98-22823 RESO RESOLUTION NO. 98-22823 A RESOLUTION AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO RECEIVE AND PROCESS ANY PETITIONS FOR INITIATIVES AND REFERENDUMS, TO SIGN ALL REQUIRED CONTRACTS, AGREEMENTS, PURCHASE ORDERS, AND CHANGE ORDERS THA T MAY AFFECT THE HEALTH, SAFETY, OR WELFARE OF THE CITY, TO TEMPORARILY RENEW EXISTING CONTRACTS WHICH MAY EXPIRE, AND TO TOLL ALL REQUIRED CITY COMMISSION ACTS RELATIVE TO ADMINISTRATIVE APPEALS PROVIDED FOR IN ZONING ORDINANCE NO. 89-2665, FROM THE LAST COMMISSION MEETING IN JULY, 1998, UNTIL THE FIRST COMMISSION MEETING IN SEPTEMBER, 1998, SUBJECT TO RATIFICATION BY THE CITY COMMISSION AT ITS FIRST MEETING IN SEPTEMBER, 1998. WHEREAS, the Mayor and City Commission are not scheduled to meet between the last meeting in July, 1998 and the first meeting in September, 1998; and WHEREAS, the Mayor and City Commission historically have, during such periods in past years, assigned certain powers to the City Manager or his Designee, to receive and process any petitions for initiatives and referendums and to sign all required contracts, agreements, purchase orders, and change orders that may affect the health, safety or welfare of the City, subject to ratification by the City Commission; and WHEREAS, there may be existing contracts which may expire and require renewal during the Commission between the last Commission meeting in July, 1998 and the first meeting in September, 1998 which should receive Commission approval for renewal for another year or other extended period of time; and WHEREAS, any administrative appeals to the City Commission, as provided in Zoning Ordinance No. 89-2665 would be unable to be held between the last meeting in July, 1998, and the first meeting in September, 1998 and, therefore, the time for the City Commission to perform any required acts relative to such administrative appeals should be tolled during said period; and WHEREAS, the City Manager will report back to the City Commission, at the first meeting in September, 1998, seeking ratification of any actions relating to the afore stated authorizations. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the City Manager, or his Designee, is hereby authorized to receive and process any petitions for initiatives and referendums and to sign all required contracts, agreements, purchase orders, and change orders that may affect the health, safety, or welfare of the City, and to temporarily renew any existing contracts for thirty (30) days that may be required to be renewed, and to toll all City Commission acts required acts relative to administrative appeals provided for in Zoning Ordinance No. 89-2665 from the last commission meeting in July, 1998 until the first Commission meeting in September, 1998, subject to ratification by the City Commission at its first meeting in September, 1998. ADMINISTRA TION RECOMMENDATION Adopt the Resolution. BACKGROUND Between the last meeting in July, 1998, and the first meeting in September, 1998, the City Commission will not be in session. During this period of time there may be contracts which may need to be awarded, and which may be in excess of the $10,000 limitation. Additionally, there may be projects which need timely action. The City Commission has historically, during such periods, assigned certain powers to the City Manager subject to ratification by the City Commission. Additionally, any administrative appeals to the City Commission, as provided in Zoning Ordinance No. 89-2665, would be unable to be held between the last meeting in July, 1998, and the first meeting in September, 1998. Therefore any required acts relative thereto should be tolled during said period. It is therefore requested that the City Manager, or his Designee, be authorized to receive and process any petitions for initiatives and referendums; sign all required contracts, agreements, purchase orders, and change orders that may affect the health, safety, or welfare of the City; temporarily renew any existing contracts, for thirty (30) days, if necessary; and, toll all acts relative to administrative appeals AGENDA ITEM CIA t-\S-9E; DATE provided for in Zoning Ordinance No. 89-2665, from the last Commission meeting in July, 1998, until the first Commission meeting in September, 1998, subject to ratification by the City Commission at its first meeting in September, 1998. CONCLUSION Since this authorization is necessary to ensure that essential services and projects continue during the period between the last Commission meeting in July, 1998, until the first Commission meeting in September, 1998, it is recommended that the City Commission approve this request.
