363-2000 RDA RESOLUTION NO. 363-2000 A RESOLUTION OF THE CHAIRMAN AND MEMBERS OF THE MlAMIBEACHREDEVELOPMENT AGENCY AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO SIGN ALL CONTRACfS, AGREEMENTS, PURCHASE ORDERS, CHANGE ORDERS AND GRANT APPLICATIONS THAT MAY AFFECT THE HEALTH, SAFETY, OR WELFARE OF THE CITY; RENEW EXISTING CONTRACfS WHICH MAY EXPIRE; TERMINATE EXISTING CONTRACfS AS NEEDED; AND TOLL ALL ACTS RELATIVE TO ADMINISTRATIVE APPEALS PROVIDED FOR IN SUBPART B, . LAND DEVELOPMENT REGULATIONS OF THE CODE OF THE CITY OF MIAMI BEACH, FROM THE LAST COMMISSION MEETING IN JULY 2000, UNTIL THE FIRST COMMISSION MEETING IN SEYfEMBER 2000, SUBJECT TO RATIFICATION BY THE REDEVELOPMENT AGENCY AT ITS FIRST MEETING IN SEPTEMBER 2000. WHEREAS, the Chairman and Members of the Miami Beach Redevelopment Agency (RDA) are not scheduled to meet between the last meeting in July 2000 and the first meeting in September 2000; and WHEREAS, the RDA has historically, during such periods in past years, assigned certain powers to the City Manager or his Designee, to sign all contracts, agreements, purchase orders, change orders, and grant applications that may affect the health, safety or welfare of the City, subject to ratification by the RDA; and WHEREAS, there may be existing contracts which may expire and require renewal, or may need to be terminated by the RDA between the last RDA meeting in July 2000 and the first meeting in September 2000 which should receive RDA approval for renewal for an appropriate period of time; and WHEREAS, any administrative appeals to the City, as provided in Subpart B, Land Development Regulations of the Code of the City of Miami Beach, would be unable to be held between the last meeting in July 2000, and the first meeting in September 2000 and, therefore, the time for the RDA to perform any required acts relative to such administrative appeals should be tolled during said period; and WHEREAS, the City Manager will report back to the RDA, at the first meeting in September 2000, seeking ratification of any actions relating to the aforestated authorizations, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CHAIRMAN AND MEMBERS OF THE MIAMI BEACH REDEVELOPMENT AGENCY, that the City Manager, or his Designee, is hereby authorized to sign all contracts, agreements, purchase orders, change orders, and grant applications that may affect the health, safety, or welfare of the City, to renew any existing contracts for an appropriate period of time, and terminate existing contracts as needed, and to toll all City Commission required acts relative to administrative appeals provided for in Subpart B, Land Development Regulations of the Code of the City of Miami Beach, from the last Commission meeting in July 2000 until the first RDA meeting in September 2000, subject to ratification by the RDA at its first meeting in September 2000, PASSED and ADOPTED this 26thday of July, 2000. ~I! ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND Between the last meeting in July 2000, and the first meeting in September 2000, the Redevelopment Agency (RDA) will not be in session, During this period oftime there may be contracts in excess of the $10,000 limitation which may need to be awarded or terminated, The RDA has historically, during such periods, assigned certain powers to the City Manager subject to ratification by the RDA. Additionally, administrative appeals to the City, as provided in Subpart B, Land Development Regulations of the Code of the City of Miami Beach, would be unable to be held between the last meeting in July 2000, and the first meeting in September 2000, Therefore, any required acts relative thereto should be tolled during said period, Agenda Item '3 F" Date r- 2"'-00 S()UTti 1)()I/IlffI: l2edevel()pment [)Istrict August Recess - RDA Commission Memorandum July 26, 2000 Page 2 It is therefore requested that the City Manager, or his Designee, be authorized to sign all contracts, agreements, purchase orders, change orders, and grant applications that may affect the health, safety, or welfare of the City; renew any existing contracts, for an appropriate period of time; terminate existing contracts, as needed and toll all acts relative to administrative appeals provided for in Subpart B, Land Development Regulations ofthe Code of the City of Miami Beach, from the last RDA meeting in July 2000, until the first RDA meeting in September 2000, subject to ratification by the Redevelopment Agency at its first meeting in September 2000. Since this authorization is necessary to ensure that essential services and projects continue during the period between the last RDA meeting in July 2000, until the first RDA meeting in September 2000, it is recommended that the Chainnan and Members of the Miami Beach Redevelopment Agency adopt this Resolution.
