98-22842 RESO RESOLUTION No. 98-22842 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE SEVENTH AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 1997/98, IN THE AMOUNT OF $25,000, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS. WHEREAS, Section 932.705, Florida Statutes, addresses the purposes and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures exists and the appropriation and the expenditure of forfeiture funds is in compliance with Section 932.705, Florida Statutes, and with Federal guidelines; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Seventh Amendment to the 97/98 Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $25,000, as reflected in the attached Exhibit "A". Is a not for profit organization established in 1996 in Miami beach and is funded by a variety of public and private sources. Currently, its principal purpose was to combat gang recruitment of minors by providing educational, recreational and social services to low income families and their children. The children participate either on a voluntary basis or by recommendations from social service agencies. This is the second year which the Miami Beach Police Department has made a financial contribution to the program from Confiscation Funds. This Department has evaluated the program and found it to be an exceptionally well-managed and productive program which provides needed mentoring for the students involved. Kasdin and Members of the City Con ission DATE: JlILY 15, 1998 FROM: Sergio Rodriguez City Manager SUBJECT: REQUEST USE FUNDS FROM THE CONFISCATION TRUST FUND TO PROVIDE FUNDING FOR "COOL SCHOOL OF DADE COUNTY INC,", (To continue the Cool School Program at Fienberg-Fisher Elementary) , ADMINISTRATION RECOMMENDATION Adopt the Resolution BACKGROUND Florida Statute 932.705 provides for, but is not limi ted to, expenditure of forfeiture funds for crime prevention, other law enforcement purposes and contribution to an organization that benefits the youth of Miami Beach. The Chief of Police of the City of Miami Beach has determined that the need for the appropriation and expenditures of forfeiture funds is in compliance with Section 932.705, Florida State Statutes. ANALYSIS The Administration requests authorization to adopt the Seventh Amendment to the operating budget for the FY 97/98 Police Confiscation Trust Fund in the amount of $25,000 from State funds to be used to provide funding for the expenditures listed in Exhibit "A". In accordance with Florida State Statute 932.705, forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has complied with all statutory procedures involved in the transaction of these funds.
