A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL
AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE
SCHOOL BOARD OF MIAMI-DADE COUNTY, FLORIDA, PROVIDING
FOR THE SCHOOL BOARD'S CONSTRUCTION OF CERTAIN
IMPROVEMENTS ON THE CITY'S RIGHT-OF-WAY, RELATIVE TO A
PARENT AND BUS DROP-OFF AREA ALONG PORTIONS OF
PRAIRIE AVENUE AND DADE BOULEVARD ADJACENT TO MIAMI
BEACH SENIOR HIGH SCHOOL; FURTHER AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN EASEMENT FOR THE
SCHOOL BOARD (THE CITY EASEMENT) FOR THE ABOVE
STATED PURPOSES, SUBJECT TO APPROVAL OF THE FINAL
FORM BY THE ADMINISTRATION AND THE CITY ATTORNEY'S
OFFICE.
WHEREAS, The School Board of Miami-Dade County (the Board) is the
owner of certain land and facilities located in the City of Miami Beach, Florida, and
known as Miami Beach Senior High School (the School); and
WHEREAS, the Board is in the process of constructing a replacement School
on the existing School land (the "Project"); and
WHEREAS, in order to complete the Project, the Board desires to make
certain improvements within the public right-of-way adjacent to the School, along
portions of Prairie Avenue and Dade Boulevard; and
WHEREAS, the Board will provide the necessary utility easements for the
existing water and sewer lines that presently transverse the School; and
WHEREAS, in consideration for making certain improvements, the City agrees
to grant the Board a permanent easement (the City Easement) for a portion of the
City controlled right-of-way necessary for the Board to construct, operate and
maintain the parent and bus drop-off area along Dade Boulevard (with the final form
for same to be approved by the Administration and the Board); and
WHEREAS, in consideration for the City Easement, the Board agrees to grant
a permanent access easement to the City across a portion of the School's property,
to facilitate access to the adjacent City owned land (the Board Easement); and
WHEREAS, accordingly the City and the Board have negotiated the attached
Interlocal Agreement, memorializing the parties' respective rights and obligations
with respect to the aforestated right-of-way improvements.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Commission hereby approve and authorize the Mayor and City Clerk to execute an
Interlocal Agreement between the City of Miami Beach and The School Board of
Miami-Dade County, Florida, providing for The School Board's construction of certain
improvements on the City's right-of-way, relative to a parent and bus drop-off area
along portions of Prairie Avenue and Dade Boulevard adjacent to Miami Beach
Senior High School; further authorizing the Mayor and City Clerk to execute an
Easement for The School Board (the City Easement) for the above stated purposes,
subject to approval of the final form by the Administration and the City Attorney's
Office.

Item Summary/Recommendation:
Approximately two years ago, the School Board of Miami-Dade County (the "Board") commenced construction
on improvements and expansions to Miami Beach Senior High School (the "School") in the City of Miami Beach.
At that time, the City of Miami Beach learned that the Board had plans to make certain improvements on
Prairie Avenue and on Dade Boulevard, both utilizing City property and/or City right-of-waywithoutthe previous
approval of the City. The City asked the Board to cease construction activities until such time as the various
issues could be reviewed and agreed upon between the City and the Board.
As a result of the City's intervention, the original Board plans for School site improvements were altered to
incorporate several items that were intended to mitigate the impact of the School construction on the adjacent
neighborhood.
The Board proceeded to approve an I nterlocal Agreement which incorporated all of the enhancements to Prairie
Avenue discussed previously, as well as the two other easements for the bus lane and the shared eastern
access. The version of the Interlocal Agreement which was approved by the Board included language that held
the City responsible for maintenance of landscape on Prairie Avenue. As this language was not consented to
by the City, the Interlocal Agreement was never presented for formal approval by the City Commission.
In order that construction of the School not be delayed, the City consented to the Board proceeding with
construction under the agreements reached between the parties as to easements and improvements on Prairie
Avenue. It was further agreed that continued discussion would occur regarding the maintenance activities and
that that particular item could be resolved at a later date.
