A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, FINDING AND DECLARING
THE EXISTENCE OF A PARKING EMERGENCY AND ALLOWING
THE MIAMI BEACH SENIOR HIGH SCHOOL PARENT TEACHER
ASSOCIATION (MBSH-PTA), A NOT-FOR-PROFIT ENTITY, TO
UTILIZE THE PUBLIC SWALE AREA LOCATED AT DADE
BOULEVARD, ADJACENT TO THE SCHOOL, TO PROVIDE
ADDITIONAL PARKING FROM FEBRUARY 15-19, 2007, FOR THE
MIAMI INTERNATIONAL BOAT SHOW, THROUGH A
FUNDRAISING EVENT; FURTHER PROVIDING THAT THE SWALE
AREA BE UTILIZED EXCLUSIVELY BY THE MBSH-PTA SUBJECT
TO THE CONDITIONS SET FORTH IN THIS RESOLUTION.
WHEREAS, the City has historically experienced parking shortages during
major events such as Winter Music Conference, Art Basel Miami Beach, Memorial
Day Weekend, New Year's Eve, Yacht and Brokerage Show and the Boat Show; and
WHEREAS, during these times, severe parking demand has historically lead
to mobility problems and ultimately gridlock on our City's roadway system; and
WHEREAS, the Administration has found that allowing for the use of
specified vacant surface parking lots for additional parking opportunities during high
impact events, coupled with an enhanced circulator program (Park-and-Ride) service,
has alleviated the mobility problems and gridlock anticipated during these events; and
WHEREAS, the Administration has received a request from the Miami Beach
Senior High School Parent Teachers Association (MBSH-PTA) for permission to utilize
the Dade Boulevard swale, adjacent to the school, for parking for a fund raising event,
and which would also provide additional parking for the Miami International Boat Show,
from February 15-19, 2007; and
WHEREAS, the Administration recommends approval of MBSH-PTA's request
subject to the following conditions:
1. That all profits generated by this fundraising event go exclusively to the MBSH-
PTA for the benefit of Miami Beach Senior High School;
2. That the subject permission is granted without establishing a precedent so as to
satisfy the unique situation created by a severe parking shortage in the City
during the Boat Show;
3. That MBSH-PTA, at its sole cost and expense, shall restore the property to the
same condition as before its use;
4. That MBSH-PTA provide the City with proof of insurance, as determined and
accepted by the City's Risk Manager, prior to commencing its proposed
fund raiser;
5. That MBSH-PTA hire an off-duty police officer to direct traffic for the ingress and
egress on Dade Boulevard;
6. That MBSH- PTA obtain a General Liability Certificate of Insurance naming the
City of Miami Beach, Florida as an additional named insured;
7. That MBSH-PTA must properly install and maintain a secure perimeter for all
landscaping; specifically, the flower beds, irrigation timers, and irrigation heads
must be "flagged". The preferred method of restriction would be rebar and rope.
Alternative methods may be proposed by MBSH-PTA; however, it must be
approved by the City Manager or his designee;
8. That MBSH-PTA will charge $20.00 for the preferred parking spaces or a fixed
flat fee for the duration of the Boat Show, primarily targeted for exhibitor use. The
flat rate parking fee to be assessed to users in the back lot will be consistent with
the City Parking Department's Citywide Boat Show Park and Ride plan;
9. The MBSH-PTA must assure that vehicles are parked properly within the
confines of the swale area. Vehicles (or any portion thereof) obstructing
pedestrian access may be cited and/or impounded; and
10. The MBSH-PTA is not permitted to park vehicles on the swale along Prairie
Avenue.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission herein find and declare the existence of a parking emergency and allow
the Miami Beach Senior High School Parent Teacher Association (MBSH-PTA), a not-
for-profit entity, to utilize the public swale area located at Dade Boulevard, adjacent to
the school, to provide additional parking from February 15-19, 2007, for the Miami
International Boat Show, through a fundraising event; furthe providing that the swale
area be utilized exclusively by the MBSH-PTA subject to t~e con.lgitions set forth in this

Issue:
Should the Miami Beach Senior High School Parent Teachers Association be permitted to park
cars on City property (swale area) fronting the High School's property during the 2007 Miami
International Boat Show?
Item Summary/Recommendation:
The Miami Beach Senior High School Parent Teachers Association (PTA) is requesting
permission to use the Dade Boulevard swale adjacent to the school to park cars during the Miami
International Boat Show, February 15-19, 2007. The PTA will operate with the condition that all
profits generated by this fund raising event will go to Miami Beach Senior. High School. The PT A
will provide off-duty police officers for traffic control. The PT A will also provide a certificate of
insurance or proof of insurance to the City.
While the Miami Beach Senior High School Parent Teachers Association (PTA) requested a $20
parking rate and to use the parking pads at the Par-3 Golf Course for overflow parking, the
Administration is recommending to use the rate the City charges, which is $15 and
recommending against allowing the PTA to use the Par-3 Golf Course.

