98-22635 RESO Incomplete RESOLUTION NO.-21~ 2/Lb 35 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, FINDING AND DECLARING THE EXISTENCE OF AN EMERGENCY AND ALLOWING THE POLICE ATHLETIC LEAGUE (PAL) TO UTILIZE THE PRIVATE VACANT LOT LOCATED AT DADE BOULEVARD AND MERIDIAN AVENUE FOR A FUND RAISING EVENT TO PROVIDE ADDITIONAL PARKING FOR THE DURATION OF THE BOAT SHOW, CURRENTLY SCHEDULED FROM FEBRUARY 12 - 18, 1998; FURTHER PROVIDED THAT THE LOT BE UTILIZED EXCLUSIVELY BY PAL SUBJECT TO THE FOLLOWING CONDITIONS: (1) THAT INGRESS AND EGRESS TO THE LOT BE PROVIDED EXCLUSIVELY FROM PRAIRIE AND NOT MERIDIAN AVENUE; (2) THAT 100% OF THE PROFITS GENERATED FROM THIS FUND RAISER BE GENERATED BACK EXCLUSIVELY TO PAL; (3) THAT PAL AND THE CITY JOINTLY MONITOR THE USE OF THE LOT SO THE SURROUNDING RESIDENTIAL NEIGHBORHOOD IS NOT DISTURBED; (4) THAT THE SUBJECT PERMISSION IS GRANTED ON A ONE TIME ONLY EMERGENCY BASIS, IN LIEU OF THE CURRENT PARKING CRISIS IN THE CITY OF MIAMI BEACH AND (5) IN ORDER TO ACCOMMODATE THE UNIQUE EMERGENCY CREATED BY THE INCREASED PARKING DEMANDS OF PATRONS ATTENDING THE BOAT SHOW, THE SUBJECT PERMISSION IS GRANTED WITHOUT ESTABLISHING PRECEDENT SO AS TO SATISFY THIS UNIQUE EMERGENCY SITUATION. WHEREAS, the Administration received a request from the Miami Beach Police Athletic League (PAL) for permission to utilize the private vacant lot located at Dade Boulevard and Meridian A venue (the Lot) for a fund raising event to provide additional parking for the Boat Show, scheduled in the City of Miami Beach from February 12.18,1998; and WHEREAS, this request was forwarded to the Land Use and Development Committee and considered by the Committee at its January 6, 1998 meeting; and WHEREAS, the Committee voted to approve the PAL's request subject to the following conditions: (I) That ingress and egress to the Lot be maintained exclusively on Prairie Avenue and not Meridian Avenue; (2) That all profits generated by this fund raising event go exclusively to PAL; (3) That the Administration and PAL work jointly in preserving the residential character of the surrounding neighborhood, and that disturbance to these residential areas be maintained at a minimum; (4) That this request is specifically granted on a one time only basis, the Committee having found that an emergency exists due to the increasing parking crisis within the City of Miami Beach, and the aggravation of this situation, particularly during special events such as the Boat Show; and (5) In order to accommodate the unique emergency created by the increased parking demands of patrons attending the Boat Show, the subject permission is granted without establishing precedent so as to satisfy this unique emergency situation; and WHEREAS, the Committee further directed the Administration to proceed with the development of an ordinance which would allow special event parking under a specific set of criteria for the duration of a particular special event; and WHEREAS, the Administration would herein recommend that the Mayor and City Commission adopt the findings of the Land Use and Development Committee, finding that an emergency exists with regard to the scarcity of parking during special events such as the Boat Show and the need for increased parking during the duration of these events, and therefore approve the PAL's request, subject to the aforestated conditions, on a one time only emergency basis. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein adopts the findings and recommendations of the Land Use and Development Committee and herein finds and declares the existence of an emergency, and allows the Police Athletic League (PAL) to utilize the private vacant lot located at Dade Boulevard and Meridian Avenue (the Lot) for a fund raising event to provide additional parking for the duration of the Boat Show, currently scheduled from February 12 - 18, 1998; provided that the Lot be utilized exclusively by PAL subject to the following conditions: (I) that ingress and egress to the Lot be provided exclusively from Prairie and not Meridian Avenue; (2) that 100% ofthe profits generated from this fund raiser be generated back exclusively to PAL; (3) that PAL and the City jointly monitor the use of the Lot so the surrounding residential neighborhood is not disturbed; (4) that the subject permission is granted on a one time only emergency basis, in lieu of the current parking crisis in the City of Miami Beach; and (5) in order to accommodate the unique emergency created by the increased parking demands of patrons attending the Boat Show, the subject permission is granted without establishing precedent so as to satisfy this unique emergency situation.
