A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AMENDMENT NO.4, TO THE DESIGN/BUilD AGREEMENT WITH RIC-MAN
INTERNATIONAL, INC., FOR THE WASHINGTON AVENUE IMPROVEMENTS, PHASES II, IV,
AND V; SAID AMENDMENT IN THE AMOUNT OF $574,560, TO PROVIDE DESIGN,
PERMITTING, CONSTRUCTION AND CONSTRUCTION ADMINISTRATION SERVICES FOR
THE RESTORATION OF MEDIANS IN WASHINGTON AVENUE AND THE INSTAllATION OF
NEW lANDSCAPING, FROM 6TH STREET TO 16TH STREET; AND APPROPRIATING FUNDS, IN
THE AMOUNT OF $575,000, FOR THE PROJECT FROM CAPITAL UPKEEP INVESTMENT
ACCOUNT AND QUALITY OF LIFE FUNDS.
WHEREAS, the Washington Avenue Improvements Project, Phases II, IV, and V (the
Project) is one of the components of the City's neighborhood improvements projects; and
WHEREAS, construction of the Project is presently well ahead of schedule and is nearing
completion; and
WHEREAS, in January 2004, the City entered into a Design/Build Agreement with the firm
of Ric-Man International, Inc. (Ric-Man), for the design and construction of the improvements which
consisted of drainage, water and sewer installations, and included lighting, landscaping, sidewalks,
and other renovations and reconstruction (the Agreement); and
WHEREAS, the latest hurricanes that impacted South Florida severely damaged the
existing landscaping in the medians on Washington Avenue; and
WHEREAS, with the exception of the median restoration between Lincoln Road and 16th
Street, and between 5th Street and 6th Street, the necessary repair work is outside of the Agreement;
and
WHEREAS, the City's Urban Forester (in the City's Park and Recreation Department,
Greenspace Division) prepared a repair and replanting proposal which provides for a combination of
different types of species within different areas of the medians, that is compatible with planting in
narrower spaces; and
WH EREAS, these species are a more appropriate fit than Live Oaks for medians of these
widths and will have a much higher chance of surviving weather conditions and remaining healthy;
and
WHEREAS, Ric-Man has priced this option (Option 1) at approximately $425,000, with a
scope of work which includes replanting the medians, per the Forester's plant designation, repair of
broken curbing, repair of irrigation and repair of the landscape lighting; and
WHEREAS, the Administration also requested a second change order proposal from Ric-
Man, to replace the damaged landscaping, add some enhancements, and repair or replace the
lighting and irrigation within the medians between 11 th Street and 16th Street; and
WHEREAS, a proposed change order for the replanting and enhancement of the medians
from 6th Street to 11 th Street, consistent with the design of the medians from 11 th Street to 16th
Street, was also obtained from Ric-Man in order to address the entire Project corridor; and
WHEREAS, in the second proposed change order request, the Administration requested
the evaluation of the possible widening of the medians from 11 th Street to 16th Street, in order to
provide for a larger planting area and to allow consideration of a different and larger tree species,
which seems to be a preference within the community; and
WHEREAS, the expansion was to be a uniform expansion of approximately four feet on
each side of the existing medians and was originally valued in the amount of $350,000; and
WHEREAS, as part of the City's due diligence, staff checked the proposed median
expansion for regulatory requirements and determined that the medians be provided with a turning
lane at each corner with the associated stacking and tapering space if they were expanded and the
turning area would be required for permitting by the County and operationally would provide for
improved mobility and traffic flow in the corridor; and
WHEREAS, the second Ric-Man proposal for the complete expansion, landscaping and
modification of the medians at Washington Avenue is split into two components: one, for the area
between 6th Street to 16th Street, in the amount of approximately $500,000 (Option 2); and two, for
the area between 11th street to 16th Street, in the amount of approximately $1,000,000 (Option 3);
and
WHEREAS, City Commission consideration at this point in the Project is important, as Ric-
Man is close to completing the Project and if landscape or other enhancements are made very soon
the changes can be integrated with less cost and without the necessity to damage final paving on
the street; and
WHEREAS, based on the high cost of the second proposed change order for landscaping
improvements, complete/uniform median expansion, and the necessary regulatory modifications, it
is the Administration's recommendation that the improvements, as proposed in Options 2 and 3, not
