2007-26477 Reso RESOLUTION NO. 2007-26477 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO.1 TO THE AGREEMENT BETWEEN THE CITY AND CHEN AND ASSOCIATES, INC., DATED MAY 18, 2005, IN AN AMOUNT NOT TO EXCEED $73,256, FURTHER, APPROPRIATING FUNDING IN THE SAME AMOUNT, FROM THE SOUTH POINTE CAPITAL FUND 389, FOR THE PROVISION OF ADDITIONAL DESIGN SERVICES FOR THE IMPLEMENTATION OF BIKE LANES ON ALTON ROAD, SOUTH POINTE DRIVE, AND OCEAN DRIVE; WITHIN THE SOUTH POINTE PHASE III, IV AND V RIGHT OF WAY NEIGHBORHOOD IMPROVEMENT PROJECT. WHEREAS, on May 18, 2005, the Mayor and City Commission authorized the execution of an Agreement with Chen and Associates, Inc. (Consultant), in a not-to-exceed amount of $2,017,009, to provide urban design, architecture, landscape architecture, engineering and construction administration services for the South Pointe Phase III, IV, and V, Right-of-Way (ROW) Neighborhood Improvement Project (the Project); and WHEREAS, the Project includes improvements to the stormwater system, water system, roadways, streetscape, landscaping, traffic calming, pedestrian lighting, and linkages within the public right-of-ways; and WHEREAS, the Project limits are bounded by Ocean Drive to the East, Alton Road to the West, South Pointe Drive to the South and 5th Street to the North; and WHEREAS, several streets within these boundaries were previously completed as part of the South Pointe Phase II Right-of-Way (ROW) Neighborhood Improvement Project; and WHEREAS, on August 23, 2005, the City issued the Notice to Proceed (NTP) for the planning phase of the work; and WHEREAS, as a result of numerous coordination meetings with City staff and residents, the Basis of Design Report (BODR) was developed; and WHEREAS, the BODR was presented as an informational item to the General Obligation (GO) Bond Oversight Committee on April 3, 2006, and to the Historic Preservation Board (HPB) on April 10, 2006; and WHEREAS, on April 11, 2006, the City Commission approved the BODR, and officially concluded the Planning Phase of the Project; and WHEREAS, in December 2006, during the Project design process, the Public Works Department requested the implementation of bike lanes in accordance with the Bike Master Plan that was being developed; and WHEREAS, the Consultant was directed to provide options for the implementation of bike lanes along Alton Road, South Pointe Drive, and Collins Avenue, in accordance with the Bike Master Plan; and WHEREAS, on January 10, 2007, a meeting was held with various City departments to review the options prepared by the Consultant, and to make recommendations for the inclusion of bike lanes in the Project; and WHEREAS, the option selected for Alton Road, from 5th Street to South Pointe Drive, increases the overall width of the existing median, provides two (2) bike lanes, increases the landscape/swale area, and provides for equal sidewalks on both sides of the street; and WHEREAS, the options explored for Collins Avenue were not viable options, and it was decided that the bike lanes would be moved to Ocean Drive; and WHEREAS, although not originally included in the Bike Master Plan, Ocean Drive from South Pointe Drive to 5th Street, is part of the Project limits; and WHEREAS, Ocean Drive was evaluated and accepted by the Public Works Department, as a viable and preferred option for the bike lanes, in lieu of Collins Avenue; and WHEREAS, the option to eliminate parking on the North side of South Pointe Drive to accommodate bike lanes was selected; and WHEREAS, it will be necessary to approve Amendment Number 1 (Attachment A) to the original Agreement between the City and Consultant, to provide additional design services for these improvements, not originally included in the South Pointe Phase III, IV and V Right of Way Neighborhood Improvements Project; and WHEREAS, the overall ft~e being requested by the Consultant for the design of the bike ianes on Alton Road, South Pointe Drive, and Ocean Drive is $ 73,256, the Program Manager, Hazen and Sawyer, and the City's CIP Office, have evaluated the Consultant's additionAl services fee proposal and find it to be fair and reasonable; and , WHEREAS, the attached Amendment No.1 increases the total Agreement fee by $73,256, for a total fee of $2,090,265; and WHEREAS, the City Administration recommends approval of the attached Amendment No.1 to the Agreement, in an amount not-to-exceed $73,256, for the for the additional scope of work required to implement bike lanes within the limits of the South Pointe Phase III, IV and V Right-of- Way Neighborhood Improvement Project. NOW, THEREFORE, BE IT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHECITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the Mayor and City Clerk to execute Amendment No.1, to the Agreement between the City and Chen and Associates, Inc., dated May 18, 2005, in an amount not-to-exceed $73,256, further, appropriating funding in the same amount, from the South Pointe Capital Fund 389, for the provision of additional design services for the implementation of bike lane on Alton Road, South Pointe Drive, and Ocean Drive; within the South Pointe Phase III, IV and V Right of Way Neighborhood Improvement Project. Item Summary/Recommendation: On April 11 , 2006, the City Commission approved and officially adopted the Project BODR, accepted the design concept contained therein, and officially concluded