A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA
ESTABLISHING A THREE MEMBER COMMITTEE TO
NEGOTIATE WITH THE OWNER OF THE BYRON
CARLYLE THEATER CONCERNING THE POSSIBLE
ACQUISITION OF THE PROPERTY BY THE CITY FOR
MUNICIPAL PURPOSES AND, IN ADDITION,
ESTABLISHING A SEPARATE THREE MEMBER
COMMITTEE TO MEET WITH THE REPRESENTATIVES
OF CULTURAL ARTS GROUPS AND OTHER POTENTIAL
USERS TO DISCUSS POTENTIAL USES OF THIS
PROPERTY AND FUNDING STRATEGIES FOR ITS
ACQUISITION.
WHEREAS, it has come to the attention of the Mayor and City Commission of the City of
Miami Beach that the Byron Carlyle Theater, located at 500 7lst Street, Miami Beach (the
"Property"), is being offered for sale by its owner; and
WHEREAS, the Mayor and City Commission wish to explore the possibilities of purchase
of this Property for municipal purposes and deem it in the best interest of pursuing this prospect to
establish a three member committee consisting of the City Manager or his designee, the City
Attorney or his designee, and a City Commissioner, to negotiate with the owner for this purpose; and
WHEREAS, in addition to the three member negotiating committee, the Mayor and City
Commission deem it advisable to also establish a separate three member committee, to be comprised
of the City Manager or his designee, the City Attorney or his designee, and a City Commissioner,
to meet with representatives of cultural arts groups, and other potential users of the Property, to
discuss its use and funding strategies for its acquisition.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that in order to effectuate the
above stated purposes, the Mayor and City Commission hereby:
1. Create a three member committee to negotiate with the owner of the Property
concerning the Property's acquisition by the City for municipal purposes. Said
committee shall consist of the City Manager or his designee, the City Attorney or his
designee, and a City Commissioner.
2. Create a three member committee to meet with representatives of cultural arts groups,
and other potential users of the Property, to discuss the use of the Property and
funding strategies for its acquisition. Said committee shall consist of the City
Manager or his designee, the City Attorney or his designee, and a City
Commissioner.
3, This Resolution shall take effect immediately.

The Byron Carlyle Theater is on the market again. I would like to sponsor a resolution to be heard
as an emergency item at the September 27th Commission Meeting, instructing the administration to
begin negotiations with the property owner.
The resolution should establish a three-member committee to negotiate with the owner, consisting
of the City Manager or his designee, the City Attorney or his designee and a City Commissioner.
The resolution should also establish a separate three-member committee to meet with representatives
of the Cultural Arts Groups and other potential users to discuss the use of the facility and funding
strategies.
Please prepare a resolution for the September 27'" Commission Meeting.

SUBJECT: Byron Carlyle Theater
Resolution No. 2000-24104 adopted on September 27, 2000, established a three member committee
to negotiate with the owner of the Byron Carlyle Theater concerning the possible acquisition of the
property by the City of Miami Beach for municipal purposes and, in addition, established a separate
three member committee to meet with the representatives of cultural arts groups and other potential
users to discuss potential uses of this property and funding strategies for its acquisition. The
committee shall consist of the City Manager or his designee, the City Attorney or his designee, and
a City Commissioner. ColIll)1issioner Smith was selected as the Commission's appointment to the
negotiating committee and Vice-Mayor Liebman was selected as the Commission's appointment to
the committee to meet with representatives of cultural arts groups.
Although I will be involved with both of the committees, I am appointing Assistant City Manager
Christina Cuervo to the negotiating committee and Executive Assistant Ronnie Singer to the
committee to meet with representatives of cultural arts groups.