be implemented, as the cost of the improvements is very significant in comparison to the overall
benefits received; and
WHEREAS, the Administration recommends that Option 1 be implemented with the limited
improvements in landscaping and renovation of the existing installations, and including the use of
Hurricane palms, as requested by the City Commission; and
WHEREAS, the Administration recommends approval and execution of Amendment No.5,
in the amount of $574,560, for the addition of Hurricane palms and other improvements to the
Medians in Washington Avenue, from 6th to 16th Street.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize
the Mayor and City Clerk to execute Amendment No.4, to the Design/Build Agreement with Ric-
Man International, Inc., for the Washington Avenue Improvements, Phases II, IV, and V; said
Amendment in the amount of $574,560, to provide design, permitting, construction and construction
administration services for the restoration of medians in Washington Avenue, and the installation of
new landscaping from 6th Street to 16th Street; and appropriating funds, in the amount of $575,000,
for the Amendment from the Capital Upkeep Investment . ccount and Quality of Life Funds.

Item Summary/Recommendation:
The Wash. Ave. Improvements Project is a component of the City's neighborhood improvements projects.
Construction is presently well ahead of schedule and is nearing completion. In January 2004, the City
entered into a Design/Build Agreement with the firm of Ric-Man International, Inc., for the design and
construction of the improvements which consisted of drainage, water and sewer installations, lighting,
landscaping, and sidewalks. The latest hurricanes that impacted South Florida severely damaged the
existing landscaping in the medians at Wash. Ave. The City prepared a repair and replanting proposal
which provides for a combination of different types of species within different areas of the medians that is
compatible with planting in narrower spaces. The City's proposal is based on current arboricultural science
and is specific to the existing streeUmedian configuration. The present width of the Wash. Ave. medians
does not provide adequate rooting space for a large tree species, such as Live Oaks. With median widths
narrower than 12 feet, smaller tree species are recommended such as Bridalveil, Spanish Stopper, and
Clerodendrum. These species are a more appropriate fit than Live Oaks for medians of narrow widths and
will have a higher chance of surviving weather conditions and remaining healthy. This planting option is
priced at approximately $350,000 (Option 1). The Administration requested In the second proposed
change order request, the evaluation of the possible widening of the medians from 11 th Street to 16th Street
in order to provide for a larger planting area and to allow consideration of a different and larger tree
species. City staff analyzed the traffic implications of the expansion of the medians and determined that
turning lanes would have to be provided at each intersection. Ric-Man has provided a new proposal for
this work which is valued at +/-$1 million which includes the expansion, landscaping, and other
improvements (Option 2). Ric-Man was also asked to provide a proposal for improving the medians from
6th St. to 11th St. to make them consistent with the other planting and medians scheme. This proposal is
valued at +/-$500,000 (Option 3). Both proposals were reviewed by Hazen & Sawyer and CIP and found to
have inconsistencies and inaccuracies. Ric-Man was directed to correct them and submit them with proper
detail and substantiation. The new proposals will be completed next week and presented as supplemental
material to this Commission Memorandum. Based on the expected cost of the full improvements, the
Administration cannot recommend Options 2 or 3 for median improvements. The Administration instead
recommends that an Amendment, based on Option 1, in the amount of $425,000, which includes a
contingency, be implemented. This option would provide for complete replanting of the corridor with trees
appropriately sized to the median area and repair of the landscape lighting, irrigation and damaged
curbinq.

Approve option 1 for the replanting and repair of landscape lighting, irrigation and curbing on
Washington Avenue between 6th Street and 16th Street.
FUNDING
Funding, in the amount of $225,000 is available from the Capital Investment Upkeep
Account appropriated for fiscal year 2005-2006, for renewal and replacement of non-facility
upkeep such as landscaping; in the amount of $200,000, from South Beach Quality of Life
Funds.