As construction progressed, a new level of concern was expressed by residents with planned improvements for
the School. After a number of meetings spanning a two year period, the Board has agreed to alter their
planned site improvements to address a variety of resident concerns. City Commission approval of the
Interlocal Agreement with the Board will enhance the School project and provide a needed community benefit
while being more sensitive of the adjacent impacts on City residents. In order to provide the best available
resolution at this time of other neighborhood concerns it is also recommended that the City Commission provide
direction and intent for other outstandinQ resident issues.

ANAL YSIS
Approximately two years ago, the School Board of Miami-Dade County (the "Board")
commenced construction on improvements and expansions to Miami Beach Senior High
School (the "School") in the City of Miami Beach. At that time, the City of Miami Beach
learned that the Board had plans to make certain improvements on Prairie Avenue and on
Dade Boulevard, both utilizing City property and/or City right-of-way without the previous
approval of the City. The City asked the Board to cease construction activities until such
time as the various issues could be reviewed and agreed upon between the City and the
Board.
The City staff met on a number of occasions with Board staff in order to review the
improvements proposed on the School site. The City also hosted several community
meetings in which the improvements were discussed and changes suggested.
As a result of the City's intervention, the original Board plans for School site improvements
were altered to incorporate several items that were intended to mitigate the impact of the
School construction on the adjacent neighborhood. Among the items which were
incorporated into the site plan by the Board were:
· An estate fence at the perimeter of the School property on Prairie Avenue
· Landscape on the School side of the estate fence on Prairie Avenue in order to
screen the parking lot and to act as a litter capture buffer
. Enhanced tree plantings in the swale area adjacent to the estate fence on the City
right-of-way on Prairie Avenue
. The addition of a sidewalk on Prairie Avenue
Within the same series of meetings, the City and Board also came to agreement upon a new
bus lane on Dade Boulevard and a shared access to the eastern side of the School property
and adjacent to Fire Station #2. Easement descriptions for both the improved bus lane on
Dade Boulevard, as well as the shared access for the City and the Board at the east end of
School property were to be incorporated into an Interlocal Agreement between the City and
the Board.
An issue which was in dispute at the time of the meetings to address the Board
improvements was which party would be responsible for maintenance of landscape,
specifically on Prairie Avenue. The Board position was that as the City had required the
landscape, the City should then also be responsible to maintain the landscape. The City
clearly stated its intention not to accept responsibility for the maintenance of the landscape
improvements on Prairie Avenue.
The Board proceeded to approve an I nterloca I Agreement which incorporated all of the
enhancements to Prairie Avenue discussed previously, as well as the two other easements
for the bus lane and the shared eastern access. The version of the Interlocal Agreement
which was approved by the Board included language that held the City responsible for
maintenance of landscape on Prairie Avenue. As this language was not consented to by the

Commission.

As construction progressed, the Board undertook several of its building and site
improvements some of which included the removal of a number of trees on Prairie Avenue in
preparation for construction of the planned Prairie Avenue drop off lane, the estate fence
and required landscaping. This particular activity as well as the overall site construction
activity triggered a new level of concern and interest among adjacent residents who through
the Bayshore Homeowners Association (BHA) expressed their displeasure with planned
improvements for the School both to the Board and to the City of Miami Beach. The
renewed expression of concern by the BHA occurred in mid 2006 and since that point in
time; the City and various BHA representatives and Board representatives have met to
discuss the BHA concerns and possible further mitigation efforts.
While the BHA raised a series of concerns and questions about site improvements, the
principle points of discussion and concern focused on planned Prairie Avenue improvements
and specifically a parent drop off lane to be constructed adjacent to Prairie Avenue and the
landscape treatment which would be finally implemented. The BHA concerns were
principally focused upon the visual and operating impact associated with the School and
undertaking additional improvements to further mitigate what they believed to be a serious
neighborhood impact.
During the many meetings over the past several months, the BHA has submitted design
suggestions and provided design drawings to illustrate both their concepts and the potential
impacts of the mitigations suggested. Every item of concern which has been identified by

the BHA has in some form been reviewed and discussed among the parties. As recent as
Tuesday, February 2ih, City and Board representatives met with BHA representatives to
review and discuss an eighteen point list of concerns which the BHA had raised.
