A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA
APPROPRIATING $302,500 FROM THE STORM WATER
FUND INTO THE LINCOLN ROAD PROJECT WORK
ORDER NO. 368.2115 AND APPROVING AN INCREASE TO
THE CONTRACT WITH S. I. NICHOLAS, INC., IN THE
AMOUNT OF $712,557, TO PERFORM ADDITIONAL WORK
FOR THE LINCOLN ROAD IMPROVEMENTS PROJECT;
FURTHER AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A FIRST AMENDMENT TO THE
AGREEMENT BETWEEN THE CITY AND S. 1. NICHOLAS,
INC.
WHEREAS, on July 12. 1995, the Mayor and City Commission approved an Agreement
with S. 1. Nicholas, Inc. (Agreement) as the successful bidder pursuant to Bid No. 79.94/95, entitled
"Proposed Roadway Landscape, Watennain Extension and Sewer Line Construction/Rehabilitation
within the Lincoln Road Mall Improvement District" (Project); and
WHEREAS, the Lincoln Road Partnership Design Committee, at its meeting of Augus( 19,
1996, requested that the 200 and 300 blocks of Lincoln Road and James/Washington A venue North
of Lincoln Road be re-designed; and
WHEREAS, the cost for this additional work is $135,057, with funding available within the
additional enhancement funding that was approved on June 5, 1996; and
WHEREAS, the Mayor and City Commission, at its meeting of July 12, 1995, appropriated
and set aside $250,000 for the new tourist information booth that will be constructed in the 400 block
just west of\1.Jashington Avenue, and $25,000 was appropriated for the booth on June 5, 1996 as part
of the additional enhancement funding; and
WHEREAS, the Project did not address and or correct the existing drainage and flooding
problems that occur on Washington Avenue between 16th Street and Lincoln Road; and
WHEREAS, it is recommended that funding in the amount of $302,500 for additional
drainage structures, piping, regrading, asphalting, permitting, design, testing and construction
administration be appropriated from the storm water fund into the Lincoln Road Project Work Order
No. 368.2115 to correct this problem; and
WHEREAS, the Administration has negotiated the attached First Amendment to the
Agreement and herein recommends that the Mayor and City Commission approve same.

NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission approve the appropriation of$302,500 ti-om the st01111 water fund into the Lincoln Road
Project Work Order No. 368.2115 and approve an increase to the Agreement with S. I. Nicholas, Inc.
in the amount of $712,557, to perform this additional work and accordingly, the Mayor and City
Clerk arc herein authorized to execute the attached First Amen nt to the Agreem nl.

ADMINISTRATION RECOMMENDATION:
To approve the Resolution.
BACKGROUND
The Lincoln Road Partnership Design Committee at its meeting of August 19, 1996, requested that
the 200 and 300 blocks of Lincoln Road and James/W ashington Avenue North of Lincoln Road be
redesigned. The Architects and Engineers have completed the revised design work. The cost of this
additional work is $135,057 including design, surveying, testing and construction administration.
Funding for this work is available within the additional enhancement funding that was appropriated
and approved by the Commission on June 5, 1996. We have attached the synopsis of the additional
funding that details what was authorized and illustrates the $135,057 yet to be committed, from
the approved funding, that can be utilized for the 200 & 300 blocks and JameslWashington Avenue
redesign. It is recommended that the contractor be given authorization to proceed with this work.
ANALYSIS
The City Commission, at its meeting of July 12, 1995, when they approved the Lincoln Road
project, appropriated and set aside $250,000 for the new tourist information booth that will be
constructed in the 400 block just west of Washington Avenue. Additionally, $25,000 was
appropriated for the booth on Jooe 5, 1996, as part of the additional enhancement funding. It is now
recommended that the contract with S. I. Nicholas be increased by $275,000 so that the information
booth can be constructed in accordance with approved plans.

Also, the original project did not address and or correct the existing drainage and flooding problems

is recommended that funding in the amount of $302,500 for additional drainage structures, piping,
regrading, asphalting, permitting, design, testing and construction administration be appropriated
from the storm water fund into the Lincoln Road Project Work Order No. 368.2115 to correct this
problem. The City's contractor, S. I. Nicholas, will perform this work in accordance with the
contract unit prices.
Of the $712,557 outlined in this memo, only the $302,500 for the additional storm water work is
new funding. All other funding has already been appropriated and earmarked for the Lincoln Road
Project and needs to be authorized, and in the case of the enhancements, be re-allocated as
recommended above.
A meeting of the Partnership Design Committee on November 27th was held to discuss the specific
reallocation of the enhancement funding.
CONCLUSION
The Administration recommends that the City Commission approve the Resolution appropriating
$302,500 from the storm water fund into the Lincoln Road Project Work Order No. 368.2115 and
approving an increase to the contract with S. L Nicholas in the amount of $712,557 to perform the
additional work.

This First Amendment is made and entered in(o on the day of . 1996 by and
between the CITY OF MIAMI BEACH, a municipal corporation existing under the laws of the
State of Florida (hereinafter referred to as "City" or "Owner"). having its principal oftices at 1700
Convention Center Drive, Miami Beach, Florida 33139. and S. I. NICHOLAS, INC., a Florida
corporation, whose address is 1600 South Federal Highway. Suite 811, Pompano Beach. Florida
33062 (hereinatier referred to as "Contractor").
WITNESSETH:

good valuable consideration, the receipt of which is hereby acknowledged, the parties hereby agree
as follows:
I. The Agreement shall be amended to include the rev'ised Scope of Sen'ices. attached
hereto as Exhibit "A".
2. The parties hereby ratify and confirm all other term and conditions of the Agreement
which remain unchanged.
