RESOLUTION NO.
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER PERTAINING TO
THE RANKING OF FIRMS; AUTHORIZING THE ADMINISTRATION TO NEGOTIATE
PROFESSIONAL SERVICES AGREEMENTS PURSUANT TO REQUEST FOR
QUALIFICATIONS (RFQ) NO. 04-06/07, FOR CITYWIDE GEOTECHNICAL AND LABORATORY
TESTING SERVICES, ON AN AS NEEDED BASIS FOR THE CITY OF MIAMI BEACH; AND
FURTHER AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE PROFESSIONAL
SERVICES AGREEMENTS UPON COMPLETION OF SUCCESFUL NEGOTIATIONS WITH ANY
OR ALL OF THE FOLLOWING FIVE (5 FIRMS: 1) PROFESSIONAL SERVICES INDUSTRIES
(PSI); 2) MACTEC; 3) NUTTING ENGINEERS OF FLORIDA, INC.; 4) UNIVERSAL
ENGINEERING SCIENCES; AND 5) GEOSOL, INC.
WHEREAS, RFQ No. 04-06/07 for Citywide Geotechnical and Laboratory Services, on an
as needed basis for the City of Miami Beach, was issued on October 18, 2006, with an opening
date of December 12, 2006 (the RFQ); and
WHEREAS, the RFQ requested sealed qualifications from experienced and qualified firms
to perform subsurface explorations, obtaining representative samples, and performing other
various geotechnical services for City facilities, rights of way projects and other miscellaneous
Capital Improvement Projects; and
WHEREAS, a pre-proposal conference was held on November 3, 2006; and
WHEREAS, Bid Net issued bid notices to 13 prospective proposers and RFP Depot issued
bid notices to 52 prospective proposers, which resulted in the receipt of twelve proposals; and
WHEREAS, the City Manager, via Letter to Commission (LTC) No. 294-2006, appointed an
Evaluation Committee ("the Committee") consisting of the following individuals:
· Rick Saltrick, Senior Capital Projects Coordinator
· Graciela Escalante, Senior Capital Projects Coordinator
· Fernando Vazquez, City Engineer Public Works
· Mike Alvarez, Assistant Director Public Works
· Greg Mohr, Leadership Academy Graduate and Resident
· David Patlak, Leadership Academy Graduate and Resident; and
WHEREAS, on February 21,2007, the Committee convened to rank the proposers; and
WHEREAS, the Committee members were provided with general information on the scope
of services, Performance Evaluation Surveys, and Risk Assessment Plans for all the proposers
being evaluated; and
WHEREAS, the Committee discussed the proposers' respective qualifications, experience,
and competence, and ranked the firms accordingly; and
WHEREAS, a motion was presented by Femando Vazquez, seconded by Graciela
Escalante, and unanimously approved by all Committee members to recommend the following five
firms: 1) Professional Services Industries (PSI); 2) Mactec; 3) Nutting Engineers of Florida, Inc; 4)
Universal Engineering Sciences; and 5) Geosol, Inc; and
WHEREAS, the City Manager concurs with the Committee's recommendation, and would
recommend that the City Commission authorize the Administration to negotiate with any or all of
the following five firms: 1) Professional Services Industries (PSI); 2) Mactec; 3) Nutting Engineers
of Florida, Inc; 4) Universal Engineering Sciences; and 5) Geosol, Inc; and
WHEREAS, the City Manager would further request that, in the event of successful
negotiations, that the Mayor and City Commission further approve and authorize the Mayor and
City Clerk to execute Agreements with the successful proposers.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the
recommendation of the City Manager pertaining to the ranking of firms; authorize the
Administration to negotiate professional services agreements pursuant to Request for
Qualifications (RFQ) No. 04-06/07, for Citywide Geotechnical and Laboratory Services, on an as
needed basis for the City of Miami Beach; and further authorize the Mayor and City Clerk to
execute professional services agreements upon completion of successful negotiations with any or
all of the following five firms: 1) Professional Services Industries (PSI); 2) Mactec; 3) Nutting
Engineers of Florida, Inc; 4) Universal Engineering Sciences; and 5) Geosol, Inc.

2006. BidNet issued bid notices to 13 prospective proposers and RFP Depot issued bid notices to 52
prospective proposers, which resulted in the receipt of twelve proposals.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANAL YSIS
On October 11, 2006, the Mayor and City Commission approved the issuance of Request for
Qualifications (RFQ) No. 04-06/07 for Citywide Geotechnical and Laboratory Services, on an
as needed basis for the City of Miami Beach. The RFQ requested sealed qualifications from
experienced and qualified firms to perform subsurface explorations, obtaining representative
samples, and performing other various geotechnical services for City facilities, rights of way
projects and other miscellaneous Capital Improvement Projects.
By issuing a Geotechnical Services RFQ and its subsequent Agreement(s), the City will be
able to adequately plan and incorporate Geotechnical and Soil Testing Services as part of
the pre-construction preparatory work, which is a phase that is part of every City construction
project. In addition, the Geotechnical firm(s) would provide personnel that are qualified,
trained and thoroughly familiar with the City's rules, policies, and procedures in inspection,
sampling testing, and reporting various areas and stages of construction. The ability to have
a rotating list of Geotechnical firms would enable the City to procure these services directly at
a cost savings to the City.
It is the intent of the City of Miami Beach to select several firms under this RFQ, which will be
contacted on a rotational basis, based on the City's needs and experience and qualifications
of the firms.

