SUBJECT: Miami Beach Police Department Case #2007-13979
This Letter To The Commission is to inform the Mayor and City Commission of Miami Beach
of the status of a complaint from a Mr. Bill Cooke regarding a lack of action on the part of
Miami Beach Police Department police officers while investigating a simple battery
allegation.
On April 8, 2007, Mr. Cooke claims he was a victim of a battery that took place on the beach
at 20th Street. Mr. Cooke sustained no injury and the subject had left the scene prior to the
officers arriving to investigate this matter. As a result of the preliminary investigation the
incident was documented and no arrests were made.
Mr. Cooke advised in an email of April 8th that the officers were courteous and professional
but felt they could have taken more action. When Mr. Cooke's complaint came to the
attention of the Miami Beach Police Department it was assigned to Lieutenant Richard
Gullage for supervisory investigation. On April 1 0, Lieutenant Gullage spoke to Mr. Cooke
and advised him why the officers could not affect a lawful arrest under the circumstances.
This explanation resolved the matter to Mr. Cook's satisfaction and is noted in the attached
email. No further action is warranted in this matter.
