HomeMy WebLinkAboutGMP Amendment - Normandy Shores Clubhouse Addition Demolition Amendment # II-A :2606- ;'("1 q7 ~ 7/5 - ~J% (, EXHIBIT I "EXHIBIT I" TO CONSTRUCTION MANAGER AT RISK AGREEMENT Normandy Shores Clubhouse Addition Demolition GMP AMENDMENT # II-A THIS GMP AMENDMENT, made and entered into as of this tfl day of /t'JlkI, ~7 ' , ("GMP Amendment") amends that certain Agreement between Owner, the CITY OF MIAMI BEACH, FLORIDA (also, City) and Construction Manager, COASTAL CONSTRUCTION OF MONROE INC., COASTAL CONSTRUCTION COMPANY (hereinafter Construction Manager or CM @ Risk ), made as of the 10th day of May 2006, for the following described Project: Normandy Shores Golf Course -Clubhouse Demolition of Additions, for documents dated 2/14/07 2499 Biarritz Drive, Miami Beach Florida WHEREAS, the Owner and the Construction Manager have agreed to amend the Agreement in the manner set forth herein. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, in the Agreement and the other Contract Documents and for such other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Owner and the Construction Manager do hereby agree as follows: 1. This GMP Amendment is executed in connection with, and is deemed to be part of the Agreement and the Contract Documents. Wherever the terms of this GMP Amendment 11- A and the terms of the Contract Documents are in conflict, the terms of this GMP Amendment 11- A shall govern and control. The terms used herein, unless otherwise defined in this GMP Amendment, shall have the meanings ascribed to them in the Contract Documents. 2. The following are hereby incorporated into the Contract Documents and made part thereof: a. The drawings listed on Attachment I, attached hereto, which drawings are made a part of the Contract Documents by this reference (the "Drawings"); and b. The specifications listed on Attachment II, attached hereto, which specifications are made a part of the Contract Documents by this reference (the "Specifications"); (N/A) and c. Those documents listed on Attachment III, Additional Contract Documents, refer to the executed pre-construction services agreement for reference. d. Those documents listed on Attachment IV, Construction Manager proposal and Qualifications and Assumptions, attached hereto, are made a part of the Contract Documents by this reference. e. The Scope of the Work for the Project, as described in Attachment I is hereby incorporated into the Work. f. The date of Commencement for the construction of Project shall be one week following the last date of execution of this amendment by the parties hereto (the "Date of Commencement"). g. The Construction Manager shall achieve Substantial Completion of the Work for this Project no later than 24 Business days from the Date of Commencement (the "Contract Time", and final completion not later than 2 days from the date of Substantial Completion. Failure to meet either the Substantial Completion or Final Completion dates shall be a material breach of this Agreement. h. The Guaranteed Maximum Price for the Project, is hereby guaranteed by the Construction Manager not to exceed the sum of $87,150.00 (the "Project GMP Amendment Phase II-A"), based upon the entire Scope of the Work as described in the Contract Documents, including, but not limited to, the Drawings and the Specifications, subject only to additions and deductions by Contract Amendment(s) or Construction Change Directive, as provided in the Contract Documents. The GMP is more particularly itemized in the Schedule of Values prepared in accordance with the terms of the Agreement, which Schedule of Values is attached hereto as Attachments VI and made a part of the Contract Documents by this reference. Included in the Schedule of Values and specifically identified herein, the Contingency included in the Guaranteed Maximum Price is the amount of $4,111.00. i. The Construction Manager shall provide Commercial General Liability Insurance, Automobile Liability Insurance, and Worker's Compensation Insurance in compliance with the provisions of Article II, Insurance and Bonds of the General Conditions of the Contract for Construction. j. The Construction Manager shall provide the Public Construction Payment Bond and the Public Construction Performance and Guarantee Bond, in compliance with the provisions of Article II, Insurance and Bonds of the General Conditions of the Contract for Construction. k. Locations for utilities will be determined by the Construction Manager, at the execution of GMP Amendment Phase II-A, and all existing utility connections will be capped as noted in the qualifications and Assumptions statement. I. The Construction Manager's on site management and supervisory personnel for this Project shall be set forth herein, and incorporated as Attachment VII to this Agreement. m. To the extent that the Owner has authorized the Construction Manager @ Risk, in writing, to perform the Work for this Project with the Construction Manager's @Risk own forces, the salary and wage schedule for the Construction Manager's personnel performing such portion of the Work, agreed upon by the City and the Construction Manager, shall be as set forth on Attachment III & IV attached hereto, and is made a part of the Contract Documents by this reference. The Construction Manager @ Risk warrants and represents that the salary and wage schedule includes comparable market rates (including any and all benefits, contributions and insurance) charged by the Construction Manager @ Risk for comparable contracts to other business and individuals for similar services, and that such rates are not higher than the standard paid for this Project. n. Though the project has a short duration and limited scope a project schedule will be provided as Attachment V. Also refer to date of commencement and "contract time" items "f' and "9" of this agreement. o. Except as expressly provided herein above all of the terms, conditions, covenants, agreements and understandings contained in the Contract Documents shall remain unchanged and in full force and effect, and the same hereby expressly ratified and confirmed by the Owner and Construction Manager @ Risk. p. This exhibit I GMP Amendment Phase II-A may be executed in several counterparts, each of which shall be deemed an original but all of which shall constitute one and the same instrument. Any variance between the qualifications and the plans, the qualifications shall prevail. 