The executed agreements will remain in effect for a period of two (2) years. The City of Miami
Beach has the option to renew the agreements at its sole discretion for an additional two (2)
year period on a year-to-year basis. Such option will be exercised, if at all, only when it is in
the best interest of the City.
RFQ No. 04-06/07 was issued on October 18, 2006 with an opening date of December 12,

The City Manager via Letter to Commission (LTC) No. 294-2006, appointed an Evaluation
Committee ("the Committee") consisting of the Following individuals:

On February 21, 2007, the Committee convened and a quorum was attained. Committee
member, Greg Mohr, did not attend the meeting because he certified on his disclosure
questionnaire that he had worked for Bureau Veritas North America, Inc d/b/a Intercounty
Laboratories which excluded him from further involvement in this Evaluation Committee. The
Committee unanimously nominated Fernando Vazquez as Chair of the Committee.
The Committee members were also provided with an overview of the project, Performance
Evaluation Surveys and Risk Assessment Plans for all the proposers being evaluated. The
Committee members were not provided with presentations by any of the twelve prospective
proposers.
The following Evaluation Criteria was used to evaluate and rank the groups or individuals:
A. The experience, qualifications and portfolio of the Principal (15 points).
B. The experience, qualifications and portfolio of the Project Manager (15 points).
C. The experience and qualifications of the professional personnel assigned to the
Project Team (10 points).

D. Risk Assessment Plan for ensuring quality of work (20 points).
E. Willingness to meet time and budget requirements as demonstrated by past
performance (5 points).
F. Certified minority business enterprise participation (5 points). Either the Prime
Consultant or the sub-Consultant team may qualify for proof of certification for
minority business enterprise participation. Accepted minority business enterprise
certifications include the Small Business Administration (SBA), State of Florida, or
Miami-Dade County.
G. Location (5 points).
H. Recent, current, and projected workloads of the firms (5 points).
I. The volume of work previously awarded to each firm by the City (5 points).
J. Past performance based on number and quality of the Performance Evaluation
Surveys (15 points).
The method of ranking the groups and individuals utilized by the Committee was the
following: The group individuals with more than 50% of the Committee Members' first-place
votes will be deemed the top-ranked contractor; subsequent contractors or contractors not
receiving the majority of the Committee Member's first-place votes will be ranked based on
the total low aggregate ranked score.
The Committee discussed their individual perceptions of the contractor's qualifications,
experience, and competence, and ranked the firms accordingly. A motion was presented by
Fernando Vazquez, seconded by Graciela Escalante, and unanimously approved by all
Committee members for PSI, Mactec, Nutting Engineering, Universal Engineering, and
Geosol to be recommended for potential award of contract. The final scoring was as follows:

Dear Ms. Viera:
In response to your protest letter, dated March 13, 2007, whereby you protest the City Manager's
recommendation relative to the ranking of firms pursuant to the above referenced RFQ, the City
Administration has reviewed the basis for your protest and hereby denies same, based on the
following:
1. Bureau Veritas' Araument Aaainst Recommendina Proffesional Service Industries
(PSI): PSI's Miami office responded to the RFQ (sic). This office is not certified for
concrete by Construction Materials Engineering Council (CMEC).
City's Response: Addendum NO.6 of the RFQ amended Article 2 (E) (2) of Section III of the
RFQ as follows:
The Proposer shall possess certification provided to them by the Miami-Dade
County Business Development Office in the following categories:
0901 - Drilling Subsurface Investigations & Seismographic
0902 - Geotechnical & Materials Engineering Services
Proposer and their proposed subconsultants shall include a copy of their
certification in the proposal response. If your firm is not certified at the time of
proposal submittal, your firm must submit documentation that reflects your
firm's attempt in applying for such certifications. If your firm is selected, then
as a condition of contract execution, your firm must possess the required
certifications.
PSI's proposal complies with the RFQ requirements, as amended.
2. Bureau Veritas' Araument Aaainst Recommendina Nuttina Enaineers: Nutting's
satellite office in Miami is listed as the office responding to the solicitation. This office
holds no CMEC accreditation. It's next closest office that can provide the services
from a accredited laboratory is in Boyton Beach. This office, however, did not
respond to the solicitation.
City's Response: See City's Response to Item Number 1 above. In addition, Addendum No.
6 of the RFQ informed all firms that if they did not provide drilling or laboratory testing
services directly, they may sub-contract the work.
Additionally, Nutting Engineers stated in its proposal that its Miami-Dade County
office/laboratory would be supported by the other two branch offices on an as needed basis.
Nutting's proposal complies with the RFQ requirements.
3. Bureau Veritas' Argument Against Recommending Universal Engineerng Sicences:
Universal's satellite office in Miami is also listed as the office responding to the
solicitation. This office holds no CMEC certifications as well. The next closest office
that can provide accredited laboratory work is located in the Palm Beaches, but again,
that office did not respond to the solicitation.
City's Response: See City's Response to Item Number 1 above. Therefore, whatever
service the Miami Branch cannot provide can be provided by the Lake Worth Branch.
Additionally, see City's Response to Item Number 2 above, relative to the provision of drilling
or laboratory testing services. Universal's proposal complies with the RFQ requirements.
4. Bureau Veritas' Argument Against Recommneding Geosol: Geosol. It is believed
Geosal has no laboratory testing services in Miami-Dade County or elsewhere, hence
it holds no CMEC certifications. Further, the firm can only self-perform a portion of the
services requested in the solicitation for "Cityside Geotechnical and Testing
Laboratory Services"
City's Response: See City's Response to Item Number 1. Additionally, see City's Response
to Item Number 2. Geosol's proposal complies with the RFQ requirements.
For the reasons set forth herein, your protest is hereby denied.
You may appeal my decision by filing an original action in the Circuit Court of the Eleventh Judicial
Circuit in and for Miami-Dade County, Florida, in accordance with the applicable court rules. Any
action not brought in good faith shall be subject to sanctions including damages suffered by the City
and attorney's fees incurred by the City in defense of such wrongful action.