The result of the Tuesday, February 2ih meeting has been communicated directly to the City
Commissioners by BHA representatives and at this point in time it appears as if agreement
between the parties has been reached on measures to be included within an Interlocal
Agreement between the Board and the City (copy attached). A number of items of concern
need to be discussed with the BHA directly by the City; however, it has been agreed that
these items are not appropriate to incorporate into the Interlocal Agreement and do not
involve the Board.
An item of concern that has been discussed principally between the Board, the City and the
School PT A was the cost impact of changes to the School improvements in order to address
the concerns of the BHA. The City and Board have agreed that of the improvements to be
constructed on Prairie Avenue, the Board will assume cost responsibility for all accept the
planned reduction in width and repaving of Prairie Avenue. The road expenses will be born
by the City. This cost sharing arrangement has been agreed upon by the Board and as the
result of the cost sharing will not have major and unmanageable impacts upon their
construction budget.
Key points within the Interlocal Agreement include:
· Provisions for construction of a bus drop off area alonq Dade Boulevard. The bus
pull off area has already been constructed and was part of the original Interlocal
Agreement. This has not been a controversial item and remains unchanged in this
version of the Interlocal Agreement.
· Shared access easement for the City on the east boundary of the School. The
lnterlocal Agreement provides for an access easement along the Schools eastern
most boundary that will allow the City to access both Fire Station #2 and the Public
Works Yard from Dade Boulevard. This item was in the original Interlocal
Agreement and has not been controversial.
. Prairie Avenue improvements
1) Prairie Avenue road width is to be reduced from the current width of 28 feet
to a width of 20 feet (10 foot travel lanes in each direction). These
improvements are to be paid for by the City.
2) Construction of a drop off lane adiacent to Prairie Avenue with provision for
thirty one (31) vehicle spaces at locations as illustrated on the Attachment to
the Interlocal Agreement. The drop off lane area is to be constructed of
concrete pavers and has been reduced from its original proposal size offorty
seven (47) vehicle spaces. These improvements are to be paid for by the
Board of Education.
3) Landscape will be provided along the entire school property on Prairie
Avenue with shade trees planted at twenty feet on center from a tree variety
pallet including silver buttonwood, green buttonwood and other similar
species. The balance of the Prairie Avenue swale area will be sodded and
an irrigation system installed which will be conveyed to the City. Landscape
on the School property adjacent to the estate fence remains unchanged and
will be low growing shrubbery. It has been agreed that a mixture of
buttonwoods and mahogany's will be planted within the parking lot bump
outs. Maintenance for the street trees and the grass mowing will be borne by
the City in the future.

. A decorative six foot estate fence on Prairie Avenue. This item remains unchanged
from the original Interlocal Agreement. This is a Board expense.
. A sidewalk is to be constructed adjacent to the paver drop off lane on Prairie Avenue
and to connect to the school entry way. This item has been modified to reflect the
new reduced size of the drop off lane. This is a Board expense.
. Two paver crosswalks will be provided at 23rd Street and the north edge of the
student parking lot. This is a Board expense.
. While not a requirement in the Interlocal Agreement, the City has committed to
signing the Prairie Avenue drop off lane "No Parkinq At All Times".
Items that have been raised by the BHA for which continued discussion, specifically with the
City and not appropriate to be included in the Interlocal Agreement include the following
items:
. A desire has been expressed by BHA to have the reduced Prairie Avenue Road
width continue north to its intersection with 28th Avenue. The City has agreed that
this is a reasonable expectation that will be incorporated either as a separate project
or as part of planned CIP Neighborhood improvements.
. The BHA has asked that the City consider plantinqs on the north fence line of the
School property where it adioins the Par 3 qolf course.
. The BHA has asked for modifications to the intersection with Dade Boulevard and
Prairie Avenue so as to reduce the total pavement area and to introduce some
landscape features.
. The BHA has asked for traffic calminq measures to be constructed on Prairie
Avenue. Specifically a raised intersection at 23rd Street and Prairie Avenue. This will
be evaluated by the City as part of a traffic calming request and after an appropriate
traffic analysis to assure that there will be no diversion of traffic or other
inappropriate impacts of the traffic calming measure.