the Planning Phase of the Project. In December 2006, during the project design process, City staff requested the implementation of bike lanes in accordance with the "Bike Master Plan" (the Plan) being developed. Chen was directed to provide options for the implementation of bike lanes on Alton Road, South Pointe Drive, and Collins Avenue, in accordance with the Plan. On January 10, 2007, a meeting was held with various City staff to review the options, and to make recommendations for the bike lanes. A summary of the preferred options and Chen & Associates (Consultant) additional scope of work is as follows: Alton Road Option for Alton Road from 2nd Street to South Pointe Drive, increases the width of the existing median, provides two (2) bike lanes, increases the landscape/swale area, and provides for equal width of sidewalks on both sides of the street. This treatment will be continued North along Alton Road to 5th Street in lieu of Michigan Avenue. Ocean Drive Although not originally included in the Plan, Ocean Drive from South Pointe Drive to 5th Street is part of the Project limits. As such, Ocean Drive was evaluated and accepted by various departments, as a viable and preferred option for the bike lanes in lieu of Collins Avenue. South Pointe Drive Option 1 a, eliminates parking on the North side of the street. Option 2, eliminates the landscaped median. Option 3, reduces the travel lanes from two (2) 11foot lanes East and West bound, to one (1) 11foot lane in each direction. The decision was made to pursue Option 1a. ANAL YSIS On May 18, 2005, the City Commission authorized the execution of an Agreement between the City of Miami Beach and Chen and Associates, Inc (Consultant). The services to be provided under the Agreement include Planning, Design, Bid and Award, and Construction Administration Phases of the South Pointe Streetscape Phase III, IV and V, Right-of-Way Neighborhood Improvement Project. The Project scope of work includes improvements to the stormwater collection and disposal system, water distribution system upgrades, roadway resurfacing and streetscape enhancements, landscaping, traffic calming installations, additional pedestrian lighting, and enhanced pedestrian linkages. The Project limits are bounded by Ocean Drive to the East and Alton Road to the West, and include: 1 st Street, between Alton Road and Ocean Drive; Commerce Street, from Alton Road to Washington Avenue; Ocean Drive and Ocean Court, from 5th Street to South Pointe Drive; Collins Avenue and Collins Court, from 5th Street to South Pointe Drive; South Pointe Drive (Siscayne Street), from Alton Road to the Eastern street end; Alton Road, from 5th Street to South Pointe Drive; Jefferson Avenue, between South Pointe Drive and 1 st Street; 1st Street, from Alton Road to Jefferson Avenue; Commerce Street and other adjacent alleys, roadways, and rights of way. The Consultant was then given authorization to proceed with the design phase of the Project. In December 2006, during the project design process, the Public Works Department's Transportation Division requested the implementation of bike lanes in accordance with the Bike Master Plan that was being developed. The Consultant was directed by the City to provide options for the implementation of bike lanes along Alton Road, South Pointe Drive, and Collins Avenue, in accordance with the Bike Master Plan. On January 10,2007, a meeting was held in the Capital Improvement Projects (CIP) office, with various City departments' staff to review the options prepared by the Consultant, and to make recommendations for the inclusion of bike lanes in the South Pointe Phase III, IV and V Right of Way Neighborhood Improvement Project. Alternatives were presented for Alton Road, South Pointe Drive and Collins Avenue. The group agreed that placing bike lanes along Ocean Drive in lieu of Collins Avenue was the most viable alternative. The options for South Pointe Drive involved either removing the medians, eliminating parking on either the North or South side of the street, or reducing the number of travel lanes to accommodate the bike lanes. The Consultant advised the CIP Department that the level of modification needed on South Pointe Drive, if eliminating travel lanes were to be considered, would require a detailed Traffic Study. The decision was later made to eliminate parking on the North side of South Pointe Drive, in order to accommodate bike lanes. Although the implementation of bike lanes on Alton Road from South Pointe Drive to Second Avenue was included in the Bike Master Plan, the continuation of the bike lanes on Alton Road from 2nd Street to 5th Street, in lieu of placing them on Michigan Avenue, was discussed and agreed upon. It should also be noted that the City's Design Consultant for the South Pointe Phase II Project, Wolfberg Alvarez & Partners (WAP), also opined that placing the bike lanes on Michigan Avenue as shown in the Bike Master Plan, would conflict with the South Pointe Elementary School "drop-off' area, as well as other design features. In addition, the South Pointe Phase II Project is in the Permitting Phase. As a result of the above mentioned items, the Consultant was requested to provide a fee proposal for the design of bike lanes within the South Pointe Phase III, IV and V Right of Way Improvement Project. A summary of the preferred options and Chen & Associates additional scope