RESOLUTION NO. 99-23030
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING AND APPROPRIATING THE
FUNDING NECESSARY TO IMPLEMENT THE ARCHITECTURAL AND
ENGINEERING DESIGN AGREEMENT WITH ROBERT A. M. STERN
ARCHITECTS (ARCIDTECT) FOR THE PROPOSED REGIONAL LIBRARY
PROJECT, IN THE TOTAL AMOUNT OF $1,370,000; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE AN AMENDMENT TO SAID AGREEMENT,
WIDCH REFLECTS A CHANGE IN THE SCOPE OF WORK, DELETING THE
PROPOSED FOUR HUNDRED (400) SPACE PARKING GARAGE STRUCTURE,
AND PROVIDING TWO SURFACE PARKING LOTS IN ITS PLACE; AND
FURTHER REQUIRING THAT THE ARCIDTECT MAINTAIN ITS
COMPENSATION FOR THE PARKING GARAGE DESIGN AT $200,000, IN
ACCORDANCE WITH THE ORIGINAL FEE, PROVIDED THE CITY NOTIFIES
THE ARCIDTECT WITHIN (36) TIDRTY-SIX MONTHS OF THE DATE OF
EXECUTION OF THE AGREEMENT THAT IT WISHES TO PROCEED WITH THE
DESIGN OF SAID GARAGE.
WHEREAS, on September 23, 1998, the Mayor and City Commission adopted Resolution No. 98-
22904, authorizing the Administration to execute an Agreement with the fIrm of Robert A. M. Stem Architects
(the Agreement) for the architectural and engineering design of a Regional Library; a 400-space Parking Garage;
and Park and Streetscape hnprovements in the area surrounding Collins Park (the Project); and
WHEREAS, due to developments in the acquisition of the properties required for the construction of
the complete Project, as set forth above, the proposed 400-space parking garage must be deleted from the scope
of work of the Project at this time; and
WHEREAS, two surface parking lots will be provided in place of the proposed 400-space parking
garage; and
WHEREAS, accordingly, the Administration recommends that the Mayor and City Commission approve
an Amendment to the Agreement, reflecting the aforestated change in the scope of work; and
WHEREAS, notwithstanding the foregoing, the Mayor and City Commission directed the
Administration to include a provision in the Agreement that the Architect maintain its fee for the design of the
parking garage at $200,000, in accordance with the original fee; and
WHEREAS, the Mayor and City Commission further directed the Administration to include a provision
that the Architect maintain the aforestated fee for (36) thirty-six months from execution of the Agreement,
provided the City notifies them within this period that it wishes to proceed with the design of the parking garage;
and
WHEREAS, the Administration is also requesting approval of the appropriation of the funding
required to implement the Agreement, in the amount of $1,370,000.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE OTY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission of the City of Miami
Beach, Florida, authorize and appropriae the funding necessary to implement the architectural and engineering
design agreement with Robert A. M. Stem Architects (Architect) for the proposed Regional Library project, in
the total amount of$I,370,000; authorize the Mayor and City Clerk to execute an amendment to said Agreement,
which reflects a change in the scope of work, deleting the proposed four hundred (400) space parking garage
structure, and providing two surface parking lots in its place; and further requiring that the Architect maintain
its compensation for the parking garage design at $200,000, in accordance with the original fee, provided the City
notifies the Architect within (36) thirty-six months of the date of execution of the Agreement that it wishes to
proceed with the design of said garage.

Adopt the Resolution.
FTJNDING:
Funds in the amount of$I,281,500 from the $l1.5M for the Library, in the General Fund Reserve
for Capital Improvements; $10,000 are available from the $21M Parking Revenue Bond issue; and
$78,500 from the City Center RDA Construction Fund. The total amount of $1,370,000 will be
appropriated to a work order to be established foi'the Cultural CampuslRegional Library.
BACKGROTJND:
On June 3, 1998, a recommendation was made by the City Manager to the Mayor and City
Commission for authorization to negotiate an agreement with the firm of Mateu, Carreno, Rizzo
and Partners for the architectural and engineering design of a regional Library, a 400-space Parking
Garage and Park and Streetscape Improvements in the area surrounding Collins Park. After
substantial discussion, the Mayor and City Commission recommended that the Administration
negotiate with the top ranked firm of Robert A. M. Stern Architects (Stem).
On September 23, 1998, the Administration presented a resolution to the Mayor and City
Commission requesting authorization to execute an agreement with Stem for a Regional Library,
a 400-space Parking Garage and Park and Streetscape Improvements in the area surrounding Collins

Park. The total negotiated fee was $1,570,000 which included basic design services for the Library
and a 400-space Parking Garage, park schematics, landscaping, and schematic design for the
Rotunda Building in Collins Park. The Mayor and City Commission adopted Resolution No. 98-
22904 authorizing the Administration to execute the agreement.
On November 18, 1998, the City Commission directed the Administration not to proceed with the
design of a 400-space Parking Garage and to instead design two surface lots in parcels 2 and 4.
ANALYSTS:
The Administration is now presenting a resolution requesting the appropriation of funds for the
above described agreement with Stem as modified by the change in scope of services. The 400-
space Parking Garage has been deleted from the scope of the project and the two surface lots added
in its place. The agreement with Stem, in the original amount of $1 ,570,000, has been modified to
reflect the changes in scope and the new contract amount of$I,370,000.

The Mayor and City Commission should appropriate the necessary, funding in the total amount of
$1,370,000, to implement the architectura1 and engineering design agreement with Robert A. M.
Stem Architects for the proposed Regional Library and Park and Streetscape Improvements in the
area surrounding Collins Park, and further authorize an amendment to said agreement.