· The BHA has asked that additional low shrubs be planted on the street side of
Prairie Avenue between the drop off lane sidewalk and the estate fence to help
screen the parking lot and reduce the impact of the drop off lane.
· The BHA has asked the Board to attempt to further mitiqate spilled over qlare from
the parkinq lot Iiqhtinq fixtures. The Board has indicated their desire and willingness
to turn the light fixtures off when the school is not in operation and as needed
consider shielding. The light fixture operations may require both the consent and/or
cooperation of FPL, as they are the owners of the parking lot light poles.
· The BHA has also asked that a special access be provided to the TeacherNisitor
Parkinq Lot at its closest point of connection with the Dade Boulevard bus lane. This
access would be used only in times of special event to facilitate parking managed by
the PT A or others as a fund raiser and not associated with general school
operations. The effect of the access would be to remove special event traffic
seeking to park at the School from Prairie Avenue. The Board has agreed to
undertake this access point if it can be designed without major impact to existing
pedestrian and parking areas.
CONCLUSION
It is also very important to note that during the prolonged series of meetings and discussions
regarding the School site improvements, at no point did any party question the need or
benefit to the completion of a superb high school for our community.
After a number of meetings spanning a two year period, the Board has moved to alter their
planned site improvements to address a variety of BHA concerns and the BHA has also
moved to compromise their desired improvements to that list which is presented for City

Commission approval. The result of the City Commission approval of the Interlocal
Agreement with the Board will be to enhance the School project and provide a needed
community benefit while being more sensitive of the adjacent impacts on City residents.
It is recommended that the members of the City Commission approve the Interlocal
Agreement as presented. In order to provide the best available resolution at this time of
other neighborhood concerns it is also recommended that the City Commission provide
direction and intent for most of the outstanding issues. As many of the items will require
engineering analysis and design, permits from other agencies, funding identification and
coordination with other project work the City commitment can only go so far. Direction to the
Administration to implement or pursue other items identified as concerns is recommended
as follows:
. Upon construction of the Prairie Avenue drop lane, sign the area as no parking.
. Either as a stand alone project or a part of the CIP neighborhood project, as
determined most appropriate by the administration, extend the Prairie Avenue road
width reduction of 20' northward on Prairie Avenue from the terminus of the Board
improvements to the intersection at 28th Avenue.
. In conjunction with the future renovation of the Par 3 golf course, design of which to
be determined, plant appropriate tree or landscape materials consistent with the
renovation plan on the border between the Par 3 and the School.
. Determine if traffic engineering and County support can be obtained for changes to
the intersection of Dade Boulevard and Prairie Avenue to reduce the overall amount
of pavement in the intersection and to introduce landscape material in an existing
traffic island. If supported, identify a funding source and pursue the intersection
improvements.
· Upon completion of the Prairie Avenue improvements, pursue to the extent feasible,
added low shrubbery in the swale area in a manner that will not interfere with
drainage or necessary maintenance of the area.
· In coordination with and consistent with the planned CIP neighborhood project for
the Bayshore neighborhood, determine if traffic calming measures are warranted and
which if any measures are appropriate at the intersections of 23rd and Prairie Avenue
and 23rd and Meridian Avenue. Either from the CIP neighborhood project budget or
a different source to be identified by the administration design and build the indicated
traffic calming measures.
While the BHA would like more certainty than is possible to express at this point in time, the
suggested City Commission action gives the most assurance possible from the City.

After introduction of all attendees, a short justification for the meeting was given by
Middaugh. The Miami Beach Senior High School and its expansion have created the
need for a drop-offlane in the City of Miami Beach (CMB) right of way along Prairie
Avenue. Since there are serious concerns about the impacts of the drop off lane a
mitigation program has been proposed by the Bayshore Homeowners Association
(BHOA) which was discussed during the meeting.
