels may differ from the existing panels due to the aging of the fiberglass and different fonnulation of resins in the new fiberglass sheets. 3) Required counter-flashing is included. ADMINISTRATION RECOMMENDATION Adopt the Resolution. AMOUNT AND FUNDING The total cost of the proposed repairs is estimated to be less than $100,000. This amount remains available from the approved Convention Center Capital Plan Floor Resealing Account, since this project has been postponed until next year. The $100,000 will be reallocated from Account No. 441.2215.069358 into a new work order to be established for this project. ANALYSIS The skywalk area, the East Entrance Atrium, and the lobby of the executive offices of the Convention Center are illuminated during daylight hours by outside light passing through large overhead translucent panels. These fiberglas reinforced resin panels, and the steel connectors and battens have suffered from the effects of weather and salt-air corrosion, and some of the panels have become warped and discolored. In addition, water leaks have developed around a number of the panels, these leaks are damaging the interior of the Convention Center. In order to halt the water leakage, and to replace the unsightly discolored panels, the City contacted Specified Architectural Systems, Inc., the sole Florida representative for Kalwall Corporation, the AGENDA ITEM (" :I -z.... "l - "2.fc, -c:5.:l DATE company which supplied the original panels to obtain a quotation for the replacement of the warped and discolored panels, and for re-sealing the framework surrounding the existing and the new panels to prevent any further water intrusion. After inspecting the existing skywalk area, the vendor's engineers recommended replacing twenty- five (25) of the existing panels, and cleaning, sanding and weather sealing the balance of the panels. In addition, the entire panel system will be secured to insure that it is watertight. Following this work, the vendor will provide the City a new five-year warranty against further water intrusion of the entire system, including the existing panels which are not being replaced at this time. The panels on the roof of the East Entrance Atrium area (over the Washington A venue entrance) will be cleaned and resealed. Cleaning and resealing these panels will make them subject to the five year warranty against water intrusion as well. The total price for the proposed work is estimated to be less than $100,000.00. Because of the absence of directly competitive producls, this purchase meets the requirements set forth in Section 2-367(c.) of the Miami Beach City Code for a sole-source purchase. The text of this Section in pertinent part, is as follows: "... the using agency shall submit justification in writing, together with all supporting documentation, to the procurement director, stating [1] that the proposed supplier is the only source of supply of the desired goods and/or services, and [2] that there is no other supplier or authorized repairlservice center (as applicable). The supporting documentation shall include [3] a written quotation with terms and conditions of sale. In addition, the using agency shall obtain [4] the written determination from an industry expert or consultant that the item or service is the only one available 10 fulfill the city's need,"[bracketed numbers added] In order to fully comply with the requirements of this Section, the following documents are attached in response to each of the requirements of this Section: [1] Letter from Kalwall Corporation confirming that Specified Architectural Systems, Inc. is the exclusive distributor for Kalwall in all of Florida except the panhandle area. [2] Letter from Specified Architectural Systems, confirming that Kalwall is the only manufacturer of panels which meet the specifications for the Convention Center roof application which meets the Miami-Dade County Product Approval requirement. [3] Written quotation from Specified Architectural Systems outlining the terms and conditions of sale. [4] Letter from Brown and Brown Architects, Inc., the City's consultant for the Convention Center roof replacement project, advising that the City replace the panels with the same manufacturer's product to avoid a total replacement, and to maintain warranty responsibility with a single manufacturer. The Administration recommends that the Mayor and City Commission adopt the Resolution, by at least a 5/7ths vote, authorizing the waiver of competitive bidding and authorizing the City's Procurement Director to negotiate a purchase order with Specified Architectural Systems, Inc., for the removal and replacement of 25 Kalwall panels and associated battens and flashing and for the cleaning and restoration of the existing panels over the skywalk, the executi ve offices and the East Atrium areas of the Convention Center to prevent water intrusion and to improve the appearance of these areas. f ~fk~~
