2007-26447 Reso RESOLUTION NO. 2007-26447 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE CITY MANAGER'S RECOMMENDATION RELATIVE TO THE RANKING OF CONTRACTORS PURSUANT TO INVITATION TO BID (ITB) NO. 17.Q6/07 FOR MULTI-PURPOSE MUNICIPAL PARKING GARAGE "BID PACKAGE 02 - PILING AND RETAINING WALLS", AND AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE TOP RANKED CONTRACTOR OF EBSARY FOUNDATION COMPANY, INC. (EBSARY); AND UPON CONCLUSION OF SUCCESSFUL NEGOTIATIONS, FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH EBSARY, IN THE ESTIMATED AMOUNT OF $1,711,000; AND SHOULD THE ADMINISTRATION NOT BE ABLE TO SUCCESSFULLY NEGOTIATE AN AGREEMENT WITH EBSARY, AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS WITH THE SECOND RANKED CONTRACTOR OF HJ FOUNDATION; AND FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH HJ FOUNDATION, IN THE ESTIMATED AMOUNT OF $1,592,000. WHEREAS, on September 10th, 2003, the Mayor and City Commission approved Resolution No. 2003-25332, authorizing the execution of a Development Agreement between the City and the New World Symphony (NWS) for the development and construction of an approximately 50,000 square foot educational, performance and internet broadcast facility with an exterior screen ("Soundspace"), and an approximately 320-space (+1-) public parking garage facility (the Agreement); and WHEREAS, in approving the Agreement, the City Commission also directed the Administration to proceed with developing a new Multi-Purpose Municipal Parking Facility (MMPF) on the site of the existing City Hall surface lot; and WHEREAS, on November 22, 2006, the City's Procurement Division issued Invitation to Bid (ITB) No. 17-06/07 for Multipurpose Municipal Parking Facility Bid Package 02- Piling and Retaining Walls, to obtain bids from qualified General Contractors to provide all labor, material, equipment, supervision, mobilization, demobilization, survey, overhead and profit, bonds, insurance, permits and taxes to complete the work to the full intent as shown or indicated inIon the bid documents; and WHEREAS, bid notices to 1,155 prospective bidders where issued, which resulted in the receipt of bids from two contractors: Ebsary Foundation company, Inc., and HJ Foundation; and WHEREAS, on January 5,2007, a Technical Review Panel approved by the City, using the Best Value criteria, unanimously ranked Ebsary Foundation Company, Inc. as Number 1, and HJ Foundation as Number 2; and WHEREAS, the City Manager concurs with the Committee's recommendation. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the City Manager's recommendation relative to the ranking of contractors pursuant to Invitation To Bid (ITB) NO. 17-06/07 for Multi- Purpose Municipal Parking Garage "Bid Package 02 - Piling and Retaining Walls", and authorize the Administration to enter into negotiations with the top ranked contractor of Ebsary; and upon conclusion of successful negotiations, further authorize the Mayor and City Clerk to execute an agreement with Ebsary, in the estimated amount of $1,711,000; and should the Administration not be able to successfully negotiate an agreement with Ebsary, authorize the Administration to enter into negotiations with the second ranked contractor of HJ Foundation (HJ); and further authorize the Mayor and City Clerk to execute an agreement with HJ, in the estimated amount of $1 ,592,000. Following completion of the construction documents by the consultant, on November 22, 2006, the City advertised the Invitation to Bid (ITB) 17-06/07 for "Bid Package 02 - Piling and Retaining Walls" for the Multipurpose Municipal Parking Facility. In response to ITB No. 17-06/07 submission, the top-ranked bid was evaluated by the Technical Review Panel, using the Best Value criteria. ADMINISTRATIVE RECOMMENDATION Adopt the Resolution. PROJECT FUNDING Funding for this task has been previously appropriated in Fiscal Year 2006-2007 Capital Budget, specifically Parking Impact Fees Fund 480. ANALYSIS On September 10, 2003, the Mayor and City Commission approved Resolution No. 2003- 25332, authorizing the execution of a Development Agreement between the City of Miami Beach and the New World Symphony (NWS) for the development of a portion of the surface parking lot, bounded by 17th Street to the North, North Lincoln Lane to the South, Washington Avenue to the East and Pennsylvania Avenue to the West, for construction of an approximately 50,000 square foot educational, performance and intemet broadcast facility with an exterior screen ("Soundspace"), and an approximately 320-space (+/-) public parking