Miami Dade County / No Objection Agreement for Transfer of Maintenance
for FDOT Roadway Lighting Systems in City of Miami Beach
Dear Mr. Gonzalez:
Miami Dade County Public Works Department, in cooperation with the City of Miami
Beach's (City) proposed agreement to contract with Florida Department of
Transportation (FOOT) for the maintenance of lighting systems on FOOT roadways
within the City, for the purpose of supporting the City's WiFi network on said
systems, does not object to turning over said Roadway Lighting Systems (Systems)
on the below listed roadways, to the maintenance and energy responsibilities of the
City. No work shall commence on the Systems currently maintained by the Miami-
Dade County Public Works Department prior to the effective date of the proposed
State Highway Lighting, Maintenance and Compensation Agreement (Agreement),
to be entered into between FDOT and the City:
Abbott Avenue - 72nd Street to Indian Creek Drive
Alton Road - 5th Street to 63rd Street
Collins Avenue - 5th Street to 61st and 72nd Street to 8ih Terrace
5th Street - Alton Road to Ocean Drive
41st Street - Alton Road to Collins Avenue
63rd Street - Alton Road to Collins Avenue
71st Street - West of North Bay Causeway to Rue Notre Dame
Harding Avenue - 72nd Street to 8ih Terrace
Indian Creek Drive - 26th Street to 44th Street and 59th Street to 71 st Street
Normandy Drive - Rue Notre Dame to West of North Bay Causeway
MacArthur Causeway - Alton Road to West City Limits
Subject to the approval of the Agreement between FDOT and the City, which is
anticipated to occur on April 11, 2007. the City agrees to assume the following
responsibilities on the Systems indicated above:
Energy payments.
Replacement or system upgrades,
Location of underground electrical conduits,
Response to citizen reports of street light malfunctions, and
All maintenance activities including emergency responses.

Accordingly, in the event of approval of the Agreement between FOOT and the City, the County will
have no further responsibility for any liability that may occur as a result of this transfer of authority.
This letter will also confirm the agreement between the County and the City whereby the County,
through its Public Works Department, will agree to compensate the City the full amount (applicable
to the period anticipated to be April 12, 2007 through June 30, 2007) previously paid to the County
by FOOT for the maintenance of the Systems that will be transferred to the City.
Please be advised that the County will also notify FPL that all billing for the Systems will be
transferred to the City upon approval of the Agreement between FOOT and the City.