A request by Commissioner Gross at the public meeting on February 11,2007 asked the
school to look into using the driver education lot as a drop-off lane as the area might be
able to accommodate some cars for drop-off. The report back was that it could be
possible, but no more reductions on Prairie Avenue would be possible. Since the number
of drop-off spaces along Prairie A venue would remain unchanged, it was agreed that the
area should remain for driver education purposes only. Middaugh also said that
regarding street resurfacing, pavers, and landscaping cost sharing had been agreed upon
between the CMB and the School Board.
Corey then reiterated that the residents' consensus at a recent public meeting on February
11,2007 at City Hall was that the parent drop-off with its parking, trash and traffic was
not appropriate on the residential street. If the CMB were to accommodate the School
Board with the drop-off along Prairie Avenue, the BHOA has outlined l6 points of
mitigation for the neighborhood. These items are appropriate mitigation measures and
would make the drop-off more palatable to the neighborhood and the vote on the
lnterlocal Agreement on March l4th not such a struggle at the Commission Meeting.
Monies have already been allocated for improvements along the stretch of Prairie A venue
from Dade Blvd. to 28th Street in the BODR in 1999. The results of the discussions on
the mitigation measures are as follows:
1) Reduction of Prairie Avenue width along school boundary to decrease pavement
massing, increase landscaping buffer and slow traffic
The School Board and the CMB agree on this measure and the School Board will
increase the depth of landscaping in the swale area from Dade to the Par 3 in order to
reduce the road width to 20 feet wide and increase the landscaping buffer between the
school and the residential neighborhood. Fields reminded the group that the area in
front of the driver education lot would be a transition area and allow the street to
change back to 14 foot wide lanes. Corey asked that additional trees to be planted in
this area to better match the rest of the school swale landscaping and help buffer the
driving education lot from the neighbors. Middaugh said that the remainder of Prairie
Avenue along the Par 3 to 28th Street would be addressed during the BODR
improvements.
2) Reduction from 4 to 3 lanes at Dade Boulevard to slow traffic entering Prairie
Avenue and racing through neighborhood and past high school
Item to be discussed between BHOA and CMB outside this meeting.
3) Enlarge traffic island at Dade Boulevard and Prairie Avenue in order to increase
green space and reduce travel lane width
This measure also shortens pedestrian crossing at Dade Boulevard (better
accommodating students walking south to Lincoln Road Mall, etc.). Item to be
discussed between BHOA and the CMB outside this meeting.
4) Raised intersections at 23rd Street and Prairie Avenue and 23rd Street and
Meridian Avenue to mitigate increased traffic volume, provide for raised
sidewalks, and make the left turns safer (from 23rd Street to Prairie Avenue)
Item to be discussed between BHOA and the CMB outside this meeting.
5) Landscaping swale
According to Fields, of the original trees removed last spring, all but two were dying;
therefore, a permit was granted by DERM. Miller strongly disagreed that the trees
were dying. An additional row oflow lying bushes was also proposed by the BHOA
as to further filter blowing trash and provide a step up to the six-foot estate fence.
Item is to be discussed at the upcoming CMB/BHOA meeting. The landscaping of
the swale will also be discussed further between the landscape architect for the school
and Miller. Findings to be made available the following week.
6) Trees in student parking area
It was agreed to alternate mahogany with buttonwood trees for the parking as well as
the street. The BHOA requested more trees in the rear parking lot to match closer the
tree density on the front parking lot (8 trees to 1 space vs. 4 trees to 1 space,
respectively). Fields stated that the additional trees were not possible, but low shrubs
at the three islands in the rear parking lot could increase the green space.
7) New chain link fence between High School and Par 3
The BHOA expressed disappointment in this fence and felt that it is consistent with
neither the residential character of the neighborhood nor the Par 3 golf course.
Beckman said that this request will fall under the Par 3 beautification improvements.
Middaugh also stated there will be a variety of trees and it will be the city's
responsibility. It was agreed that this would be discussed at upcoming the
City/BHOA meeting.
8) Six foot estate fence
Fields stated that the fence would be a black "estate" fence. The gates to the parking
entrances would match the "estate" fence. The main gates to the entrance to the
school will be more ornate and will be set back off of the street.