garage facility. Commission Memorandum January 17, 2007 MPPF Piling Award Page 2 0'5 In approving the execution of the Agreement, the Commission also directed that the Administration should proceed with developing a new Multi-Purpose Municipal Parking Facility (MMPF) on the site of the existing City Hall surface lot. Throughout the negotiations with the NWS, the Administration has consistently stated that replacement parking must be built before displacement of either of the 17th Street surface parking lots. Consequently, the Municipal Multipurpose Parking Facility must be built and completed, or an alternate acceptable replacement parking location must be identified, prior to the commencement of construction of the NWS project construction. At that time, the estimated schedule called for substantial completion of the MMPF by November 2007, and final completion by February 2008. On April 14, 2004, the Mayor and City Commission approved Resolution No. 2004-25543, authorizing the execution of an agreement with the Architect, in an amount of $1 ,200,788, for the provision of Planning, Architecture, Landscape Architecture, and Engineering Services required to design the Multi-Purpose Municipal Parking Facility project. During the completion of the Contract Documents by the City's Consultant, the City requested additional scope of work by adding an additional floor to the project. To minimize the impact to the project schedule, the City in coordination with the Program Manager, developed a construction phasing plan. This phasing plan would phase the construction of the project in four (4) phases. This effort was coordinated due to the time savings to the project and to minimize the impact to the completed original design. The Construction Fencing & Selective Demolition would be performed by one of the City's JOC Contractor. The other four construction phases will be formally bidded independent from each other. The construction of the facility will be phased as follows: . Construction Fencing & Selective Demolition. . Piling and Retaining Walls. . Underground Utilities and Remaining Demolition. . Structure and Site Improvements. . Tenant Build-Out. The demolition project has been awarded to a JOC contractor with funding previously appropriated in the 2006 Fiscal Capital Budget. This work encompasses the clearing of the site to prepare for the installation of the pilings. At this time the piling phase encompasses the installation of over 500 piling in the area to support the structure and the installation of two retaining walls adjacent to city Hall. The projected schedule for the project is as follows: 1. Construction Fencing & Selective Demolition: Although the construction fence installation will start in mid-December. Demolition activities will include the removal of landscaping, asphalt, and lighting and metering equipment, and is expected to end by March,2007. 2. Piling and Retaining Walls: This phase encompasses construction of sub-surface foundations and it is estimated that this work will take place starting in early March and be completed by the end of May, 2007. 3. Underground Utilities and Remaining Demolition: This phase includes the modification and installation of major underground utility infrastructure, including water, sewer, storm water, electrical and data communication systems on the MMPF site, as well as on 18th Street, Meridian Avenue and Meridian Court. It is estimated that this work will take place starting in April, 2007, and be completed by August, 2007. CommIssion Memorandum January 17, 2007 MPPF Piling Award Page 3 0(5 4. Structure and Site Improvements: This phase includes construction of the main building structure, site improvements such as landscaping and the new plaza area, street resurfacing and sidewalks, etc. It is estimated that this work will take place starting in mid 2007, and be completed by late 2008. Upon achieving substantial completion of the garage portion of the building, employee parking will be available in the new MMPF. 5. Tenant Build-Out: This phase encompasses the construction of the interior offices and associated mechanical, electrical and plumbing systems. It is estimated that this work will take commence in October, 2008 and be completed in early 2009 ITS PROCESS AND CONTRACTOR EVALUATION On November 22, 2006, the City's Procurement Division issued Invitation to Bid (ITB) No. 17-06/07 for Multipurpose Municipal Parking Facility Bid Package 02- Piling and Retaining Walls. The purpose of this ITB is to obtain bids from qualified General Contractors to provide all