98-22807 RESO RESOLUTION NO. 98-22807 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING A PUBLIC HEARING TO CONSIDER A LEASE AGREEMENT BETWEEN THE CITY AND SPRINT SPECTRUM L.P., FOR THE PLACEMENT OF ANTENNAE ON THE RADIO TOWER OF FIRE STATION NO.2 AND ELECTRONIC EQUIPMENT ON THE ROOF OF THE BUILDING ADJACENT TO SAID RADIO TOWER, ALL LOCATED IN AND AROUND 2300 PINE TREE DRIVE, MIAMI BEACH, FLORIDA. WHEREAS, Sprint Spectrum L.P. is interested in entering into a non-exclusive Lease Agreement with the City to lease an area on the roof and radio tower of Fire Station 2, located at 2300 Pine Tree Drive, for the placement of antennae and telecommunications equipment; and WHEREAS, on June 12, 1998, the City issued Invitation to Bid No. 75-97/98, to solicit bids for long-term leases of City owned property for the purpose of installing telecommunications equipment and antennae; and WHEREAS, executing the proposed lease agreement between Sprint Spectrum L.P. and the City would not preclude making similar lease agreements with other interested parties because it would be feasible to have multiple telecommunications installations of this type at the same site; and WHEREAS, Ordinance No. 92-2783, governing the sale and lease of City-owned property, requires the City Commission to hold a public hearing, advertised not less than 15 days prior to the hearing, to obtain citizen input as to the proposed lease. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a public hearing to obtain citizen input regarding a Lease Agreement between the City and Sprint Spectrum L.P., for the placement of antennae on the radio tower of Fire Station No.2 and electronic equipment on the roof of the building adjacent to said radio tower, located in and around 2300 Pine Tree Drive, Miami Beach, Florida, is hereby called to be held before the Mayor and City Commission in their chambers on the third floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on July 15, 1998, beginning at 10:30 a.m., and the City Clerk is hereby authorized and directed to publish appropriate Public Notice ofthe said Public Hearing in a newspaper of Miami Beach, at which time and place all interested parties will be heard. FROM: SUBJECT: ~. ADMINISTRA TION RECOMMENDATION Adopt the Resolution. BACKGROUND Sprint Spectrum L.P. is interested in entering into a non-exclusive agreement with the City of Miami Beach to lease an area on the roof and radio tower of Fire Station 2, located at 2300 Pine Tree Drive, for the placement of antennae and telecommunications equipment. Sprint Spectrum L.P. commissioned a structural analysis and evaluation of the tower, completed by G.M. Selby & Associates, Inc. in December 1997. The study concluded that with some minor upgrades to the tower at 30 ft, 50 ft, and 67 ft, the tower could hold the proposed antennae and cabling. Sprint Spectrum L.P. has agreed to pay for the upgrades prior to installing their equipment. Sprint Spectrum L.P. has proposed the following terms: · An initial five year term with four renewable terms of five years each, · $18,000 annually to be paid to the City of Miami Beach, · 15% increase per term, · leased area to be approximately 4' x 7', located on the roof of Fire Station 2, at 2300 Pine Tree Drive, · Antennae to be located at approximately 70 ft on the existing tower. AGENDA ITEM~ DATE f-\-'1~ ANALYSIS On June 12, 1998, The City of Miami Beach issued Invitation to Bid No. 75-97/98, to solicit bids for long-tenn leases of City owned property for the purpose of installing telecommunications equipment and antennae. The opening date for the bid is June 30, 1998. Executing the proposed lease agreement between Sprint Spectrum L.P. and the City, would not preclude making similar lease agreements with other interested parties. It is feasible to have multiple telecommunications installations of this type at the same site. Ordinance No. 92-2783 (Shapiro Ordinance) states in Section 2 that prior to sale or lease of City property, the City Commission must have a public hearing, advertised not less than 15 days prior to the hearing, to obtain citizen input. CONCLUSION ~. The City Commission should set a public hearing to consider public comment regarding a Lease Agreement between the City and Sprint Spectrum L.P., for the placement of antennae on the radio tower of Fire Station NO.2 and electronic equipment on the roof of the building adjacent to said radio tower located in and around 2300 Pine Tree Drive, Miami Beach, Florida. ~&"X .
