A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, REGARDING ACQUISITION OF
CERT AIN PROPERTIES HAVING STREET ADDRESSES OF 340 23RD
STREET, AND 211 22ND STREET, MIAMI BEACH, FLORIDA, LEGALLY
DESCRIBED ON EXHIBIT "A" ATTACHED HERETO AND
INCORPORATED BY REFERENCE HEREIN, SAID ACQUISITION
DEEMED AND DECLARED TO BE NECESSARY FOR A PUBLIC
PURPOSE; AND SPECIFICALLY APPROVING AND AUTHORIZING THE
ACQUISITION OF THE PROPERTY BY THE CITY BY PURCHASE,
DONA TION OR THROUGH THE FILING OF EMINENT DOMAIN
PROCEEDINGS, INCLUDING A DECLARATION OF TAKING, AS
NECESSARY,
WHEREAS, the City of Miami Beach (the "City") has determined a need for a Regional
Library to be located within the city limits; and
WHEREAS, the City has determined a need for a parking garage to meet zoning
requirements for the Regional Library and other activities in the Cultural Center; and
WHEREAS, the area in which the Bass Museum is located has been identified for
development as a Cultural Center to include a Miami-Dade Regional Library, a Miami City Ballet
facility, a parking garage and other related facilities (the "Cultural Center").
NOW, THEREFORE, BE IT DUL Y RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows:
Section 1. The matters set out in the foregoing recitals are true and
correct, and they are hereby incorporated as a portion of this Resolution.
Section 2. The acquisition of the fee simple title interest to the Properties
having street addresses of 340 23rd Street (Property "A"), and 211 22nd Street
(Property "B"), Miami Beach, Florida, each being legally described on Exhibit "A"
attached hereto and incorporated by reference herein (collectively, the "Properties"),
is deemed and declared to be necessary for the public purpose of constructing the
Miami-Dade Regional Library and a parking garage, which are components of the
Cultural Center project.
Section 3, The Mayor and City Commission hereby specifically approve
and authorize the acquisition of the fee simple title interest to each of the Properties
by the City through the filing of eminent domain proceedings, including a declaration
of taking, as necessary.

RECOMMENDATION:
Adopt the Resolution.
BACKGROUND:
The site adjacent to the Bass Museum and bounded by 22nd Street, Park Avenue, 23rd Street and
extending east of Liberty Avenue has been identified as the location for the Cultural Campus which
will include a regiona11ibrary, public parking garage and other activities. Initially, six parcels
needed to be acquired. Two parcels remain to be acquired.
To facilitate the acquisition, it is recommended that the City of Miami Beach purchase the properties
identified as 211 22nd Street and 340 23rd Street. These two parcels are identified for reuse as the
regional library and the public parking garage, respectively.
ANAL YSIS:
The need for a regional library and an associated parking garage has been demonstrated. Therefore,
acquisition of these properties by the City of Miami Beach through purchase, donation, acquisition
or filing of eminent domain will facilitate this process. The Administration will continue to update
the Commission on a regular basis as to the status of the acquisition process.

CONCLUSION:
It is recommended that the Mayor and City Commission of the City of Miami Beach, Florida, adopt
the attached Resolution authorizing the acquisition by the City of the above-described parcels by
purchase, donation, acquisition or the filing of eminent domain proceedings.
