ORDINANCE NO. 2007-3547
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
THE LAND DEVELOPMENT REGULATIONS OF THE CODE
OF THE CITY OF MIAMI BEACH, BY AMENDING CHAPTER
142, "ZONING DISTRICTS AND REGULATIONS", ARTICLE
IV, "SUPPLEMENTARY DISTRICT REGULATIONS ",
SECTION 142-875 "ROOF REPLACEMENTS" TO MODIFY
AND EXPAND THE REQUIREMENTS FOR ROOFING
MATERIALS IN ALL DISTRICTS; PROVIDING FOR
REPEALER, CODIFICATION, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City of Miami Beach continually seeks to update and clearly define
the requirements of the Land Development Regulations of the Code of the City of Miami
Beach as they pertain to zoning districts and regulation; and
WHEREAS, the City of Miami Beach recognizes the benefits of alternative roofing
materials in terms of maintenance, durability, sustainability, energy efficiency and
availability; and,
WHEREAS, the City of Miami Beach has adopted regulations pertaining to
replacement and construction of pitched roofs; and,
WHEREAS, the City of Miami Beach desires to expand, modify and clarify the
requirements for new and replacement roofing material for pitched roof; and,
WHEREAS, the amendments set forth below are necessary to accomplish all of the
above objectives.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA.
SECTION 1. That Chapter 142, Entitled "Zoning Districts and Regulations", Article IV,
Entitled "Supplementary District Regulations ", Division 1, Entitled "Generally" of the Land
Development Regulations of the Code of the City of Miami Beach, Florida is hereby
amended as follows:
Sec. 142-875. Roof replacements and new roofs.
(a) In all districts. except locally desionated historic districts. sites or structures. the new
construction. repair or replacement of any pitched roof shall consist of flat or barrel
tile. which shall be composed of concrete. clay or ceramic material. Metal roofinq
systems may be proposed for new construction. existino multi-family and townhome
structures. existino commercial buildinos. sinole family homes constructed after
1942. and non-architecturally sionificant sino Ie family homes constructed prior to
1942. and shall be subiect to the review and approval of the Plan nino Department.
in accordance with the followinQ criteria:
ill The same style. desion and material shall be required for the main
structure and all accessory structures when located on the same
property.
ill The color of the roof shall be neutral and shall not overwhelm or cause
the roof to stand out in a sionificant manner.
.@) The desion. details. dimensions. surface texture and color shall be
consistent with the architectural desion. style and composition of the
structure.
ffi The desion, details. dimensions. surface texture and color shall be
consistent with the established scale, context and character of the
surroundino area.
The appeal of any decision of the PlanninQ Department under this section shall be
to the Desion Review Board. in accordance with Chapter 118. Article VI of these
Land Development Reoulations.
(b) Within any locally desionated historic district. site or structure. the new construction.
repair or replacement of any pitched roof shall consist of flat or barrel tile. which
shall be composed of concrete. clay or ceramic material. The use of metal roofino
systems on new construction or existino non-contributino structures shall require the
review and approval of the Historic Preservation Board. in accordance with Chapter
118. Article X of these Land Development Reoulations. Metal roofinQ systems shall
not be permitted on contributino buildinQs.
(c) NotwithstandinQ the above. for those structures constructed and substantially
maintained in the Mediterranean Revival or Mission style of architecture. only
concrete. clay or ceramic tile may be utilized. For purposes of this subsection.
Mediterranean Revival or Mission architecture shall be defined as those structures
built between 1915 throuQh 1942 and characterized by. but not limited to. stucco
walls. low pitch terra cotta or historic Cuban tile roofs. arches. scrolled ortile capped
parapet walls and articulated door surrounds. or Spanish baroque decorative motifs
and classical elements.
(d) Notwithstandino the above. in the event a material other than flat or barrel tile was
permitted for a pitched roof in any district. such roof may be replaced with the same
material. subiect to the criteria in subsection (a) above.
(e) For those structures which contain historic Cuban barrel tiles, such tiles shall be
retained and preserved, subject to the provisions of the applicable building codes.
(f) No variances from any of these provisions shall be oranted. However. in the event
that the Buildino Official determines that limitations exist reQardino the load capacity
of an existinQ roof. a roofino material other than concrete. clay or ceramic tile may
be approved by the Plannino Department for any type of structure. in accordance
with the criteria specified in Section 142-875(a)(1-4) above.
In 311 districts, the repair or replacement of a barrel tile or cement tile roof sh31l be of like
material. Nev.' construction of pitched roofs sh31l only be comprised of b3rrol tile or cement

tile. For neVi construction of multi family, tm...nhome and commercbl structures, appropriate
roof finishes other than b3rrel tile or cement tile m3Y be approved by the design review or
historic preservation b03rd, as applicable.
SECTION 2. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and
it is hereby ordained that the provisions of this ordinance shall become and be made part
of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be
renumbered or relettered to accomplish such intention, and the word "ordinance" may be
changed to "section", "article", or other appropriate word.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are
hereby repealed.
SECTION 4. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.