ANAL YSIS
The Washington Avenue Improvements Project, Phases II, IV, and V (the Project) is one of
the components of the City's neighborhood improvements projects. Construction of the
Project is presently well ahead of schedule and is nearing completion. In January 2004, the
City entered into a Design/Build Agreement with the firm of Ric-Man International, Inc. (Ric-
Man), for the design and construction of the improvements which consisted of drainage,
water and sewer installations, and included lighting, landscaping, sidewalks, and other
renovations and reconstruction.
The latest hurricanes that impacted South Florida severely damaged the existing
landscaping in the medians at Washin~ton Ave. With the exception of the median
restoration between Lincoln Road and 16t street and between 5th Street and 6th Street, the
necessary repair work is outside of the Agreement with Ric-Man. The restoration of
landscaping is also not eligible for FEMA refunding.
The City's Urban Forester (In the City Park and Recreation Department, Greenspace
Division) prepared a repair and replanting proposal which provides for a combination of

different types of species within different areas of the medians that is compatible with
planting in narrower spaces. The Forester's proposal is based on arboricultural science and
is specific to the existing street/median configuration. The present width of the Washington
Avenue medians does not provide adequate rooting space for a large tree species, such as
Live Oaks. With median widths narrower than 12 feet, smaller tree species are
recommended such as Bridalveil (a smaller shade tree that has mature heights of
approximately 35 feet) for widths between 11 feet and 7 feet, Spanish Stopper (a decorative
tree with mature heights of 10 to fifteen feet) for medians between 7 feet and 5 feet, and
Clerodendrum (a decorative shrub) for 5-foot medians. These species are a more
appropriate fit than Live Oaks for medians of these widths and will have a much higher
chance of surviving weather conditions and remaining healthy.
Ric-Man has priced this option (option 1) at approximately $425,000. The scope of work
would include replanting the medians per the Forester plant designation, repair of broken
curbing, repair of irrigation and repair of the landscape lighting.
The root area is important as trees not provided with adequate rooting space, grow slowly
and do not usually achieve full size. Trees with insufficient rooting area will eventually go into
decline after all rooting space is filled and must be replaced. Trees with insufficient root area
are vulnerable to uprooting, particularly in higher winds (topical storm force winds of 39 mph
and higher), often damaging pavement, sidewalks, underground utilities and other
infrastructure. Recommended minimum rooting space for large trees, based on mature
crown size, is 400 square feet. Also, in order to achieve wind-firmness, trees must be able
to extend anchoring roots in all directions, not in only two directions as is typical on narrow
medians. Therefore it was recommended that Live Oaks not be planted on medians with a
width of less than 12 feet.
The Administration also requested a second change order proposal from Ric-Man, to
replace the damaged landscaping, add some enhancements, and repair or replace the
lighting and irrigation within the medians between 11th Street and 16th Street. Because the
expansion and modification of the medians from 5th Street to 6th Street and from 16th Street
to Lincoln Road are already part of the Ric-Man Agreement for Washington Ave. and the
proposed expansion and modification of the medians from 11 th to 16th Streets would be
consistent with this design, a proposed change order for the replanting and enhancement of
the medians from 6th Street to 11 th Street was also obtained from Ric-Man in order to
address the entire project corridor.
In the second proposed change order request, the Administration requested the evaluation
of the possible widening of the medians from 11 th Street to 16th Street in order to provide for
a larger planting area and to allow consideration of a different and larger tree species, which
seems to be a preference within the community. The expansion was to be a uniform
expansion of approximately four feet on each side of the existing medians. This expansion
originally had a lump sum value in the amount of $350,000. As part of the City's due
diligence, staff checked the proposed median expansion for regulatory requirements and
determined that the medians be provided with a turning lane at each corner with the
associated stacking and tapering space if they were expanded. The turning area would be
required for permitting by the County and operationally would provide for improved mobility
and traffic flow in the corridor. Without the turning area, many left turns would have to be
made from one of the two existing travel lanes, causing lane blockages at each intersection.