labor, material, equipment, supervision, mobilization, demobilization, survey, overhead and profit, bonds, insurance, permits and taxes to complete the work to the full intent as shown or indicated inIon the Bid Documents. A non-mandatory Pre-Bid meeting was held on December 8, 2006 at the City of Miami Beach City Hall. Prospective bidders were provided information as to the Scope of Work, the Evaluation Criteria, Best Value Procurement, and of all required documentation to be submitted with their bid. RFP Depot issued bid notices to 1,155 prospective bidders, resulting in 47 bidders requesting the ITB document. Additionally, the bid was also provided to prospective bidders by BidNet, which issued bid notices to 66 prospective bidders, resulting in 18 bidders requesting the ITB document. Both bid notification systems resulted in the receipt of bids from the following Contractors: . Ebsary Foundation company, Inc. . HJ Foundation On December 21, 2006, the Capital Improvement Projects Office (CIP) provided a recommendation of Technical Review Panel members which was approved by the City Manager's Office, consisting of the following individuals: . Fernando Vazquez, City Engineer . Saul Frances, Parking Director . Stephen Baumal, URS, Project Manager . William Cary, Planning Department Assistant Director . Brad Judd, Property Management Director On January 5, 2007, the Technical Review Panel convened, all panel members were present except Brad Judd, Property Management Director, due to illness. The Panel was provided Scope of Work information by Stephen Baumal, URS, Project Manager. The Procurement Division provided past performance evaluation surveys on the two (2) bidders and Ms. Sarah Goodridge, PhD student, of Florida International University provided insight on "Best Value Procurement". The Technical Review Panel also discussed the Evaluation Criteria, which was used to evaluate and rank the Bidders. The Evaluation Criteria was articulated in detail in the Bid Document as well other Addenda issued by the City's Procurement Division. The Evaluation Criteria used by the Technical Review Panel is as follows. Commission Memorandum January 17, 2007 MPPF P///ng Award Page 4 0'5 TECHNICAL REVIEW PANEL EVALUATION/SELECTION PROCESS The Evaluation process used by the City for this bid is one of "Best Value Procuremenf', meaning that the City will, in addition to price, will consider past performance on previous contracts, Risk Assessment for this ITB, Qualifications of Personnel proposed, and interview of Contractor's personnel. The Technical Review Panel utilized a three-phase evaluation and ranking process. The first phase consisted of the Risk Assessment Plan and the Past Performance. The second phase consisted of the interview of the bidders, and the third Phase was the ranking of the bid prices submitted. The following Criteria and respective points were used by the Technical Review Panel in the Ranking of both bidders: Phase 1: Risk Assessment Plan. (25 points) Past Performance based on number and quality of the Performance Surveys. (25 Points) Phase 2: Interview of Key Personnel. (25 Points) Phase 3: Bid Price. (25 Points) 100 Points Total Upon completion of scoring all three Phases, the Procurement Representative tabulated all scores for all three Phases and provided the results to the Technical Review Panel. CONCLUSION: The Administration recommends approval of the attached Resolution accepting the City Manager's recommendation of the Ranking of Bids received pursuant to Invitation to Bid (ITB) No. 17-06/07 for Multi-Purpose Municipal Parking Garage "Bid Package 02 - Piling and Retaining Walls; and authorizing the Administration to enter into negotiations with the top ranked Contractor of Ebsary Foundation Company, Inc.; and upon conclusion of successful negotiations, further authorizing the Mayor and City Clerk to execute an agreement with Ebsary Foundation Company, Inc., in the estimated amount of $1,711 ,000; and should the Administration not be able to successfully negotiate with Ebsary Foundation Company, Inc., authorizing the Administration to enter into negotiations with the second ranked Contractor of HJ Foundation; and, respectively, authorizing the Mayor and City Clerk to execute an Agreement with HJ Foundation, in the estimated amount of $1,592,000, upon conclusion of successful negotiations; and further authorizing the Administration to reject all bids in the event that successful negotiations are not reached with neither the top nor the second ranked contractor and authorize reassurance if the invitation to bid.