2. The purpose of this interior selective demolition project is to further uncover the integrity of the existing structure. This demolition includes the complete removal of the interior "build-out" of the clubhouse and sand-blasting the metal joist system in the Maintenance Building. The design team shall review the existing structure and determine the scope required for the completion of the Clubhouse and Maintenance Building. 3, This Estimate is based on a Start Date in April 2007 and completion of the project in 25 working days subject to prompt permit approvals and responses by authorities. 4, Builders Risk Insurance shall be provided by Owner in an amount and form satisfactory to Contractor. This policy must name Coastal Construction, (Contractor) as a co-insured and will be required prior to the start of construction. All Builders Risk insurance deductible costs and costs for under insured (or uninsured) items are the sole responsibility of the Owner. 5. The following items are specifically excluded from this Proposal: . Topographical Final Surveys and Elevation Certificates, · Unforeseen Subsurface Conditions (IE: Contaminated soil removal and replacement, pockets of unsuitable soil conditions for foundations) · Testing Services including but not limited to, concrete material, soil density, glazing, waterproofing, etc, . Architectural or Engineering Services, · Environmental Testing. ~r0 6. All costs for all building permits, specialty permits, p=' ,:1 ~:til~, and pirmit fees shall be paid by the Owner, Individual sub trade permits are included by each affected Subcontractor. The General Contractor and all affected Subcontractors shall be responsible for coordinating all associated permits and related requirements including but not limited to filling out and submitting Permit Applications and supporting documents. 7. It is assumed that a portion of the project site may be utilized for construction parking and staging areas throughout the duration of the project at no charge to the Contractor from the Owner or any authorities having jurisdiction. 8. Payment and Performance Bonds are excluded, Page 1 oD Attachment IV 9. Jobsite Security Services is excluded. 10. Asbestos abatement is included in accordance with the documents prepared by Professional Service Industries dated June 13,2006. Quantities and locations of asbestos abatement work are based on this report. II. The Existing Maintenance Building is assumed to be free of any Hazardous Materials. Any Hazardous Materials Abatement, Demolition, or Disposal is excluded. 12. DERM & DPEP Filings & Notices are included. 13. Sheet Piling, Shoring, Bracing, or otherwise protecting and stabilizing of existing structures to remain is Excluded. 14. Fire extinguishers shall be utilized as temporary fire protection for the duration of the project. 15. The existing roof shall be removed only at areas scheduled to be demolished. An allowance of $2,500 has been included for associated patch work in these areas only. In order maintain any warranties that the existing roof may have in place, Coastal shall attempt to utilize the original roofing contractor (City of Miami Beach to provide contact information). 16. Any existing roof damage prior to commencement of work shall be the responsibility of the City of Miami Beach. Roof patch work and repairs associated to the demolition scope shall be done utilizing above allowance. Damage caused by Coastal in areas not associated with the demolition scope of work shall be the responsibility of Coastal. 17. All sidewalks, drives, landscaping, and utilities surrounding the Clubhouse and Maintenance building shall remain. Restoration, repairs, or alterations of such items are excluded. 18, Electrical Service for the demolition work shall be supplied by subcontractor provided generators. Temporary power stations, panels, and other power sources are excluded. 19. An allowance of $500 is included for all utility disconnects (including but not limited too: water, electrical, gas). This allowance also includes the cost to provide the temporary water service required for demolition work. 20. Clubhouse shall receive a temporary construction fence for duration ofthe demotion process At, ~.~ 21. Coastal shall cover'e;c~or ..\a~~o~moval) with standard Pl~OOd material mounted directly to the exterior walls of the structure. All plywood co{,ers shall be painted flat white. Note: plywood covers do not provide a watertight seal; water intrusion is possible. Page 2 00 Attachment IV 22, All interior drywall, drywall partition framing (wood and metal), insulation, and wood paneling shall be removed from the Clubhouse building. 23. Coastal has assumed that the existing structure is supported by a shallow foundation system. Removal of pilings or other systems not associated / indicated with a shallow foundation system is excluded as part ofthis estimate. 24. A I O'x 10' section of existing terrazzo flooring shall be refurbished. The intent of this exercise is to assess the quality ofthe finish floor meets the owners and architects approval. 25. All precautions will be taken to preserve existing plaster cornice details, wood ceilings, and fireplaces. Contractor shall be held harmless of any existing damage and/or new damage caused by construction. 26. Contractor will provide Owner with the option to relocate the existing kitchen equipment before being disposed of. If this option is exercised all equipment will be removed and delivered within 50 miles from the site. Contractor is to be held harmless of any existing damage(s) and/or new damage(s) to the equipment. Reassembly, installations, restorations, repairs and any other associated work with the equipment is excluded. 27. With the exception to the kitchen equipment, the demolition Subcontractor shall have exclusive salvage rights for all materials, furnishings, equipment, and accessories in or around the building and site. Sorting and distributing of such items shall be performed on site. 28. The work associated with the removal of the existing FPL vault shall be coordinated with FPL, however performed by demolition contractor. Any deposits, permits, fees, or other cost associated with this work is excluded. 29. Exposed steel joist members in the Maintenance Building shall be sandblasted. This work will be performed to determine if the existing rust can be removed; this does not provide a guarantee that all rust can be removed. 30. Any associated work with existing fuel tanks is excluded. 31. Maintenance building surrounding area shall be cleaned of all debris and trash. No work at Clubhouse exterior site.