Item Summary/Recommendation:
Currently, the City Code only permits flat or barrel tile as a roof material on single family homes. For multi-
family and commercial buildings, material other than flat or barrel tile is subject to the review and approval
of the Design Review or Historic Preservation Boards, as applicable.
The proposed Ordinance creates allowances for the use of metal roofing systems on certain types of
single family homes, and establishes criteria for the administrative review of metal roofs on commercial
and multi-family structures.
On January 17, 2007 the subject Ordinance was approved by the Commission on First Reading.
The Administration recommends that the Commission adoot the ordinance.
Adviso Board Recommendation:
At the August 22,2006 and November 28,2006 meetings, the Planning Board recommended that the
City Commission approve the ordinance.
On September 5, 2006 the Design Review Board reviewed the proposed Ordinance and
recommended approval.
On September 12, 2006 the Historic Preservation Board reviewed the proposed Ordinance and
recommended approval.
On October 9,2006 the Land Use and Development Committee reviewed the proposed Ordiance and
recommended a roval.

ADMINISTRATION RECOMMENDATION
Adopt the Ordinance.
BACKGROUND
Recently a number of variance applications have been submitted to the Board of Adjustment
for the utilization of standing seam metal roofs on single family homes. Currently the Code
only permits roofing materials other than flat or barrel tile on multi-family and commercial
structures, at the discretion of the Design Review or Historic Preservation Boards.
At the direction of the Board of Adjustment, staff has prepared an amendment to the roofing
materials section of the City Code, in order to expand the types of material that can be used
on pitched roofs, City wide. This proposed amendment also responds to the availability and
practicality of standard roof materials such as concrete and ceramic tile.
ANAL YSIS
The number of different roofing materials has expanded significantly over the years in terms
offinishes, color, design, type and dimensions. Specifically, a wide range of metal roofs now
exist, which satisfy building code requirements and are compatible with most styles of
architecture in the City. These include metal tile in a flat or barrel shape, as well as different
textures, colors and finishes of standing seam metal.
In addition to being much more architecturally compatible than in the past, alternative roofing
material such as metal tile and standing seam metal offer the following tangible benefits over
concrete or ceramic tile:

1. They are far more durable; not just to wind speed, but, more importantly, in
terms of damage from flying debris.
2. They are far more energy efficient, particularly in the summer months.
3. They have a longer warranty that concrete or barrel tile.
4. They are generally the same price as concrete tile and less expensive than
clay or ceramic barrel tile.
5. They are readily available.
After the 2005 hurricane season a number of single and multi family property owners
suffered roof damage from one degree to another. Because of the lack of availability of flat
or barrel tile, single family home owners were forced to apply for variances for roofing
materials such as standing seam metal or shingles. The Board process added months to
the permitting process. It is very likely that the cycle of hurricanes we have experienced
since 2004 will continue for the next few decades.
The proposed ordinance amendment strikes a careful balance between protecting the
architectural and historic integrity of the City's housing stock, while allowing for more
durable, sustainable and available roofing material.
The subject Ordinance went before the Planning Board on August 22, 2006 and was
transmitted to the City Commission with a favorable recommendation, and subject to minor
amendments. On September 5, 2006, the Design Review Board evaluated the proposed
Ordinance and recommended approval. The Historic Preservation Board reviewed the
Ordinance on September 12, 2006 and also recommended approval.
On September 11 , 2006 the Land Use and Development Committee reviewed the proposed
Ordinance, and instructed the Administration to study the issue further and bring back the
ordinance for further discussion. On October 9, 2006 the Land Use and Development
Committee recommended approval of the Ordinance, subject to certain modifications; the
following is a summary of those modifications:
1. Metal roofing systems may be proposed for new construction, existing multi-family
and townhome structures, existing commercial buildings and single family homes
constructed after 1942, and non-architecturally significant single family homes
constructed prior to 1942.
2. Specific Criteria is established for the Planning Department to follow when evaluating
metal roof requests.
3. The use of metal roofing systems on new construction or existing non-contributing
structures in historic districts requires the review and approval of the Historic
Preservation Board. Metal roofing systems shall not be permitted on contributing
buildings.
4. Metal Roofing Systems shall not be permitted on those structures constructed and
substantially maintained in the Mediterranean Revival or Mission style of
architecture.
5. A 'No variance' provision was incorporated.
On November 28, 2006, the Planning Board reviewed the amended Ordinance and

transmitted it to the City Commission with a favorable recommendation. The Planning Board
also recommended that a provision be added to the subject Ordinance to address structural
problems associated with existing roofs. Specifically, in the event that the Building Official
determines that limitations exist regarding the load capacity of an existing roof, a roofing
material other than concrete, clay or ceramic tile may be approved by Planning Department
for any type of structure, in accordance with the criteria specified in Section 142-875(a)(1-4)
of the code.
On January 17, 2007 the subject Ordinance was approved by the Commission on First
Reading.
FISCAL IMPACT
The proposed Ordinance is not expected to have any fiscal impact.
CONCLUSION
The Administration recommends that the City Commission adopt the proposed Ordinance.
Pursuant to Section 118-164(4) of the City Code, an affirmative vote of five-sevenths shall
be necessary in order to enact any amendments to the Land Development Regulations.