ANALYSIS
As part of a fundraising effort, the Miami Beach Senior High School Parent Teachers
Association (MBSH-PT A) requested permission to use the Dade Boulevard swale adjacent
to the 'school for parking of vehicles of persons who will be attending the 2007 Miami
International Boat Show, held at the Miami Beach Convention Center from February 15-19,
2007.
The Miami International Boat Show, like certain other Special/Major Events, increases the
demand for parking in the City. The use of this vacant lot for parking for this event would
alleviate this increased parking demand and create less of an inconvenience for those
citizens who live in the area. As you know, this is an annual request from MBSH-PT A. This
year however, MBSH-PTA requested to increase the parking fee from $15 to $20.
Additionally, they requested use of the parking area at the Par-3 Golf Course for overflow
parking.
Rate structure, regulation/policy, and enforcement are integral components to managing
parking in the City. The Administration considered the $20 rate in the context of the citywide
special event flat parking rates and a $20 flat rate is at or above valet parking rates. From a
parking management perspective, self-parking should never have a value higher than valet
parking. As you know, valet parking is the highest level of service and justifies a premium
fee. The area in question is undoubtedly the preferred (self) parking location due to its close
proximity to the event and warrants a premium fee; however, that premium should fall in line
with the established rate structure and is recommended to be at $15 which is at the same
rate as valet parking for this event.
As it regards the Par 3 Golf Course, the Administration recommends against this request. In
addition to setting a precedent, the Bayshore Homeowners Association has expressed
concerns with this in the past; there remain a number of residents who still use the Par 3
regularly who would be displaced as a result of granting this request. Therefore, the
Administration recommends against both of the aforementioned requests.
In addition, and consistent with previous years, the Parents Teachers Association will agree
to the following:
1. That all profits generated by this fund raising event go exclusively to the MBSH-PT A
for the benefit of Miami Beach Senior High School;
2. That the subject permission is granted without establishing a precedent so as to
satisfy the unique situation created by a severe parking shortage in the City during
the Boat Show;
3. That MBSH-PTA, at its sole cost and expense, restore the property to the same
condition as before its use;
4. That MBSH-PTA provides the City with proof of insurance, as determined and
accepted by the City's Risk Manager, prior to commencing its proposed fund raiser;

It is recommended that the Mayor and City Commission adopt this Resolution and permit the
MBSH-PT A to use the specific properties delineated above at the maximum rate of $15 per
vehicle, which would ease the parking problems caused by the Boat Show and will allow the
PT A ~~ave their fund raiser for the school.

Kathy Bass Boat Show revenue allows us to enrich the learning experience for all
Corresponding Secretary Miami Beach Senior High students. Therefore, on behalf of Miami Beach Senior High
Alissa Stein School students, faculty, staff, and PTA, I would personally like to thank the City of
Communications Miami Beach Commission, Parking Department, and you for helping to make our 2006
Michelle Rivera Boat Show parking fundraiser one of our most successful to date.

After expenses, we cleared almost $78,000 which has been spent on the
students and various school-wide programs. The PTA purchased: calculators for Science
and Mathematics, camera equipment for the Journalism classes, and drill team equipment
for the JROTC. We also sent deserving students to compete in the Brain Bowl, allocated
funds for the Rock Ensemble's trip to Los Angeles, CA, and sent students to the annual
Future Business Leaders Association and DECA conventions and competitions. In
addition, funds were spent on supplies and uniforms for many of our athletic teams.
While this is a partial listing, efforts were made to ensure that funding was allocated to all
school programs and subsidized various clubs and athletic programs.
In order to make this year's fundraiser as successful as possible, we are once
again requesting the use of the Dade Boulevard swale adjacent to the school. As in past
years, the swale will be an integral part of our fundraiser and is, once again, in critical
need due to the loss of parking due to the ongoing construction. We would like the
language of the resolution to reflect that this year we will be raising our parking fee from
$15 to $20. After careful consideration, we feel an increase to $20 is in keeping with
parking charges for major events around Miami-Dade County.
It is my understanding that Beach High's principal has been working with the
City of Miami Beach Parking Department to help alleviate parking problems for Art
Basel and the Garden Center. In this spirit of cooperation, I have one additional request.
Is it possible for the City to allow the MBHS PTA to use the parking pads at the Par-3
golf course for overflow parking during the Boat Show?