The potential traffic implications of the median expansion and the requirement for turning
lanes significantly modified the initial proposals and the consideration of additional costs.
The second proposal from Ric-Man provides for the expansion of the medians, the addition
of turning lanes, the consideration of the varied tree species in accordance with the arborist
City Commission Memorandum - Washington Avenue Medians

recommendations, and the associated modifications such as pavement reconstruction, curb
& gutter, soil, existing electrical repairs, existing irrigation repairs and expansion, etc.
The second Ric-Man proposal for the complete expansion, landscaping and modification of
the medians at Washington Avenue is split into two components. The first component from
6th Street to 16th Street is approximately $500,000 (option 2). The second component for the
work from 11th street to 16th Street is approximately $1 ,000,000 (option 3).
The second proposal has been reviewed by Hazen & Sawyer (H&S) and by the CIP Office
and has been found to have inconsistencies and inaccuracies. H&S and CIP have
discussed it with Ric-Man and have requested that a new corrected second proposal be
presented with more detail and substantiating material. The revised second proposal is
expected for early next week and will be presented as supplemental material to this
Commission Memorandum.
Commission consideration at this point in the project is important as Ric-Man is close to
completing the project. If landscape or other enhancements are made very soon the
changes can be integrated with less cost and without the necessity to damage final paving
on the street.
CONCLUSION
Based on the high costs of the second proposed change order for landscaping
improvements, complete/uniform median expansion, and the necessary regulatory
modifications, it is the Administration's recommendation that the improvements as proposed
in options 2 and 3 not be implemented. The cost of the improvements is very significant in
comparison to the overall benefits received. The Administration recommends instead the
implementation of the initial Option 1 proposal with a complimentary appropriation of
$425,000 which includes a construction contingency. This option would provide for
complete replanting of the corridor with trees appropriately sized to the median area and
repair of the landscape lighting, irrigation and damaged curbing.

SUBJECT: WASHINGTON MEDIANS SUPPLEMENTAL MATERIALS
As mentioned in Commission Memorandum R7E in this agenda, the City continued
negotiations with Ric-Man International, Inc. (Ric-Man) to obtain proposals for the complete
landscaping of all medians within Washington Ave. from 6th Street to 16th street and for the
widening of the medians and creation of turning lanes from 11th Street to 16th Street. The
landscaping included in these proposals is a combination of smaller trees such as the ones
in the agenda item and Live Oaks. The idea is that if the medians are widened larger trees
such as Live Oaks can be planted because the restrictions present in the current narrower
medians is then no present anymore.
Costs, in the amount of $954,000, for the widening of the medians from 11 th Street and 16th
Street are produced primarily by a significant amount of existing utilities that must be
relocated such as light poles, FPL services, water meters, etc. (Attachment 1). In addition
the widening of the medians require all curbs to be removed and new curbs provided;
additional pavement demolition and placement; new irrigation systems; more extensive
corrections and adjustments to the existing electrical systems; more extensive replacement
and additions to the existing pavers; etc. Costs, in the amount of $459,000, for the existing
medians from 6th Street to 11 thth Street are produced by the new landscaping combination of
Live Oaks and smaller trees in lieu of the plantings of smaller trees only as presented in the
Commission Memorandum'. (Attachment 2)
In addition to the above scope, there are more costs associated with engineering and
documents creation, with inspection services, with permitting, with Public Information, and
with a more extensive Maintenance of Traffic Plan which are all included in the proposals.
The costs of the larger median expansion and landscaping also will require additional funds,
in the amount of $140,000, for contingency and funds, in the amount of $67,000, for CIP
management.
A sketch of the proposed widening and turning lanes is included in these supplemental
materials for information. The costs of the proposed improvements to the medians from 5th
Street to 6th Street and from 16th Street to Lincoln Road are also included in these materials
for information. The design of these two sections of Washington Ave. was included in the
original Agreement with Ric-Man but the cost of construction was not included except as an
estimate, in the amount of $250,000, within the contingency. Currently there are funds
remaining in the contingency for this work.
