RESOLUTION NO. 2007-26490 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AMENDMENT NO.1, IN THE AMOUNT OF $101,034, TO THE EXISTING EMERGENCY AGREEMENT BETWEEN THE CITY AND RIC-MAN INTERNATIONAL, INC., TO PROVIDE INTERCONNECTION BETWEEN THE NEW TWELEVE (12) INCH WATER MAIN, LOCATED ON THE EAST SIDE OF INDIAN CREEK DRIVE, AND THE EXISTING SIX (6) INCH WATER MAIN ON THE WEST SIDE OF INDIAN CREEK DRIVE AND TO PROVIDE APPROPRIATE PROTECTION TO THIRTY (30) NEWLY INSTALLED VALVES, ALONG INDIAN CREEK DRIVE FROM 63RD STREET TO ABBOTT AVENUE. WHEREAS, on December 6, 2006, the Mayor and City Commission approved Resolution No. 2006-26404, ratifying, pursuant to Section 2-396 (a) of the Miami Beach City Code, an emergency agreement between the City and Ric-Man International, Inc., for the installation of a twelve (12) inch water on Indian Creek Drive, from 63rd Street to Abbott Avenue; and WHEREAS, as part of the emergency water main installation, the City recognized the need to connect the new twelve (12) inch water main on the east side of Indian Creek Drive, to the existing six (6) inch water main on the west side of Indian Creek Drive, to improve water pressure and overall performance of water main network; and WHEREAS, the City required the protection of thirty (30) newly installed valves in the traffic area to ensure proper operation and functioning throughout the life cycle of the water main; and WHEREAS, funding, in the amount of $101,034, is being provided from the Gulf Breeze Loan 2006 Fund 423 (Miscellaneous Wastewater and Water Upgrades), previously appropriated in the FY 2006-07 Capital Budget; and WHEREAS, the additional water main construction work was completed by Ric-Man International, Inc. on December 15, 2006, and Florida Department of Transportation has agreed to hold the City harmless for any delays attributed to the work performed on the water main along the Indian Creek Drive Corridor. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami Beach, Florida, hereby approve Amendment No.1, in the amount of $1 01,034, to the existing emergency Agreement between the City and Ric-Man International, Inc. to provide interconnection between the new twelve (12) inch water main, located on the east side of Indian Creek Drive, and the existing six (6) inch water main on the west side of Indian Creek Drive, and to provide appropriate protection to thirty (30) newly installed valves. Item Summary/Recommendation: An emergency construction project was awarded to Ric-Man International on December 6, 2006 in the amount of $517,000 for the installation of a 12 inch water main along Indian Creek Drive from 63rd Street to 6th Street. After awarding the project, the City recognized the advantage of connecting the new 12 inch water main to the existing 6 inch water main. The connection improved the performance of the existing water main infrastructure in the area and improved fire flow. The City also required the protection of 30 newly installed water valves in the traffic areas. The construction work was completed on December 15, 2006. The Administration recommends adopting the Resolution. ANAL YSIS On December 6, 2006, the Mayor and the City Commission of the City of Miami Beach approved Resolution 2006-26404 for an emergency agreement between the City and Rie- Man International, Inc. for the installation of 12 inch water main on Indian Creek Drive from 63rd Street to Abbott Avenue at a cost of $517,000. After warding the project, the City recognized the advantage of connecting the new 12 inch water main to the existing 6 inch water main. The connection improved the performance of the existing water main infrastructure in the area and improved fire flow. The City also required the protection of 30 newly installed water valves in the traffic areas. The construction work was completed on December 15, 2006 for an additional $101,034. The change had to be completed in accordance with FOOT's roadway construction schedule to avoid delays. Any delay, by the City, to FOOT's roadway construction would have represented a significant cost to the City and hardship to the neighborhood. In addition to the installation of the water main, the City instructed the contractor to provide adequate protection for the new valves within the traffic lanes. Recognizing the City's prompt response, FDOT has agreed to hold the City harmless for any delays attributed to the interconnection of the water mains and valve protections along the Indian Creek Drive Corridor. CONCLUSION The Administration recommends approving the resolution ratifying amendment 1 of the emergency agreement between the City and Ric-Man International Inc., in the amount of $101,034 to provide interconnection between the new 12 inch water main located on the east side of Indian Creek Drive and the existing 6 inch water main on the west side of Indian Creek and to provide appropriate protection to 30 newly installed valves along Indian Creek Drive from 63rd Street to Abbott Avenue.