of work is as follows: Alton Road The option for Alton Road from 2nd Street to South Pointe Drive increases the overall width of the existing median, provides two (2) bike lanes, increases the landscape/swale area, and provides for equal sidewalks on both sides of the street. These were not viable options and it was decided that the bike lanes would be moved to Ocean Drive. Ocean Drive Although not originally included in the Bike Master Plan, Ocean Drive from South Pointe Drive to 5th Street is part of the South Pointe III, IV and V Right of Way Neighborhood Improvement Project limits. As such, Ocean Drive was evaluated and accepted by the Public Works Department, and other department staff, as a viable and preferred option for the bike lanes in lieu of Collins Avenue. South Pointe Drive Several options were looked at for South Pointe Drive. Option 1 a, eliminates parking on the North side of the street. Option 1 b, eliminates parking altogether. Option 2, eliminates the landscape median. Option 3, reduces the travel lanes from two (2) 11' lanes East and West bound, to one (1) 11' lane in each direction, and would require the completion of a Traffic Study. The decision was made to pursue Option 1 a. The decision to implement the bike lanes during the design stage of the project, has delayed the submittal of the sixty percent (60%) Construction Documents (CD's) by four (4) months. Once the additional services fee for this work is approved, the Consultant will implement the changes within two (2) months, and submit the sixty percent (60%) CD's to the City. In order to advance the Project, it will be necessary to approve Amendment Number 1 (Attachment A) to the original Agreement between the City and the Consultant, to provide additional design services for these improvements not originally included in the South Pointe Phase III, IV and V Right of Way Neighborhood Improvements Project. The overall fee being requested by the Consultant for the design of the bike lanes on Alton Road, South Pointe Drive, and Ocean Drive is $ 73,256. The Program Manager, Hazen and Sawyer, and the City's CIP Office, have evaluated the Consultant's additional services fee proposal and find it to be fair and reasonable. CONCLUSION The Administration requests approval of the additional services described in the not-to- exceed amount of $73,256, as recommended, and authorization to execute Amendment Number 1, to the existing Agreement with Chen & Associates, for the additional scope of work required to implement bike lanes within the limits of the South Pointe Phase III, IV and V Right-of-Way Neighborhood Improvement Project. The following items, currently not included in the Agreement, will be added to the scope of the Project: Task 5.4 - Design of Bike lanes/routes: The Consultant shall provide detailed design services for producing contract documents (specifications and drawings) as needed for the construction of bike lanes/routes as required by Public Works within the South Pointe Phase III, IV and V Neighborhood as noted below. In this effort, the Consultant shall be bound by the requirements stipulated in TASK 2 - DESIGN SERVICES as adopted via Resolution No. 2005-25902, on May 18, 2005, approving and authorizing the Mayor and City Clerk to execute an Agreement with Chen and Associates for Professional Services for the Pointe Phase III, IV and V Neighborhood Right of Way Improvement Project. In addition to revising existing design documents as necessary to accommodate new bicycle lanes, the Consultant shall also revisit the encroachment tabulations, as new removals may result from this effort. The consultant shall also conduct a detailed assessment of which drawings will be affected by these changes in preparing the proposal. Landscape drawings shall illustrate' revised sight triangle locations. In addition, bike lane and route improvements shall be added to the 60% construction cost estimate. In general, Bicycle lanes / routes shall be included as follows: Alton Road The Options for Alton Road from 5th Street to South Pointe Drive increases the overall width of the existing median, provides two (2) bike lanes and provides for equal sidewalks on both sides of the street. The landscape/swale area will be increased where feasible. Ocean Drive Although not originally included in the "Bike Master Plan" Ocean Drive from South Pointe Drive to 5th Street is part of the South Point III, IV and V Project, and was evaluated and accepted by the Public Works Department as a viable and preferred option for the bike lanes in lieu of Collins A venue. "Providing quality, responsive and professional service to clients, peers and the publiC for 20 years" South Pointe Drive Several Options were looked at for South Point Drive. Option I would eliminate parking on the north side of the street or eliminate parking altogether. Option I which eliminates the parking on the north side may be viable. Option II would eliminate the landscape median. Planning, CIP and Parks staff expressed that removal of the median would be opposed by the South Pointe Residents. Option III would reduce the travel lanes from two (2 )11' lanes east and west bound, to one(1) II' lane in either direction, and would require the completion of a traffic study. Since the preferred option for this street is to be determined, the Consultant will be required to provide a proposal for a traffic analysis.