9) No parking or Standing Signage
Middaugh states that, clear from the beginning, the CMB will never permit parking at
any time (including for neighborhood residents) and cars will be towed. Fields says
the working drawings have 'No Parking" signs. Although, according to the BHOA,
the issue of after hours abuse is still not solved and the neighborhood remains
skeptical that it will be abused and force the residents to call in violations on a daily
basis as is current.
10) Drop-off lane surface
Fields stated they had been asked for stamped asphalt from the CMB originally.
Middaugh thought that pre-cast concrete pavers would be more appropriate. Alonso
asked for the specifications in order to be able to coordinate the drop-off with other
neighborhood improvements. Alonso suggested some type of interlocking pavers.
Fields asked for the specification as soon as possible so that they may continue with
the design drawings. Alonso strongly felt that it is important to match the streetscape.
11) Street Lights along Prairie Avenue to remain consistent if any had to be moved
Moot point according to Fields as none is being moved.
12) Concrete curb along school swale to prevent parking on swale
According to Beckman, curbs cannot be installed along this stretch of Prairie Avenue,
although stated and allocated for in BODR. Vasquez offered that the road way is too
flat making a curb with drain inefficient for drainage. A grassy swale is proposed for
this area along Prairie Avenue that does not have the drop-off lane. Corey stressed
the illegal parking problem and the proximity to the Convention Center. To avoid
illegal parking, concrete dots or bollards such as on 28th Street and landscaping such
as low shrubs was proposed by city officials. This issue is to be discussed at the next
meeting between BHOA and the City.
13) Drop-off lane for students only during school hours
It was discussed that drop-off after hours for parent/teacher conferences would be
allowed.
l4) Lighting
Fields will look into cost of shields or reflectors to protect neighborhood from
disturbing glare. The lights are designed for full-growth trees (in 4-5 years);
therefore, shields would eventually have to be removed. Trees to be planted would be
a 12-l4' standard. There was also a discussion about the ownership of lights: FPL
owns them even though installed by the School Board. Alonso suggested that they
could be turned off when school not operating. Item still needs to be resolved to
reduce glare into neighborhood.
15) Curb cuts along Prairie Avenue
Fields stated that there are actually three: front parking lot, rear parking lot, and
maintenance/emergency entry at 23rd Street. Third curb cut is considered emergency
vehicle egress at 23rd Street and can be driven over by fire truck or large truck for big
event stage loading, which the school says are about 2 per year. Miller asked why
the entry to the rear lot was at 23rd Street. According to Fields, it was too close to the
intersection and not wanted by the CMB Public Works Department. This entrance
would have necessitated 90-degree parking and taking more space from play fields.

These additional points were added:
17) "School Zone" flashing lights along Prairie Avenue
Corey asked school architects if "School Zone" flashing lights would be mounted
along Prairie A venue. According to Fields, they are not required anymore for high
schools and that they would not be installing any.
18) Front school parking lot being used consistently for convention center events
BHOA recognized that this is income for the CMB and a big fundraiser for the PT A,
but the residents need a break during weekends and holidays. The residents along
southern Prairie Avenue (23rd to Dade) have noticed the parking lot used on most
weekends and the parking seems to be run by the CMB. At no time, these residents
get a break from the traffic even on holidays when most of the convention business
occurs. It was proposed by the BHOA that a curb cut be placed along the bus drop-
off and the front parking lot. It was offered by Corey that this could be used only on
weekends and holidays when the front parking lot was being used commercially.
This would allow the school, city and PT A to still use the front lot, but allow the
southern Prairie A venue residents a much needed break from the traffic. The Boat
Show parking in the football fields was also discussed. Alonso stated that this
practice goes against school policy and offered that after the field is redone and a new
irrigation system installed it could not continue. Alonso stated that he would direct
the architects to look into the possibility of creating a "maintenance gate" to
accommodate this request. Fields suggested that bollards could be used and a special
curb to allow for cars to enter the parking lot off of Dade Boulevard.
A meeting between the BHOA and the CMB would be scheduled as soon as possible to
go over the umesolved issues discussed in the meeting. A Memorandum of Agreement
between the BHOA and the CMB needs to be finalized and included as part of the
interlocal agreement voted on at the March l4th Commission Meeting to ensure that the
mitigation measures would be implemented.
